HomeMy WebLinkAboutResolution 2554 Recreating SID 641: 5-06-85 . .___._._...___n..__. 081 RESOLUTION NO. 2554 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, RECREATING SPECIAL IMPROVEMENT DISTRICT NO. 641 FOR THE PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICATION OF AN 8-INCH SANITARY SEWER MAIN AND ALL OTHER NECESSARY APPURTENANCES TO SERVE ALL LOTS LOCATED WITHIN BLOCK 1 OF GRAF'S FIRST SUBDIVISION, SECOND FILING, AND BLOCKS 2, 3, 4 AND 5 OF THE AMENDED PLAT OF A PORTION I OF GRAF'S FIRST SUBDIVISION, SECOND FILING. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 18th day of March, 1985, the said City Commission duly passed Resolution No. 2548 declaring it to be the intention of said City Commission to recreate a special improvement district to be known and designated as Special Improvement District No. 641. That said Commission Resolution No. 2548 is hereby referred to and made a part hereof for further particulars in respect to the purpose of creation and the boundaries of said Special Improvement District No. 641, the estimated cost of said improvements and the method of assessing the same against the property of the district; and WHEREAS, the notice of the passage of Commission Resolution No. 2548 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U. S. mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid and due proof having been made of the publication and service of said notice; and I WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protest against the creation of said proposed Special Improvement District No. 641. The City Commission was in regular session on the 15th day of April, 1985, at 7 o'clock p.m., at the Commission Chambers in the City Hall Building in the said City of Bozeman, Montana. The same was the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation of said district. I n addition, it further appears that all the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA: Section 1 That the said Special Improvement District No. 641 of the City of Bozeman be and the same is hereby created for the purpose of making improvements as set out in said Commission Resolution No. 2548 and hereinafter described. I Sect ion 2 That said special improvements be and the same are hereby ordered to be made in Special Improvement District No. 641 as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, RECREATING SPECIAL IMPROVEMENT DISTRICT NO. 641 FOR THE PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, COMMISSION RESOLUTION NO. 2554 ---- ---- ------------------- II P 'J ,. ~, " "" ~ '...,' ~,~' j.' - INSPECTION AND ENGINEERING CERTIFICATION OF AN 8-INCH SANITARY SEWER MAIN AND ALL OTHER NECESSARY APPURTENANCES TO SERVE ALL LOTS LOCATED WITHIN BLOCK 1 OF GRAF'S FIRST SUBDIVISION, SECOND FILING, AND BLOCKS 2, 3, 4 AND 5 OF THE AMENDED PLAT OF A PORTION OF GRAF'S FIRST SUBDIVISION, SECOND FILING. Sect ion 3 That the entire costs and expenses of making the improvements herein referred to in said Special Improvement District No. 641 shall be assessed against the entire district. Each I lot, block, parcel or tract of land within the district boundary will be assessed for that portion of the whole cost which its area bears to the square footage of the entire district, exclusive of streets, avenues and alleys. The total actual assessable footage within the entire district is 446,435.78 square feet and is the area on which all assessments will be calculated.
