SUBJECT: Amendment to Professional Services Agreement with Great "West
Engineering in an amount not to exceed $4,500, for the Environmental
Protection Agency (EPA)- mandated Greenhouse Gas reporting for the
City owned Story Mill Landfill.

RECOMMENDATION: Authorize City Manager to sign Amendment to Professional Services
Agreement with Great 'West Engineering for the EPA - mandated Greenhouse Gas reporting for
the Story Mill Landfill.
BACKGROUND: The City of Bozeman Solid Waste Division has been contracted with
Great West Engineering since 1998. The nature of the contract has been to update closure and
post closure costs during the operation of the landfill, track landfill capacity, update any
necessary base maps, and prepare all engineering documents for closure of the landfill cells.
In recent years the EPA has drafted regulations requiring reporting of greenhouse gases
for landfills. The City of Bozeman has registered on their data base and has fulfilled all
reporting obligations to date. In August the City of Bozeman received notice that one final step
in the reporting process is to register various technical information regarding the landfill online.
The registration includes authorizing agents of the facility, verifying the length of landfill
operations, verifying the in place waste volumes, and calculating methane production.
Much of this has already been performed by city staff. However, the registration process
requires some technical aspects that are beyond the limits of the engineering staff that Great
West Engineering can fulfill. Once the initial reporting is input with the EPA database the City
staff will be able manage the future reporting requirements.

FISCAL EFFECTS: The entire project will be funded through the Solid Waste Landfill
Closure /Post- Closure Fund. This fund has a balance of
$1,660,876.97 and is required by the Department of Environmental
Quality to be reserved solely for the closure and post-closure
monitoring of the landfill cells.
ALTERNATIVES: As suggested by the City Commission.

Amendment to Professional! Services Agreement
For Great West Engineering
THIS AGREEMENT is made as of this 12th day of September 2011, between the City of Bozeman, a
Municipal Corporation, Bozeman, Montana, herein referred to as OWNER and Great West Engineering, an
Engineering Consulting Firm of Helena, Montana, herein referred to as ENGINEER.
WHEREAS, the parties have entered into a Professional Services Agreement dated December 7, 1998
herein referred to as Original Agreement for professional engineering services; and
WHEREAS, the parties desire to further amend the provisions of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED
HEREIN, the patties agree as follows:
TASK ORDER GG will be included with Exhibit A Scope of Services for the remainder of the
project as of September 12, 2011.
2. 'Section 17 — Anti- Discrimination Policy for Contracts and Other Agreements and Purchases will be
added to the TERMS AND CONDITIONS to read:

The Engineer agrees not to discriminate in the fulfillment of this Agreement on the basis of
race, color, religion, creed, sex, age, marital status, national origin, or actual or perceived sexual
orientation, gender identity or disability.
The Engineer agrees this requirement shall apply to the hiring and treatment of the Engineer's
employees and to all subcontracts.
Except as specifically amended herein, the original agreement shall remain in full force and effect and
the Parties shall be bound by all terms and conditions therein.

TASK ORDER GG
Scope of Services
This Exhibit outlines our Scope of Services to perform Greenhouse Gas Reporting for
the City of Bozeman Landfill. Great West will obtain, organize and input the data
required for the EPA-mandated Greenhouse Gas reporting as required in 40 CFR 98
Sub-Part HH. The data will be obtained from gas records maintained by the City and
landfill design criteria that Great West already has access to. Great West will act as the
City's agent, as authorized under the eGGRT electronic reporting procedures. Final
review and submittal of the electronic documentation and calculations will necessarily
be the responsibility of the City, as authorized under the eGGRT agreement.
Consultant services will include the following.
• Registering as authorized agents of the facility;
• Obtaining and verifying length of landfill operations,
• Obtaining and verifying estimated and measured waste-acceptance volumes;
• Calculation of methane production based on multiple methods of record-keeping;
• Inputting of data to the eGGRT electronic reporting system.
Compensation
The Consultant will perform this task on an hourly rate basis not to exceed $4,500.
