The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Monday, March 28, 2011. Present were Mayor Jeff Krauss, Commissioner Cyndy
Andrus, Commissioner Sean Becker, Commissioner Chris Mehl, Commissioner Carson Taylor,
City Manager Chris Kukulski, Assistant City Manager Chuck Winn, City Attorney Greg Sullivan
and City Clerk Stacy Ulmen.

Mayor Krauss called the meeting to order.

0:13:01 Welcome
Mayor Krauss welcomed everybody to the Meeting.
0:13:19 Changes to the Agenda
Mayor Krauss stated that there is a group of Boy Scouts tonight at the meeting. The Group is
working on their Citizen badges. Each Scout made a poster of what it means to be a good
Citizen. They then handed them out to the Commission.

0:15:48 Motion and Vote to approve the Minutes from February 7, 2011.
It was moved by Cr. Becker, seconded by Cr. Andrus to approve the Minutes from
February 7, 2011.

Gallatin Mental Health Local Advisory Council requesting the Streamline Bus Service
entertain and consider a change in the Streamline route(s)to include the Mental Health
Center Campus on Farmhouse Lane (Wordal)

Mayor Krauss opened public comment on the Consent Agenda.
0:16:3 8 Jeff Rupp, Public Comment
HRDC Representative Jeff Rupp spoke regarding Consent Item 2.Authorize the City Manager, on
behalf of the City Commission, to sign a letter from the Gallatin Mental Health Local Advisory Council
requesting the Streamline Bus Service entertain and consider a change in the Streamline route(s) to
include the Mental Health Center Campus on Farmhouse Lane(Wordal). He has concerns regarding
this item.

The Commission agreed to pull Consent Item 2. Authorize the City Manager, on behalf of the City
Commission, to sign a letter from the Gallatin Mental Health Local Advisory Council requesting the

0:20:11 Jason Armstronz, Public Comment
Mr. Armstrong of 185 Chesnut Grove Avenue spoke regarding the Peach Street Bike Lane. He
spoke regarding how bikers get killed. A marked area would be safer. A bike lane down Peach is
appropriate.

Mr. Rasker of 811 South Grand stated that he bikes year round. It is not safe. There are bike
lanes everywhere in other cities. We are behind the times.
0:26:09 Amy McNamara, Public Comment
Ms. McNamara of 419 South 9th stated that she supports the Community Action Plan. She spoke
regarding the expansion for bike lines identified in the Climate Action Plan. There are few bike
lanes in this City. She encourages the Commission to adopt the plan and put in a bike lane on
Peach.

Mr. Schlinker of 1530 South Grand stated that he is the Vice President of the Bozeman Bike
Kitchen. Bike transportation is viable transportation for members of the Gallatin Valley and the
City and infrastructure is needed for safety.

Mr. Smith of 423 North Black stated that by adding bike lanes on Peach Street are a good
connector. Bikes and Climate change should be interwoven.

Mr. Blomquist of 9 East Peach Street stated that he appreciates bike lanes. He spoke regarding
speed on Peach. If it is narrower,people will drive slower down the street. This will link with
other bike lanes.

Ms. Chiuchiolo of 208 Donna Avenue stated that she is the Gallatin Valley Bike Club President.
She spoke regarding letters that she received from folks in support of and two against the bike
lanes on Peach Street. She read a few of them to the Commission.

Mr. Hoffman of 1030 ? Drive stated that he rides his bike all over Bozeman. He has ridden for 9
years and has been hit by several cars. He urged the Commission to put in the Bike Lanes on
Peach.

Mr. Bishop of 4898 Itana Circle thanked all the participants on the Climate Action Plan. This is a
vibrant community engaged in a process that will involve the citizens.

Mr. Angst of 501 South 3rd stated that he supports the Climate Action Plan. The actions are
going to save money. The payback period is not going to be that long. He urged the Commission
to come up with alternative solutions. He spoke regarding the bike paths. They are important.

Mr. Keck of 411 North 3rd spoke regarding Collin's Coalition. He spoke in support of bike lanes
on Peach. Trails need to start and end at safe locations. There are intersection safety concerns at
Peach and Rouse. He spoke regarding the truck traffic at this intersection. He urged that the
Commission error on the side of safety.

