HomeMy WebLinkAboutChristenot Zone Map Amendment Application No. Z-11170, open and Commission Memorandum REPORT TO :Honorable Mayor and City Commission FROM:Doug Riley, Associate Planner Tim McHarg, Planning Director SUBJECT:ChristenotAnnexation #A-11001and Zone Map Amendment #Z-11170 : MEETING DATESeptember 26,2011 AGENDA ITEM TYPE: Action : RECOMMENDATIONOpen and continue the public hearings for #A-11001 and #Z-11170 to November 14, 2011 to allow time for Staff, the City Commission and the applicant to evaluate the policy implications and details for the proposed annexation and requested deferment or elimination of certain annexation related fees. : BACKGROUNDThis annexation (and zone map amendment)was originally on the City th Commission’s agenda of August 29, 2011. Following the public hearing and discussion, the th Commission continued the annexation (and corresponding ZMA) until September 26. th Following the Commission meeting on August 29,City staff has been discussing the policy implications and details of the applicant’s requested deferrement of fees typically collected as part of annexation. This includes deferring Durston Road Payback Districtpayments, connection of the existing home to sewer and water and the levying of associated impact fees and cash in lieu of water rights. As the policy implications of these possible decisions could impact future annexation requests and the SID payback district, staff is requesting that the City Commission hold a separate future policy discussion regarding such annexation and payback policies (prior to action on this specificannexation). Staff has discussed this with the applicant and they have agreed to the continuance of this item until November 14, 2011.This continuance will also allow the variance to the cash in lieu of water rights to be noticed as part of the re-noticing of the new hearing dates to the public.It will also allow the applicant time to provide details regarding the adequacy of the existing septic system for that connection consideration.
