LINKED MINUTES OF THE MEETING OF THE CITY COMMISSION
BOZEMAN, MONTANA
October 10, 2011

The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Monday, October 10, 2011. Present were Mayor Jeff Krauss, Commissioner Cyndy
Andrus, Commission Sean Becker, Commissioner Chris Mehl and Commissioner Carson Taylor, City Manager Chris Kukulski, Finance Director Anna Rosenberry, City Attorney Greg Sullivan
and City Clerk Stacy Ulmen.

A. Call to Order- 4:30 p.m.-Commission Room, City Hall, 121 North Rouse
B. Executive Session-Litigation Strategy
Mayor Krauss closed the meeting to the public pursuant to Sect. 2-3-203(4)(a), MCA, finding
that the meeting involves a discussion of litigation strategy and an open meeting would have a
detrimental effect on the litigation position of the City.

Mayor Krauss asked City Manager Chris Kukulski if there were any changes to the agenda. Mr.

City Clerk Stacy Ulmen gave the Public Service Announcement regarding the City Elections.

0:02:04 Motion and Vote to approve the minutes from August 22, 2011.
It was moved by Cr. Mehl, seconded by Cr. Andrus to approve the minutes from August
22, 2011.
Those voting Aye being Crs. Mehl, Andrus, Taylor, Becker and Mayor Krauss.
Those voting No being none.
The motion passed 5-0.

1. Authorize Payment of Accounts Payable Claims (LaMeres)
2. Authorize City Manager to sign an Amendment to the Professional Services Agreement
with Great West Engineering for the EPA-Mandated Greenhouse Gas reporting for Story

3. Authorize Cancelling City Commission meeting on October 17, 2011 (Kissel)
4. Approve Resolution No. 4350, authorizing City Manager to sign Change Orders No. 6, 7
and 8 for the remodel and renovation of the City Shop Complex at 814 North Bozeman
(Goehrung)

0:07:36 1. Public Hearing and Consideration of Crescent Cross Growth Policy
Amendment, Application No. P-11003 (Saunders)
Chris Saunders, Assistant Planning Director gave the staff presentation regarding the
Consideration of Crescent Cross Growth Policy Amendment, Application No. P-11003.

The Commission and Staff spoke regarding the larger issue of development, the 20 acre number
and Growth Policy Amendments, location of the future high school, the zoning of the area and
annexation of the property.

Chris Budeski of Madison Engineering representing the Applicant stated that they are requesting
that the Commission open and continue this item.

Ms. Cornish of 5591 Cottonwood Road stated that there is a precedent for development along
Huffine. She would like to see the "dog leg" down Cottonwood addressed.

to a time after the Commission has considered the larger issue of development along
Huffine Lane.
It was moved by Cr. Taylor, seconded by Cr. Becker to continue Application No. P-11003
to a date certain with the date to be set to a time after the Commission has considered the
larger issue of development along Huffine Lane.

The Commission discussed the timing of the larger discussion, notification and areas to be
addressed in the larger discussion.

14.01.130 C of The Bozeman Municipal Code, pertaining to the Reassignment of Interest
Earnings From The Perpetual Care Trust Fund (Rosenberry)
Finance Director Anna Rosenberry gave the staff presentation regarding the Provisional
Adoption of Ordinance No. 1817, Amending Chapter 14, Section 14.01.130 C of The Bozeman
Municipal Code, pertaining to the Reassignment Of Interest Earnings From The Perpetual Care
Trust Fund.

0:44:20 Motion and Vote to appoint Katie Noland as a Montana State University student
representative and Tanner Scott Moe as an interested citizen representative to the
Community Alcohol Coalition.
It was moved by Cr. Andrus, seconded by Cr. Taylor to appoint Katie Noland as a
Montana State University student representative and Tanner Scott Moe as an interested
citizen representative to the Community Alcohol Coalition.

Discussion took place regarding the Superintendent and the Rate Study, composting and
recycling.

Attorney Sullivan spoke regarding the recent case in regards to an issue in Great falls. Timing of
