RESOLUTION NO. 2591
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOZEMAN, MONTANA, AUTHORIZING THE
RETENTION OF SPECIAL COUNSEL IN THE MATTER
OF THE CITY'S WATER RIGHTS AND SETTING AN
HOURLY FEE.
WHEREAS, the City of Bozeman has filed certain claims
for water rights with the Department of Natural Resources;
and
WHEREAS, the maintenance of those water rights is
primarily necessary for the operation of the City's water
utility which supplies water to residents of the City of
Bozeman; and
WHEREAS, the water rights as filed have been examined
by the Water Court and are now subject to a preliminary
decree issued for the Gallatin Basin; and
WHEREAS, the City Attorney has advised the City Manager
and the City Commission that the City's interest in this
particular matter should be defended by counsel experienced
in water rights; and
WHEREAS, the City must adequately represent its rights;
and
WHEREAS, pursuant to the instructions of the City
Manager, the City Attorney has entered into a tentative
agreement with the law firm of Moore, Rice, O'Connell &
Refling to represent the City of Bozeman in the water rights
adjudication procedure; and
WHEREAS, the best interest of the City of Bozeman will
be served by retaining Moore, Rice, O'Connell & Refling for
the purpose of representing the City therein;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOZEMAN, MONTANA:
Section 1
That the law firm of Moore, Rice, O'Connell & Refling
be and is hereby retained as special counsel to represent
the City of Bozeman and to take such action as the firm and

the City Attorney may deem necessary to fully protect the
interests of the City of Bozeman with respect to its water
rights.
Section 2
That said law firm shall be reimbursed at the rate of
Seventy-Five Dollars ($75) per hour for its representation.
PASSED AND ADOPTED by the Commission of the City of
Bozeman, Montana, at a regular session held thereof on the
23rd
