Graf Park for portion of Sourdough Trail on ballot: 8-18-86 " ..!; RESOLUTION NO. 2619 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE TRADE OF A PORTION OF THE PARK KNOWN AS EAST GRAF PARK FOR PARK LAND KNOWN AS A PORTION OF THE SOURDOUGH TRAIL AND PLACING THE TRADE ON THE BALLOT FOR APPROVAL BY THE ELECTORS OF THE CITY OF BOZEMAN. WHEREAS, East Graf Park is an undeveloped municipal park approximately 14.26 acres in size located east of Colter Avenue and west of the south portion of the Valley View golf course; and WHEREAS, Sourdough Trail meanders to the south of East Graf Park for more than one mile to Goldenstein Lane and has been open to and used by the public and maintained by the Bozeman Rotary Club the past nine years; and WHEREAS, the City now has the opportunity to trade a strip of East Graf Park 96 feet wide and 1,124 feet long located along the eastern boundary of the park for a portion of the Sourdough Trail extending approximately 3/5 of a mile from a point parallel to Graf Street to the southern boundary of the city limits. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 Subject to ratification by a majority of the City's electors, the City Commission hereby approves the exchange of the following portion of East Graf Park: Two tracts of land located in the S 1/2, NW 1/4, Section 19, T2S, R6E, MPM and further described in Certificate of Survey No. 62 filed in 1974 and Certificate of Survey No. 264 filed in 1976, as filed and on record in the office of the Clerk and Recorder of Gallatin County, Montana. Said tracts containing a total of 2.475 acres more or less. to the Estate of Eugene Graf, Jr., in return for the deed to the following portion of the Sourdough Trail: ., J A tract of land being a portion of Graf's Fourth Addition to the City of Bozeman, situated in the S.W. 1/4 of Section 19, T.2S., R.6E., P.M.M., City of Bozeman, Gallatin County, Montana, and being further described as follows: Beginning at a point which is the S. 1/4 corner of Section 19, T.2S., R.6E., P.M.M., as located and described by Charlie Swart on Film 16, page 482; thence from said point of beginning along the south line of said Section 19 N89016'00"W a distance of 19.92 feet to a point on the westerly line of Sourdough Creek Trail as it is now located; thence along said line N21025'36W a distance of 223.87 feet, N03056'15"W a distance of 339.85 feet, N71010'06"E a distance of 119.36 feet, N00006'55"E a distance of 733.88 feet, N27001'32"Wa distance of 44.19 feet; NOOOOO'12"E a distance of 598.74 feet, N10025'39"W a distance of 178.57 feet, N59042'29"W a distance of 239.85 feet, N10025'44"W a distance of 197.93 feet, N88026'24"Wa distane of 81.08 feet and N42048'29"Wa distance of 181.12 feet; thence N89012'08"Wa distance of 796.22 feet; thence N00028'04"E a distance of 15.00 feet to a point on the southerly line of Certificate of Survey No. 819A; thence along said line S89012'08"E a distance of 815.09 feet to a point on the southerly line of Certificate of Survey No. 803; thence along said line 5 43049'01"E a distance of 161.23 feet and S89010'13"E a distance of 383.89 feet to a point on the North-South mid-section line of said Section 19 as described in Book 177, page 302, Gallatin County Records; thence along said line SOOOOO'28"W a distance of 2537.27 feet to the point of beginning. Said parcel being 4.8156 acres along with and subject to any existing easements. and a deed to a small tract located along the southeast portion of East Graf Park: A tract of land being a portion of C.O.S. No. 819A, situated in the NW 1/4 of Section 19, T2S, R6E, P.M.M., City of Bozeman, Gallatin County, Montana, and being further described as follows: Beginning at a point on the westerly line of said C.O.5. No. 819A, said point being N76027'33"E a distance of 782.86 feet from the West 1/4 corner of said Section 19. Thence along said westerly line of said C.O.S. No. 819A, N01055'10"W a distance of 15.00 feet; Thence S88039'22"E a distance of 199.93 feet; Thence S 0I001'58"W a distance of 15.00 feet; Thence N88038'22"W a distance of 200.16 feet to the point of beginning. Said tract of land being 0.0689 acres, along with and subject to any existing easements. Said deeds shall be to the City of Bozeman with the additional provision that the land shall be held in trust for park land use by the public. -2- <; ,t f Section 2 The exchange as stated herein shall be placed before the qualified electors of the City of Bozeman at the general election to be held on Tuesday, November 4, 1986, and the wording of the proposal shall be substantially as follows: FOR: AGAINST: Approval of the City's exchange of the 96- foot easterly strip of undeveloped East Graf Park, consisting of 2.5 acres (about 1/5 of the whole park which is located east of Colter Avenue) in return for the City and the public receiving ownership of approximately 3/5 mile of the Sourdough Trail, consisting of 4.8 acres extending south from a point parallel with Graf Street to the south boundary of the City limits. Approval of the City's exchange of the 96- foot easterly strip of undeveloped East Graf Park, consisting of 2.5 acres (about 1/5 of the whole park which is located east of Colter Avenue) in return for the City and the public receiving ownership of approximately 3/5 mile of the Sourdough Trail, consisting of 4.8 acres extending south from a point parallel with Graf Street to the south boundary of the City limits. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session held thereof on the 18th day of August , 1986.
