RESOLUTION NO. 2550
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS
SPECIAL IMPROVEMENT DISTRICT NO. 647 FOR THE PURPOSE OF
ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION
AND ENGINEERING CERTIFICATION OF THE ASPHALT PAVING, STORM
DRAINAGE, CURB AND GUTTER ON A PORTION OF HIGHLAND BOULEVARD
AND AN 8-INCH SANITARY SEWER MAIN AND ALL OTHER NECESSARY
I APPURTENANCES.
WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana,
held on the 19th day of February, 1985, the said City Commission duly passed Resolution No.
2543, declaring it to be the intention of the said City Commission to create a Special
Improvement District to be known and designated as Special Improvement District No. 647 for
the purpose of accomplishing the engineering design, construction, inspection and engineering
certification of the asphalt paving, storm drainage, curb and gutter on a portion of Highland
Boulevard and an 8-inch sanitary sewer main and all other necessary appurtenances. Said
construction and installation to include all street excavation, subgrade improvement, gravel
street base, asphalt street base, asphalt surfacing, concrete curb and gutter, gravel walkway,
storm drain inlets and pipe, sanitary sewer pipe and services, manholes, traffic control
devices and all other necessary appurtenances. That said Commission Resolution No. 2543 is
hereby referred to and made a part hereof for further particulars in respect to the boundaries
of said Special Improvement District No. 647, the estimated cost of said improvements and the
method of assessing the same against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No. 2543 was duly
I published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general
circulation printed and published in the City of Bozeman, Montana, and by sending a copy of
such notice by U. S. Mail to each person, firm or corporation having property within the
proposed district at his or its last known address, upon the same date that such notice was
first published as aforesaid, and due proof having been made of the publication and service
of said notice; and
WHEREAS, within the time provided by law and said published and served noticed,
there was not sufficient protest against the creation of said proposed Special Improvement
District No. 647. The City Commission was in regular session on the 18th of March, 1985, at
7 o'clock p.m., at the Commission Chamber in the City Hall Building in the said City of
Bozeman, Montana. The same was the time and place designated in said notice for passing
upon all protests, if any, against the proposed work or against the creation of said district.
And, it further appears that all of the proceedings for the creation of said district have been
lawful and regular.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONT ANA:

That the said Special Improvement District No. 647 of the City of Bozeman be and the
same is hereby created for the purpose of making improvements as set out in said Commission
Resolution No. 2543 and hereinafter described.

That said special improvements be and the same are hereby ordered to be made in
Special I mprovement District No. 647 as follows:

ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION I
AND ENGINEERING CERTIFICATION OF THE ASPHALT PAVING, STORM
DRAINAGE, CURB AND GUTTER ON A PORTION OF HIGHLAND BOULEVARD
AND AN 8-INCH SANITARY SEWER MAIN AND ALL OTHER NECESSARY
APPURTENANCES.
Sect ion 3
That the entire cost and expense of maintaining the improvements herein referred to in
said Special Improvement District No. 647 shall be assessed against the entire district. Each
lot, block, tract or parcel of land which abuts the district boundary will be assessed for that
portion of the whole cost which the length of its abutment bears to the front footage of the
entire district, exclusive of streets, avenues and alleys.
The total actual assessable footage within the entire district is 11,572.90 feet and is
the linear footage on which all assessments will be calculated.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session held thereof on the 1st day of April 1985.