Ms. Williamson of 405 South 5th spoke regarding the Climate Action Plan. She spoke regarding
being a homeowner on Peach Street. The traffic is fast. Bike Lanes in Peach would make the
street safer. She is in support of bike lanes.

Mr. Mistretta of 439 North Black Avenue stated that he represents Cravin's, a fishing guide lunch
service located on Peach. They would like to work with the City on parking and the bike lanes.

Mr. Parent stated that he is with Albertsons. He thinks that the Action Plan was well thought out
but has a concern with the 5 cent per plastic bag fee. Financially this would place a burden on
customers and businesses. This would create a competitive problem. Please look at an alternative
way to educate the public. Urge recycling and educate customer base. Please consider this. He
likes the phone book opt out program and the Geo Thermal Generation Study idea.

Mr. Peck of 5801 Cottonwood Road stated that he supports bike lanes. He has been forced off
the roads when riding his bike.

Mr. Evans stated that he is the President of the South West Montana Building Industry
Association. He spoke regarding the members of SWMBIA. He spoke regarding the Climate
Action Plan. They want people to build energy efficient housing and their members are doing
this already. Let the market move in its own direction.

Mr. Bogman of 3701 Tractor Trail stated that he is a member of the Gallatin Bike Club. Bike
lanes slow traffic. There is a School on that route. Continuity increases use. Cars are rarely
parked on the street. What is the legacy that we are going to leave?

Ms. Weber of 3748 Bungalow Lane thanked the Climate Task Force. She supports the plan. It is
a step in the right direction. She spoke regarding the bike lanes. It is a needed safety issue.

Mr. Krueger gave the staff presentation regarding the Provisional adoption of Ordinance No.
1802, Residential Emphasis Mixed Use Zoning District and Associated Zone Text Amendments
No. Z-09241 to Title 18, Unified Development Ordinance, Bozeman Municipal Code.

1:01:46 Motion that having heard and considered Public Comment, consider a motion to
Provisionally adopt Ordinance No. 1802, Residential Emphasis Mixed Use Zoning District
and Associated Zone Text Amendments No. Z-09241 to Title 18,Unified Development
Ordinance, Bozeman Municipal Code and incorporate the findings in the Staff Report.
It was moved by Cr. Taylor, seconded by Cr. Mehl that having heard and considered
Public Comment, consider a motion to Provisionally adopt Ordinance No. 1802, Residential
Emphasis Mixed Use Zoning District and Associated Zone Text Amendments No. Z-09241
to Title 18,Unified Development Ordinance, Bozeman Municipal Code and incorporate the
findings in the Staff Report.

(Meyer)
1:03:50 Natalie Meyer, Grants and Climate Protection Coordinator for the City
Ms. Meyer gave the opening statement on the Community Climate Action Plan.
1:05:15 Hattie Baker, Sustainable Planning Solutions
Ms. Baker presented the Community Climate Action Plan. She spoke regarding the development
of the Task Force. She spoke regarding the 39 Recommendations listed in the Action Plan.
1:30:46 Scott Bishke, Task Force Member
Mr. Bishke thanked the Commission, Ms. Baker and Ms. Meyer for their help and support. He
asked that the Commission to adopt plan in its entirety, recognize that the plan has changes and
implement what the plan says.

1:36:09 Kaaren Jacobson, Public Comment
Ms. Jacobson of 1110 South 3rd Avenue stated that we need to do our part. She is impressed
with the Task Force. She commended staff We need to assume our own Community
responsibility.

Mr. Lansdale of 721 North Grand Avenue stated that he supports the Action Plan.

1:40:06 Cathy Wedan, Public Comment
Ms. Wedan stated that she is with the League of Women Voters from the area. The League has
Climate change as one of their top priorities. On a National level nothing is happening. We have
an opportunity to address climate change in Bozeman.
1:42:15 Eva Paton, Public Comment
Ms. Paton 8945 Cooper Trail stated that she is part of the League. It is great working at the local
level.
1:42:30 Ann Banks, Public Comment
Ms. Banks of 7 Hills street asked that the Commission hear the plan and adopt it.
1:42:44 Terry Ball, Public Comment
Ms. Ball of 2278 Reaoda Road asked the Commission to support the Plan.
1:42:52 Millie Gutkoski, Public Comment
Ms. Gutkoski of 304 North 18th thanked Bresnan TV for filming the Commission Meetings.
1:43:11 Sue Meadows, Public Comment
Ms. Meadows of 505 South 9th thanked the Task Force and the Commission for moving forward
with this.
1:44:16 Gary Gannon, Public Comment
Mr. Gannon stated that he is impressed that the City has started to move forward with this. He
recommends that the Commission approve the Plan.
1:46:40 Christopher Spozis, Public Comment
Mr. Spogis stated that he is inspired to reduce his carbon imprint. He hopes that the Commission
will approve the Plan.

