Present were Mayor Jeff Krauss, Commissioner Cyndy Andrus, Commission Sean Becker, Commissioner Chris Mehl and Commissioner Carson Taylor, City Manager Chris Kukulski, Finance Director Anna Rosenberry, City Attorney Greg Sullivan and City Clerk Stacy Ulmen. ** Please refer to the audio recording of this meeting for additional detail. A. Call to Order- 4:30 p.m.-Commission Room, City Hall, 121 North Rouse B. Executive Session-Litigation Strategy Mayor Krauss closed the meeting to the public pursuant to Sect. 2-3-203(4)(a), MCA, finding that the meeting involves a discussion of litigation strategy and an open meeting would have a detrimental effect on the litigation position of the City. *A separate set of Minutes have been prepared for the Executive Session 0:00:04 C. Minutes – August 22, 2011 0:02:04 Motion and Vote to approve the minutes from August 22, 2011. It was moved by Cr. Mehl, seconded by Cr. Andrus to approve the minutes from August 22, 2011. Those voting Aye being Crs. Mehl, Andrus, Taylor, Becker and Mayor Krauss. Those voting No being none. The motion passed 5-0. 0:02:20 H. Consent 1. Authorize Payment of Accounts Payable Claims (LaMeres) 2. Authorize City Manager to sign an Amendment to the Professional Services Agreement with Great West Engineering for the EPA-Mandated Greenhouse Gas reporting for Story Mill Landfill (Johnson) 3. Authorize Cancelling City Commission meeting on October 17, 2011 (Kissel) 4. Approve Resolution No. 4350, authorizing City Manager to sign Change Orders No. 6, 7 and 8 for the remodel and renovation of the City Shop Complex at 814 North Bozeman (Goehrung) 0:02:59 Public Comment on the Consent Agenda Mayor Krauss opened public comment on the Consent Agenda. Public Hearing and Consideration of Crescent Cross Growth Policy Amendment, Application No. P-11003 (Saunders) Chris Saunders, Assistant Planning Director gave the staff presentation regarding the Consideration of Crescent Cross Growth Policy Amendment, Application No. P-11003. 0:14:55 Questions for Staff The Commission and Staff spoke regarding the larger issue of development, the 20 acre number and Growth Policy Amendments, location of the future high school, the zoning of the area and annexation of the property. 0:18:49 Applicant Presentation Chris Budeski of Madison Engineering representing the Applicant stated that they are requesting that the Commission open and continue this item. 0:19:30 Public Comment Mayor Krauss opened public comment. 0:19:34 Jean Cornish, Public Comment Ms. Cornish of 5591 Cottonwood Road stated that there is a precedent for development along Huffine. She would like to see the "dog leg" down Cottonwood addressed. 0:21:34 Public Comment closed 0:21:52 Motion to continue Application No. P-11003 to a date certain with the date to be set to a time after the Commission has considered the larger issue of development along Huffine Lane. It was moved by Cr. Taylor, seconded by Cr. Provisional Adoption of Ordinance No. 1817, Amending Chapter 14, Section 14.01.130 C of The Bozeman Municipal Code, pertaining to the Reassignment of Interest Earnings From The Perpetual Care Trust Fund (Rosenberry) Finance Director Anna Rosenberry gave the staff presentation regarding the Provisional Adoption of Ordinance No. 1817, Amending Chapter 14, Section 14.01.130 C of The Bozeman Municipal Code, pertaining to the Reassignment Of Interest Earnings From The Perpetual Care Trust Fund. 0:33:27 Questions for Staff The Commission and Staff spoke regarding the fiscal effects, interest and perpetual care, and refinancing bonds. 0:38:00 Public Comment Mayor Krauss opened public comment.
