RESOLUTION NO. 2602
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 649 FOR THE
PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION,
INSTAllATION, INSPECTION AND ENGINEERING CERTIFICATION OF SANITARY
SEWER MAINS, WATER MAINS AND STORM DRAINAGE AND All OTHER
NECESSARY APPURTENANCES TO SERVE PARTICULAR PROPERTIES WITHIN
ANNIE SUBDIVISION, FIRST FILING.
WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, I
held on the 7th day of April, 1986, the said City Commission duly passed Resolution No. 2599,
declaring it to be the intention of the said City Commission to create a Special Improvement
District to be known and designated as Special Improvement District No. 649 for the purpose of
accomplishing the engineering design, construction, inspection and engineering certification of
sanitary sewer mains, water mains and storm drainage. Said construction and installation to
include all sanitary sewer mains, water mains and storm dr.ainage, including trench excavation,
backfill, bedding material, PVC sanitary sewer main, ductile iron water main, RCP storm sewer
main, manholes, valves, fittings, hydrants, street drain inlets, service line stubs and other
necessary appurtenances. That said Commission Resolution No. 2599 is hereby referred to and
made a part hereof for further particulars in respect to the boundaries of said Special
Improvement District No. 649, the estimated cost of said improvements and the method of
assessing the same against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No. 2599 was duly published,
as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation
printed and published in the City of Bozeman, Montana, and by sending a copy of such notice
by U.S. Mail to each person, firm or corporation having property within the proposed district
at his or its last known address, upon the same date that such notice was first published as
aforesaid, and due proof having been made of the publication and service of said notice; and
WHEREAS, within the time provided by law and said published and served notice, there I
was not sufficient protest against the creation of said proposed Special Improvement District No.
649. The City Commission was in regular session on the 5th day of May, 1986, at 7 o'clock p. m. ,
at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana.
The same was the time and place designated in said notice for passing upon all protests, if any,
against the proposed work or against the creation of said district. And, it further appears
that all of the proceedings for the creation of said district have been lawful and regular.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONT ANA:
Section 1
That the said Special Improvement District No. 649 of the City of Bozeman be and the
same is hereby created for the purpose of making improvements as set out in said Commission
Resolution No. 2599 and hereinafter described.
Section 2
That said special improvements be and the same are hereby ordered to be made in Special
Improvement District No. 649 as follows:

Section 3
That the entire cost and expense of maintaining the improvements herein referred to in
said Special Improvement District No. 649 shall be assessed against the entire district. Each

lot, block, tract or parcel of .Iand within the district boundary will be assessed for that portion
of the whole cost which its area bears to the area of the entire district, exclusive of streets,
avenues and alleys.
The total actual assessable area within the entire district is 1,144,073 square feet and is
the area on which all assessments will be calculated.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
I regular session held thereof on the 12th day of May 1986.

that the foregoing Resolution No. 2602 was published by title and number in the Bozeman Daily
Chronicle, a newspaper of general circulation printed and published in said City, in the issue
dated the 15th day of May 1986, and due proof of such publication is on file in my office.
