RECOMMENDATION: Authorize the City Manager to sign Professional Services
Agreement Amendment Number 2 for the College/11th Roundabout Project.
BACKGROUND: The original Professional Services Agreement (PSA) between the City of
Bozeman and engineering firm Robert Peccia & Associates (RPA) was executed by the parties
on January 20, 2009. At the time the PSA was put in place, the fee for Construction Phase
Services was agreed not to exceed a value of $47,187.00. Compensation for Construction Phase
Services is based on the Engineer’s direct labor costs for services rendered during construction.
The original $47,187 construction phase fee was based on an anticipated 30 day construction
period for the roundabout construction contract, but in actuality a 60 day construction period was
determined necessary once plans were finally approved by the Montana Department of
Transportation. Because the PSA requires compensation on services rendered during the actual
construction period, RPA is due fees commensurate with the additional 30 days that were not
contemplated when the PSA was originally executed. PSA Amendment Number 2 increases the
construction phase services by a value of $47,000 to a total cost not to exceed $94,187.00.
ALTERNATIVES: As recommended by the Commission.
FISCAL EFFECTS: PSA Amendment Number 2 will decrease the Water Impact Fee fund by a
value of $47,000.
