COMMISSION RESOLUTION NO. 2617
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, REVISING AND RE-ESTABLlSHING GOALS AND POLICIES FOR
ANNEXATION OF PROPERTIES TO THE CITY OF BOZEMAN, AND SUPER-
CEDING COMMISSION RESOLUTION NO. 2532.
WHEREAS, the City of Bozeman seeks to establish comprehensive annexation goals
and policies, to provide for orderly, well-planned growth; and
WHEREAS, adoption of such goals and policies will provide our community with clear
guidelines for informed annexation proposals;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, to wit:
Section 1
Goals
The following goals are hereby established for the consideration of all future annexa-
tions to the City of Bozeman.
1. It shall be the goal of the City of Bozeman to encourage annexations to smooth
existing City boundaries rather than creating irregular extensions which leave
unannexed gaps between annexed areas or islands of annexed or unannexed
land.
2. It shall be the goal of the City of Bozeman to encourage annexations which will
enhance the existing traffic circulation system or provide for circulation systems
that do not exist at the present time.
3. The City prefers annexation of parcels of land larger than five (5) acres in
size, but will not prohibit annexation of smaller parcels if factors such as top-
ographic limitations, sanitary disposal needs, fire access, maintenance of public
facilities, etc., demand a smaller annexation.
4. The City shall seek to annex all areas that are totally surrounded by the City
without regard to parcel size.
5. The City shall seek to annex all property bounded on three (3) sides by the
City. This shall include vacant as well as developed areas.
6. The City shall seek to annex all property currently contracting with the City
for City services such as water, sanitary sewer and/or fire protection.
7. It shall be the goal of the City to preserve the unique environmental and aes-
thetic values of the community.

8. It shall be the goal of the City of Bozeman to encourage annexations that are
identified in the Bozeman Area Master Plan as being in the urban service area
boundary.
Section 2
Policies
The following policies are hereby established for the consideration of all future an-
nexations to the City of Bozeman.
1. Prior to annexation, the City shall obtain all easements, rights-of-way, water
rights and waivers of protest against the creation of S .1. D. 's necessary to pro-
vide the essential services for future development.
2. The initial application for annexation shall be in conformance with the Bozeman
Area Master Plan. If the request is not in conformance with the Bozeman Area
Master Plan, the applicant shall be referred to the City-County Planning Board
for an application for a Master Plan Amendment. The Master Plan Amendment
must be reviewed and approved by the City-County Planning Board and the
City Commission prior to consideration being given to the annexation request.
3. Once an annexation request has received preliminary approval from the City Com-
mission, the applicant shall file a petition for amendment of the property's zon-
ing classification to the appropriate City classification (s). The zoning amend-
ment shall be acted upon by the City Commission promptly after the property is
formally annexed.
4. It shall be the general policy of the City that annexations will not be approved
where county roads will be the most commonly used route to gain access to the
property and/or when logical extensions to road systems are unresolved or in
question.
5. Prior to annexation of property, it shall be the policy of the City of Bozeman to
acquire usable water rights, or an appropriate fee in lieu thereof, equal to the
average annual diversion requirement necessary to provide the anticipated aver-
age annual consumption of water by residents and/or users of the property
when fully developed on the basis of the zoning designation(s). The fee may
be used to acquire water rights or for improvements to the water system which
would create additional water supply capacity. This policy is subject to the
followi ng exceptions:
a. For any annexation in excess of ten (10) acres, it shall be carried out
prior to final plat approval, final site plan approval or the issuance of any

building permit, whichever occurs first.
b, For any annexation or portion thereof proposed for use as a church as
that term is defined in the Bozeman zoning ordinance, the R-1, Residen-
tial--Single-Family, Low-Density, District shall be used in place of the
property's zoning designation for calculating the water requirement. If
the use changes from a church at any time in the future, the owner of the
property at the time of the change shall supply any additional water rights
or fee which might be due, based on the actual zoning designation at the
time of the change.
6. An application for annexation shall provide an annual schedule of development,
including an estimate of population, to the year of maximum density.
7. During the annexation proceedings, primary consideration shall be given to the
impact of the proposed annexation on the services affecting the public's health,
safety and welfare. Analysis of these service impacts will be performed by
those City departments which have responsibility for providing the services.
The analysis will be based on data supplied by the applicant and data gathered
during independent investigations accomplished by the responsible City author-
ity.
8. When considering the annexation of property designated fer residential land
use, the City shall obtain a letter from the School District assessing the avail-
ability of schools and school transportation for residents of the proposed an-
nexation.
9. It shall be policy of the City of Bozeman to establish the size of utility lines
and streets for all annexations in such a way as to anticipate and encourage
orderly growth.
10. It shall be the policy of the City of Bozeman to review these annexation goals
and policies annually.
11. It shall be the policy of the City of Bozeman to give preference to those an-
nexation proposals that show promise of immediate and steady development.
