RESOLUTION NO. 2573 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, SUPERSEDING RESOLUTION NO. 2571; INDICATING THE CITY'S INTENT TO EXCEED THE CURRENT STATUTORY MILL LEVY FOR GENERAL FUND PURPOSES ON THE APPROVAL OF A MAJORITY OF THE QUALIFIED ELECTORS OF THE MUNICIPALITY AT THE NEXT GENERAL ELECTION; SAID ADDITIONAL DOLLAR AMOUNT OF MONIES RAISED TO BE USED BY THE CITY OF BOZEMAN FOR PURCHASING ONE LADDER TRUCK FOR USE BY THE FIRE DIVISION. WHEREAS, on September 9, 1985, the City Commission adopted Resolution No. 2571 entitled "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO SUBMIT TO THE ELECTORATE OF SAID CITY A LEASE OR LEASE/PURCHASE AGREEMENT FOR THE ACQUISITION OF A LADDER TRUCK FOR THE FIRE DIVISION"; and WHEREAS, upon further review it appears advisable to define in more detail the City Commission's intent when it adopted Commission Resolution No, 2571; and WHEREAS, the City of Bozeman, Montana, has thoroughly reviewed the capital, salary and operations expenditures for the City's All-Purpose General Fund in the preparation of an operating budget for Fiscal Year 1985-86; and WHEREAS, the City has conducted a complete analysis of revenue over the past two fiscal years; and WHEREAS, the City staff has projected the total possible collectible revenue for Fiscal Year 1985-86; and WHEREAS, it appears that the expenditure level neces- sary to acquire certain major equipment items necessary to continue to maintain adequate fire protection services to the citizens of the City of Bozeman cannot be reached by existing revenue; and WHEREAS, Section 7-6-4431, M.C.A., authorizes a municipal governing body to exceed the current statutory mill levy established for the All-Purpose General Fund upon approval of a majority of the qualified electors voting in an election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: ". Section 1 That the revenue derived from the special mill levy election as provided herein will be used to purchase a ladder truck for use by the Fire Division. Section 2 That the specific amount requested to purchase said fire truck over a period of two fiscal years and the amount necessary to be placed at issue before the qualified electorate of the City of Bozeman is approximately $175,000 per year. Section 3 That the above-stated amount necessary to purchase said ladder truck over a period of two fiscal years represents approximately 8.00 mills per year. Section 4 That the specific General Fund mill levy limitation to be exceeded is the one which is governed by Section 15-7-122, M.C.A., which revises Section 7-6-4452, M.C.A. Said mill levy for Fiscal Year 1985-86 is approximately 72.11 mills. Section 5 That said additional mill levy as stated herein shall be placed at issue before the qualified electorate of the City of Bozeman at the general election to be held on Tuesday, November 5, 1985, and the wording of the proposal shall be as follows: D FOR Authorizing the City of Bozeman to make a levy of up to eight (8) mills per year in addition to the regular levy now authorized by law for each of the next two fiscal years for the purpose of raising $175,000 per year to purchase one ladder truck for the City's Fire Division. -2- .. ..
