A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOZEMAN, MONTANA, EXTENDING THE
BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO
INCLUDE A TRACT OF LAND CONTIGUOUS TO SAID
CITY AND REFERRED TO AS THE VALLEY VIEW
GOLF CLUB PARCEL, HEREIN MORE PARTICULARLY
DESCRIBED, WITHIN THE CORPORATE LIMITS
THEREOF.
WHEREAS, Commission Resolution No. 2540 was adopted by
the City Commission on December 17, 1984, declaring it to be
the intent of the City of Bozeman to extend the boundaries
of said City so as to include said contiguous tract within
the corporate limits of the City; and
WHEREAS, said tract contains approximately 1.404 acres
and is located south of Kagy Boulevard, between the right-
of-way boundary of Fairway Drive on the west and Valley View
Golf Course on the east; and
WHEREAS, a public hearing on Commission Resolution No.
2540 was duly noticed and held on January 7, 1985; and
WHEREAS, on January 14, 1985, the Commission voted to
approve the intent to annex the tract as established in
Commission Resolution No. 2540 subject to the following
condition:
A mutual written agreement between the City and
the freeholders of the tract that defines the
provision of services including, but not limited
to, rights of way, easements, water rights or cash
in lieu, waivers of protest against creation of
SID's and water and sewer hookup fees.
WHEREAS, provision of services to said contiguous
tract is the subject of a written agreement between the City
and Valley View Golf Club, a Montana corporation, record
owner of the tract, dated June 3, 1985; and
WHEREAS, the City has received Seven Hundred Three
and 83/100 Dollars ($703.83) from the record owners of the
tract; and
WHEREAS, said contiguous tract is described by
Certificate of Survey No. 803A, as filed in the office of
the Clerk and Recorder of Gallatin County, Montana.

NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Bozeman, Montana:
Section 1
That it is hereby declared that pursuant to Title 7,
Chapter 2, Part 43, M.C.A., the following property
contiguous to the municipal boundaries of the City of
Bozeman be annexed to the City of Bozeman and that the
boundaries of said City shall be extended so as to embrace
and include such property, to wit:
A portion of that tract shown on Certificate of
Survey No. 803A as filed in the office of the
Clerk and Recorder, Gallatin County, Montana, said
portion being located in the Northwest one-quarter
of Section 19, Township 2 South, Range 6 East,
Montana Principal Meridian, Gallatin County,
Montana; being further described as follows:
Beginning at the point where the West line of that
tract shown on Certificate of Survey No. 803A
crosses the North line of Section Nineteen.
Thence South 18037'01" West on said West line a
distance of 438.46 feet. Thence South 68011'19"
West on said West line a distance of 116.22 feet.
Thence North 22019'35" West a distance of 493.91
feet to a point on the North line of Section 19.
Thence North 89019'59" East on said North line a
distance of 155.57 feet to the point of beginning.
Said tract being 1.404 acres, more or less.
Section 2
The effective date of this annexation is July 3, 1985.
Section 3
The annexation of the Valley View Golf Club Parcel is
subject to the terms of the agreement dated June 3, 1985, by
and between the City of Bozeman and Valley View Golf Club, a
Montana corporation, regarding the provision of services.
PASSED AND ADOPTED by the City Commission of the City
of Bozeman, Montana, at a regular and stated session of said
City Commission, held on the 3rd
day of June
