A RESOLUTION SPECIFYING WATER RATE MODIFICATIONS
TO BECOME EFFECTIVE AT A SPECIFIC DATE UPON
DEPARTMENT OF PUBLIC SERVICE REGULATION OF THE
STATE OF MONTANA, PUBLIC SERVICE COMMISSION,
APPROVAL; AND DIRECTING APPLICATION TO THE
PUBLIC SERVICE COMMISSION FOR APPROVAL THEREOF.
WHEREAS, a water rate study prepared for and accepted
by the City of Bozeman, Montana, projects a need for
extension, expansion, repair and improvement of facilities
for the provision of water to users of the utility water
supply of the City of Bozeman, Montana; and
WHEREAS, the rates and charges in effect at the present
time are not adequate to provide revenues with which to
accomplish the extension, expansion, repair and improvement
of said facilities, and to defray increased costs of
operation of said facilities; and
WHEREAS, certain statutory requirements require
construction of certain water utility facilities and the
continued maintenance thereof, thereby increasing costs of
operation of said facilities; and
WHEREAS, the provisions of said extension, expansion,
repair and improvement of said facilities is essential to
the immediate preservation of the public's health; provi-
sions therefore cannot be undertaken until the City has in
effect rates, charges and regulations adequate to assure the
funding thereof; that such rates, charges and regulations,
must, before taking effect, be approved by the Department of
Public Service Commission, under the provisions of Section
69-3-101, M.C.A., et seq., as amended; and that budgetary
requirements respecting commencement of the extension,
expansion, repair and improvement of said facilities
contemplate such rates, charges and regulations becoming
effective by May 15, 1985, to enable the City to proceed
as expeditiously as possible to accomplish the objectives
hereinabove recited.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOZEMAN, MONTANA:
1. That, subject to the provision of Paragraph 3 of this
Resolution, the schedule of rates, charges and regulations
proposed in Exhibit A, attached hereto and by this reference
incorporated herein, shall be adopted and published as the
rates, charges and regulations governing operations of the
City of Bozeman, Montana, water utility, effective May 15,
1985, unless sooner changed, modified, cancelled or
continued.
2. That the Mayor of the City of Bozeman, Montana, and the
Clerk of the City Commission are authorized and directed to
submit the petition of the City of Bozeman, Montana, to the
Department of Public Service Regulation of the State of
Montana, public Service Commission, for approval of the
rates, charges and regulations set forth in Exhibit A of
this Resolution. The City Manager and all other officials,
employees and representatives of the City of Bozeman,
Montana, are authorized and directed to do all things
necessary or convenient to accomplish the objectives of
this Resolution.

3. That the rates, charges and regulations set forth in
Exhibit A hereof shall not become effective in any event
until the Department of Public Service Regulation of the
State of Montana, Public Service Commission, has approved
the same as provided by law.
PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONTANA, this
15th day of April, 1985, as a
Resolution effective upon passage.
