MEETING DATE: August 22nd, 2011 AGENDA ITEM TYPE: Consent RECOMMENDATION: Motion and vote to approve and authorize City Manager to sign Bozeman Water Reclamation Facility, Digester No. 3 and Solids Dewatering Building Project – Change Order No. 2. BACKGROUND: Attached is a copy of change order number 2 for the above referenced project. This change order includes twenty four items. Six of the items are credits while the other eighteen are additions. Pages two through five of the attached document titled “Change Order No. 2 Summary” provides a short description of each of the items involved with this change. Additionally, the remainder of the document contains the detailed backup cost information for each item. With the exception of CPR 48, the change order is a wash financially. CRP 48 is an owner requested change to enclose the sludge load out bay for $150,000. When the overall project was repackaged and portions rebid, one of the elements that was removed was the sludge storage building. This was going to be where dewatered sludge was stored through the winter months. The plan was to dewater the sludge during the summer months and then continue to utilize the sludge ponds during the winter. The plant staff has analyzed the situation and found that it is much more cost effective and efficient to dewater the sludge year round and haul it to the Logan landfill for composting. In order to do this, the sludge load out bay must be enclosed in order to keep the dewatered sludge from freezing. This item also requires an extension of contract time of 118 days for substantial completion and 68 days for final completion. No other change in contract time is being provided with this change. The final recommended increase in cost and time extension for this change is reasonable and commensurate with the work involved. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission. 66 FISCAL EFFECTS: Overall this change order increases the contract amount by $150,187.69 from $5,321,791.10 to $5,471,978.79. This will decrease the contingency on the project from $442,478.25 to $292,290.56. WHEREAS, the City Commission did, on the 17th day of February 2010, authorize award of the bid for the Bozeman WRF Digester No. 3 and Solids Dewatering project, to McAlvain Civil Constructors, Inc., Boise, Idaho; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and McAlvain Civil Constructors, Inc., as contained in Change Order No. 2, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 269 Resolution No. 4332, Change Order 2 for WRF Digester No. 3 & Solids Dewatering 2 of 2 PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 22nd day of August 2011. __________________________________________ JEFFREY K.
