MEETING DATE: August 29, 2011 AGENDA ITEM TYPE: Consent RECOMMENDATION: Adopt Resolution and Authorize City Manager to execute on behalf of the City of Bozeman an alternative delivery project contract for the Bogert Pool renovations. BACKGROUND: In 2005, the Montana Legislature created an alternative project delivery contract process for certain construction projects of state agencies and certain local governments. The legislation established requirements that must be met in order to use an alternative project delivery contract, including a written justification. City staff feels that the Bogert Pool renovations project justifies the use of this process, as set forth in the Resolution. Bogert Pool is in need of several renovations including ladder replacements, gutter replacements, and replacement of the existing liner. Many of these improvements will need to be field fit and designed by a qualified contractor once the pool has been drained for the season. These improvements must be completed before the pool reopens for the 2012 season. This creates a time crunch for any contractor and city staff to assure the pool is protected from the freezing temperatures and the work is completed on schedule. The alternative delivery process allows the City of Bozeman to select a qualified contractor to complete this project as a “design/build” by one contractor instead of selecting a separate designer and a separate contractor. This will contribute to significant time savings and possible cost savings by shortening the construction schedule. FISCAL EFFECTS: The entire project will be funded through the Bogert Pool’s Capital Improvements Project (CIP) budget that has previously been approved by the commission. ALTERNATIVES: No action Attachments: Commission Resolution 4334 Report compiled on: 8/18/2011 20 COMMISSION RESOLUTION NO. 4334 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE AWARD OF AN ALTERNATIVE PROJECT DELIVERY CONTRACT FOR THE BOGERT POOL RENOVATION WHEREAS, § 18-2-502, MCA, authorizes the City to use and alternative project delivery contract. A governing body that uses an alternative project delivery contract shall determine that the proposal meets at least two of the sets of criteria described in § 18-2-502, MCA, subsections (2)(a) through (2)(c) and the provisions of subsection (3). WHEREAS, Bogert Pool Renovations must be completed within the time constraints specified in § 75-10-736, MCA, and therefore the project has significant schedule ramifications and using the alternative project contract is necessary to meet critical deadlines by shortening the duration of construction. WHEREAS, the type of this project includes aspects of value engineering and construction planning that would contribute to significant cost savings by allowing the contractor to complete the final design and construction of the project. WHEREAS, the scope of the project is highly specialized in nature, such that only contractors qualified to design and construct pool renovations of this type, the project therefore presents significant technical complexities that necessitate the use of an alternative delivery project contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That Chris Kukulski, Bozeman City Manager, is authorized to execute on behalf of the City of Bozeman an alternative delivery contract for the Bogert Pool Renovation. 21 Section 2 That Chris Kukulski, Bozeman City Manager, will ensure that the contract will be awarded in an appropriate manner that will not encourage favoritism or bias nor substantially diminish competition, by conducting the process in such a manner that only qualified contractors will be eligible, and that the award will be based upon experience and expertise of the applicants.
