SUBJECT: Christenot Annexation #A-11001 – Reclaim Variance and Open and Continue to November 28th

RECOMMENDATION: The City Commission should reclaim review of the applicant’s
submitted variance request to defer payment of the fee-in-lieu of water rights in conjunction with the Christenot Annexation application and open and continue the public hearing for #A-11001 to November 28, 2011.
RECOMMENDED MOTION: Based upon the fact that the City Commission is the review
authority for the Christenot Annexation, and the submitted variance request to defer
payment of the fee-in-lieu of water rights is part of that application, I move to reclaim jurisdiction of the Christenot Annexation fee-in-lieu of water rights variance per Section 18.64.010.C.1 and to open and continue the public hearing date for #A-11001 for November 28, 2011.
BACKGROUND: The Christenot annexation was originally on the City Commission’s agenda
of August 29th, 2011. Following the public hearing and discussion where this item was continued, the Commission took further action to open and continue this item until November 14th in order to allow for a policy discussion regarding the Durston Road and West Babcock
Street Special Improvement and Payback Districts; (in follow-up to questions raised during the
original Christenot Annexation public hearing and their request to defer their Durston Road
payback district payments). As that policy discussion is scheduled for November 7th, in order to provide staff time to compile packet materials as related to the Christenot Annexation following the policy discussion, the public hearing needs to be continued to November 28th.
The applicant has also submitted the attached variance request to defer payment of the fee-in-lieu
of water rights for the proposed Christenot Annexation and made the appropriate request for the
City Commission to reclaim jurisdiction of this variance from the Board of Adjustment. By opening and continuing this item to November 28th , this also allows for the re-noticing of these
applications to the public.
Staff has discussed this with the applicant and they have agreed to the continuance of this item
until November 28, 2011.
