Villard Street: 8-26-85 SEE PAGE 118 for RESOLUTION NO. 2 5 71-1 8 RESOLUTION NO. 2570 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 648 FOR THE .PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICATION OF THE ASPHALT PAVING, CONCRETE SIDEWALKS AND ALL OTHER NECESSARY APPURTENANCES ON WEST VILLARD STREET BETWEEN NORTH GRAND AVENUE AND NORTH I WI LLSON AVENUE. WHEREAS, the adjacent property owners have requested that the City create an SID for the purpose of paving West Villard Street from North Grand Avenue to North Willson Avenue; and WHEREAS, the aforesaid request has been evaluated by the City Commission. NOW I THEREFORE I BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA: Sect ion 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 648 of the City of Bozeman for the purpose of accomplishing the engineering design, construction, inspection and engineering certification of asphalt paving, curb and gutter, concrete sidewalks and all other necessary appurtenances for that portion of West VUlard Street between North Grand Avenue and North W1IIson Avenue. Section 2 I Boundaries The boundaries of said Special Improvement DIstrict No. 648 are shown in the Proposed District Boundary map attached hereto and more particularly described as follows: Description Beginning at the southeast corner of Block 5 of Beall's Third Addition to the City of Bozeman; thence northerly along the east line of said Block 5 a distance of 38.17 feet; thence westerly and parallel to the southerly line of said Block 5 a distance of 131.00 feet, to a point on the east line of the north-south alley In said Block; thence continuing westerly on the same line a distance of 14 feet to a point on the west line of said alley; thence northerly along the west Une of said alley a distance of 61.83 feet to the northeast corner of Lot 24 of said Block 5; thence westerly along the north line of said Lot 24 a distance of 50.00 feet; thence southerly and parallel to the west line of the alley in said Block 5 a distance of 39.88 feet; thence westerly and parallel to the southerly line of said Block 5 a distance of 83.26 feet to a point on the west line of said Block 5; thence southerly along the west line of said Block 5 a distance of 60.12 feet to the southwest corner of said Block 5; thence southerly across West Villard Street a distance of 60 feet to the northwest corner of Block 4 of Beall's Third Addition; thence southerly along the west line of said Block 4 a distance of 37.84 feet; thence easterly and parallel to the north line of said Block 4 a distance of 132.00 feet to a point on the west Une of the north-south alley in said Block 4; thence continuing easterly on the same Une a distance of 14 feet to a point on the east line of said alley; thence southerly on said east line a distance of 0.33 feet; thence easterly and parallel to the north line of said Block 4 a distance of 131.00 feet I to a point on the east line of said Block 4; thence northerly along the east line of said Block 4 a distance of 38.17 feet to the northeast corner of said Block 4; thence northerly across West Villard Street a distance of 60 feet to the southeast corner of Block 5, Beall's Third Addition, the point of beginning. The total square footage of the assessable portion of the district is twenty-five thousand (25,000) square feet. COMMISSION RESOLUTION NO. 2570 _n_..._ 1')1) ',....... ..J Section 3 Character of Improvements The character of improvements to be made is the engineering design, construction, inspection and engineering certification of street excavation, subgrade improvement, gravel or asphalt street base, asphalt surfacing, concrete curb and gutter I concrete sidewalks, and all other necessary appurtenances. I Sect ion 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering, contingency, special improvement district revolving fund and incidental expenses is Forty-Five Thousand Five Hundred Dollars ($45,500). Section 5 Method of Assessment The cost is to be assessed against the entire district. Each lot, block I tract or parcel of land which is included within the district boundary described in Section 2, above I will be assessed for that portion of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenues and alleys. The total actual assessable area within the entire district is 25,000 square feet and is the area on which all protests will be received, considered and determined. It is also the area on which all assessments will be figured. Sect ion 6 I Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the engineering, construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 648 as authorized by law. Such bonds will be in denominations of One Thousand Dollars ($1,000) each, and fractions or multiples of $1000 where necessary I to be issued and chargeable against a fund known and designated as Special Improvement District No. 648 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singlely or in multiples, and in the order of their registration, from whatever funds are available for the purpose in said Special Improvement District No. 648. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 7-12-4201 and Section 7-12-4223, M. C. A., and all other applicable provisions of Title I 7, M. C. A., relating to special improvement districts in cities and towns, and any amendments thereof. COMMISSION RESOLUTION NO. 2570 .....------..-..--- 121 Section 7 Protests and Notices That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall, Bozeman, Montana, on Monday, the 16th day of September 1985, at the hour of 7 o'clock p. m. of said day, is the time and place, when and where the I City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said Special Improvement District No. 648, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either of them; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of Intention.
