STREET LIGHTING EASEMENT
J & D Limited Family Partnership, GRANTOR, in consideration of $1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation
of the State of Montana, with offices at 121 North Rouse Avenue, GRANTEE, its successors and assigns,
a perpetual easement across, over and through a strip of land 12 feet wide situated in the City of
Bozeman and Gallatin County, Montana, located in the SE 1 /4 of Section 9, T. 2 S_ R. 5 E., P.M.M., more
particularly described as follows, to wit:
An easement twelve feet in width being the easterly twelve feet of Lots 1 and
2 in Block 2, and the westerly twelve feet of the easterly thirty and ninety-
eight hundredths feet of Lot R-1, of the Plat of J & 0 Family Major
Subdivision Phase 1, as recorded in the office of the Clerk and Recorder of
Gallatin County, Montana under Document No 2375679.
The GRANTOR does hereby create this perpetual easement for the purpose of constructing,
reconstructing, maintaining, operating, repairing, improving, replacing and using street lighting and any
necessary fixtures and appurtenances over, under, across and upon said real property.
The GRANTOR states that he possesses the real property described above and that he has the
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shalt extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
