Box 1230 Bozeman, MT 59771 -1230 2397929 Page: 1 of 4 0912902011 11:08:412 AM Fee- $2B 00 te Charlot Mills - Gallatin Go,,lY MT MI9C 11111111 11jIl IIII IIIIIII111111IN IIII VIII 111111111111111 VIII VIII IIII IIII RELEASE AND RECONVEYANCE OF EASEMENT(S) COMES NOW the City of Bozeman, 121 North Rouse Avenue, Bozeman, MT 59715, a Municipal Corporation of the State of Montana hereinafter ( "GRANTOR ") and does hereby release and reconvey the following described easement unto South Meadow, Inc., Bozeman, Montana as follows: WITNESSETH WHEREAS the Grantor is the legal record title holder of a Sewer and Water Pipeline and Access Easement situated across: Lot 1, South Meadow Minor Subdivision No. 294, located in the Southwest Quarter of Section 19, Township 2 South, Range 6 East of the Principal Meridian of Montana, City of Bozeman, Gallatin County, Montana. WHEREAS the above Sewer and Water Pipeline and Access Easement was granted August 30, 2004, and recorded on September 22, 2004, at the Clerk and Recorder's Office of Gallatin County, Montana, as Document Number 2164141. WHEREAS the construction of sanitary sewer and storm drainage pipelines has been completed without having to occupy said easement recorded on September 22, 2004, and WHEREAS the potential re- alignment of said sanitary sewer and storm drainage pipelines can be appropriately considered with future subdivision review of these properties, the vacation of a portion of the utility easement recorded on September 22, 2404 will not adversely impact the Grantor's interests. WHEREFORE, the Grantor does hereby release and reconvey to South Meadow, Inc., those portions of the easement located on the above described real property as set forth on Exhibit A attached hereto together with any right, title, or interest that the Grantor may have in said easements as set forth on Exhibit A attached hereto and incorporated herein by reference
