' RESOLUTION NO. 2603 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 650 FOR THE PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSTALLATION, INSPECTION AND ENGINEERING CERTIFICATION OF STREETS, CURB AND GUTTER, SIDEWALKS, STORM DRAIN DETENTION BASIN IMPROVEMENTS AND ALL OTHER NECESSARY APPURTENANCES TO SERVE PARTICULAR PROPERTIES WITHIN ANNIE SUBDIVISION, FIRST FILING. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, I held on the 7th day of April, 1986, the said City Commission duly passed Resolution No. 2600, declaring it to be the intention of the said City Commission to create a Special Improvement District to be known and designated as Special Improvement District No. 650 for the purpose of accomplishing the engineering design, construction, inspection and engineering certification of streets, curb and gutter, sidewal ks and storm detention improvements. Said construction and installation to include all streets, curb and gutter, sidewal ks and storm detention improvements, including street and trench excavation, backfill, bedding material, gravel street base, asphalt street surfacing, concrete curb and gutter, concrete sidewalks, stream crossing pipes, storm drain detention basin and pipes, and other necessary appurtenances. That said Commission Resolution No. 2600 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 650, the estimated cost of said improvements and the method of assessing the same against the property of the district; and WHEREAS, the notice of the passage of Commission Resolution No. 2600 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U. S. Mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the publication and service of said notice; and WHEREAS, within the time provided by law and said published and served notice, there I was not sufficient protest against the creation of said proposed Special Improvement District No. 650. The City Commission was in regular session on the 5th day of May, 1986, at 7 o'clock p.m., at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana. The same was the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation of said district. And, it further appears that all of the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 That the said Special Improvement District No. 650 of the City of Bozeman be and the same is hereby created for the purpose of making improvements as set out in said Commission Resolution No. 2600 and hereinafter described. Section 2 That said special improvements be and the same are hereby ordered to be made in Special Improvement District No. 650 as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 650 FOR THE I PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSTALLATION, INSPECTION AND ENGINEERING CERTIFICATION OF STREETS, CURB AND GUTTER, SIDEWALKS, STORM DRAIN DETENTION BASIN IMPROVEMENTS AND ALL OTHER NECESSARY APPURTENANCES TO SERVE PARTICULAR PROPERTIES WITHIN ANNIE SUBDIVISION, FIRST FILING. Section 3 That the entire cost and expense of maintaining the improvements herein referred to in said Special Improvement District No. 650 shall be assessed against the entire district. Each COMMISSION RESOLUTION NO. 2603 ......n..._ -...----- 217 lot, block, tract or parcel of land within the district boundary will be assessed for that portion of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenues and alleys. The total actual assessable area within the entire district is 1,144,073 square feet and is the area on which all assessments will be calculated. I PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session held thereof on the 12th day of May 1986.
