SUBJECT: Bozeman Water Reclamation Facility, Phase 1 Improvements – Change
Order No. 9.

RECOMMENDATION: Motion and vote to authorize the City Manager’s signature on the Bozeman Water Reclamation Facility, Phase 1 Improvements – Change Order No. 9.
BACKGROUND: Attached is a copy of the summary of change order number nine for the
above referenced project. This change order includes two items. The attached summary letter
from HDR provides a description of each of the items involved with this change. The remaining pages provide the detailed cost breakdown for each item.
These items are primarily for the convenience of the maintenance staff. The addition of launder
covers will prevent the formation of algae in the clarifier launders during the warmer months.
When algae does occur, maintenance staff must remove it using scrub brushes. The second item is to pipe the effluent flow through the existing chlorine contact basin rather than convey it via open channel flow. During the past year, the flow open channel flow regime was being utilized.
Like the launders, algae became a problem during the warmer months. Piping the flow will
eliminate this problem. These items were discussed with the Finance Director who indicated her
support for adding them to the project. This change includes an extension of contract time of 150 days for substantial completion and
final completion. The final recommended increase in cost and time extension for this change is
reasonable and commensurate with the work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order increases the contract amount by $114,429.00
from $36,684,276.90 to $36,798,705.90. This will decrease the contingency on the project from
$1,558,500.99 to $1,444,071.99. The contingency is included in the overall budget for the project
but not in the construction contract which is why the change order must be processed.

COMMISSION RESOLUTION NO. 4355
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH WILLIAMS BROTHER CONSTRUCTION, LLC., BILLINGS,
MONTANA.
WHEREAS, the City Commission did, on the 10th day of November 2008, authorize award of the
bid for the Bozeman Water Reclamation Facility Phase I Improvements project, to Williams Brother
Construction, LLC., Billings, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and Williams Brother Construction, LLC., as contained in Change Order No. 9,
attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed
to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and
directed to attest such signature.