The Commission and Staff spoke regarding commissioning, benchmarking, affordability,
sectors, return on investment, City vs County recommendations, the proposed plastic bag fee and
consideration of a plastic bag ban and renewable energy options.

2:10:22 Motion to adopt the Community Action Plan as presented to the City Commission
at the March 28, 2011 meeting.
It was moved by Cr. Mehl, seconded by Cr. Becker to adopt the Community Action Plan as
presented to the City Commission at the March 28, 2011 meeting.
2:10:40 Commission Discussion
The Commission discussed the City's Goal of reduction, efficiency and savings tests, the
recommendations within the Action Plan, approval and implementation, costs and timeliness,
instructions to staff, energy production, conservation, taking small steps in a public matter,
control, concern of telling people what to do, choices of public goods, composting, banning
plastic bags, commissioning, global warming, paybacks, budget issues, Commission priorities, a
Coordinator position, benchmarking and commissioning and reducing emissions.

It was moved by Cr. Mehl, seconded by Cr. Becker to delete the reference to spending
$100,000 for the Waste Facility Study.

3:05:37 3. Peach Street Bike Lanes (Kerr)
3:05:47 Andy Kerr, Associate Engineer
Mr. Kerr gave the staff presentation regarding the Peach Street Bike Lanes.
3:16:40 Commission Questions for Staff
Mr. Kerr was asked to point out certain areas on a map. The Commission discussed the
recommendations of the Bicycle Advisory Board and parking areas.

Mr. Delmue spoke regarding the proposal of the Board.

The Commission spoke regarding safety and center line location.

Mr. Spogis of 613 North Tracy stated that he does not want any parking on Peach. It is an unsafe
situation with parking. He spoke regarding an incident that he was involved in as a biker.

Ms. Snyder of 908 South Tracy spoke in support of bike lanes.
3:59:31 Tyler ?, Public Comment
Tyler stated that he is a volunteer with the Bozeman Bike Kitchen. He spoke regarding current
safety concerns.
4:00:49 Joe Gilpen, Public Comment
Mr. Gilpen of 2920 Colter Avenue spoke regarding the parking and if it is feasible. It appears to
not be. He was on the previous Transportation Board that looked at this area.

Mayor Krauss suspended the Rules until 10:15 p.m.
4:02:14 Rebecca Gleason, Public Comment
Ms. Gleason stated that she is a member of the Bicycle Board spoke regarding not having
parking on both sides of the street. She feels it is a good idea.

The Commission highlighted their preferences with parking.
4:06:25 Motion and Vote to designate bike lanes on Peach Street from Rouse Avenue to
North 7t', eliminating parking on the south side of Peach, allowing parking on the north
side of Peach, with final design to be returned to the Commission with final approval.
It was moved by Cr. Becker, seconded by Cr. Andrus to designate bike lanes on Peach
Street from Rouse Avenue to North 7t'', eliminating parking on the south side of Peach,

Commission with final approval.

Trustees (Kissel)

Cr. Andrus recused herself due to a possible conflict of interest because of her affiliation with the
Chamber.

Mr. Fatouros spoke regarding his concern of the direction of the TBID. He spoke regarding the
leisure market.

Mr. Lambert would like to be on the board and he would work for all the hotels in town.

It was moved by Cr. Mehl, seconded by Cr. Becker to appoint Holly Ferrell to the TBID
Board.

The motion passed 4-0.
4:11:13 5. Appointment to the Community Alcohol Coalition (Kissel)
4:11:29 Motion and Vote to appoint David McManis.
It was moved by Cr. Andrus, seconded by Cr. Taylor to appoint David McManis.
