COMMISSION RESOLUTION NO. 4330
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH DUNEMAN CONSTRUCTION, OF BELGRADE, MONTANA.
WHEREAS, the City Commission did, on the 16th day of August 2010, authorize award of tbebid
for the construction of the College /Huff ne Pathway to Duneman Construction, Belgrade, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and, Dunernan Construction, Belgrade, Montana, as contained in Change Order No. 3
attached hereto, are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest
such signature.
PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 1st day of August 2011.

JUSTIFICATION {JFCHANGE ORDER:
Items 1,2 and 8: In preparing the path foundation along Alignment "C" from Station 27+00 to 27+90, rotting tree stumps
and organic material were encountered requiring muck excavation to build a suitable path base, GeutexU|eGeo|onfabric
was used to wrap the rock and grave[ backfill to provide a firm foundation.

unworkable to obtain foundation preparation and compaction. Wet, lasting spring weather compounded the issue of

was deemed the appropriate solution as the Owner, Engineer and Contractor are all concerned about project delivery

subexcavation and replacement as the alternative, at a substantial lengthier amount of install time and cost if this Item
was not used.

CURRENT CONTRACT PRICE: $441,025.65 CONTRACT COMPLETION DATE: As of July 10, 2011, the
Contractor is 9 days over the 50 day contract time. Substantial
Completion is estimated at July 15, 2011.
AMOUNT OF THIS CHANGE ORDER: +22,495.00 NUMBER OF DAYS GRANTED THIS CHANGE ORDER: 5
NEW CONTRACT PRICE: $463,520,65, NEW CONTRACT COMPLETION DATE: At 55 Calendar Days
The completion date as set forth in the contract documents shall be (unchanged, increased, decreased) by 5 calendar
days. The date for completion of all work will be on expected Substantial Completion of ,July 15, 2011. With the
additional contract days aranted herein (to 55 calendar days total), the Contractor is still sublect to liquidated damages as
substantial completion is oroiected to be at 64 calendar days, or 9 days beyond contract time. A summary of the 5
additional contract days to be granted herein follows.
5 days to subexcavate, backfill and install geotextile as described herein. In addition, the Contractor installed numerous
irrigation sleeves along MSU frontage and at Technology Boulevard at the request of those owners for future irrigation
runs under the path. The Contractor provided labor for install which removed some labor forces from project work.
APPROVALS:
Surety consent is required if the net increase of this change order and all previous change orders exceeds 20% of the
original contract amount.
Note: The following Surety Consent is NA as the sum of Change Orders 1, 2 and 3 does not exceed 20% of the
original contract amount.
SURETY CONSENT
The surety hereby consents to the aforementioned contract change order and agrees that its bond or bonds shall apply
and they extend to the contract as thereby modified or amended per this change order. The principal and the surety
further agree that on or after execution of this consent, the penalty of the applicable performance bonds or bonds is
hereby increased by $ (100% of the change order amount) and the penalty of the applicable
labor and material bond or bonds is hereby increased by $ (100% of the change order amount).

In summary, the installation of geotextile separation fabric has allowed the project delivery to be expedited in
comparison to if the subgrade material were removed (subexcavated) and replaced with gravel. The use of
geotextile not only increased the labor output that the Contractor could achieve, in comparison to a
subexcavation process, but is a less costly process, As an example, a square yard (SY) of subexcavation, at
2 feet deep, amounts to approximately 0.7 cubic yards (CY) of subexcavation. Subexcavation costs $4,50/CY
and the replacement gravel for this process is $1 8.00/CY. A lesser quality geotextile to line the excavation is
$1 .25/SY. For the 1 square yard of area in a sublexcavation process, the total estimated cost is approximately
$17.00/SY for all materials (subexcavation, replacement and geotel
By comparison, with this change order, the use of the more robust Geolon Geotextile, at $5.00/SY eliminated
the sublexcavation process, and had an install cost of $5.00/SY, or approximately 1/3 of the subexcavation

SUBJECT: Approve Resolution 4330 authorizing the City Manager to sign Change
Order ##3 for the use of geotextile separation fabric due to unfavorable soil
conditions for the College /Huffne Community Transportation
Enhancement Program (CTEP) Pathway project.

RECOMMENDATION: Approve Resolution 4330 authorizing the City Manager to sign
Change Order 43 in the about of +$22,495.00, for the
College/Huffne Pathway CTEP Pathway project.
BACKGROUND: The College /Huffine Pathway originally started construction in the fall of
2011. When the weather became too prohibitive to work last winter, there
was a winter shut down that temporarily halted the work for the season.
When construction started back up this spring there were areas where the
pathway was to be constructed that had unsuitable soils for paving the
pathway and could not meet specifications. In one area rotting tree stumps
were discovered and needed to be excavated and clean pit run had to be
imported in their place.
Due to the wet weather of the construction season this spring the
contractor and engineer decided to use geotextile fabric instead of waiting
for the material to adequately dry for construction. Since this project is
funded through CTEP and is on a very tight schedule, it was deemed
appropriate to take these measures to assure the project was completed on
schedule.
A total of 60 cubic yards of material needed to be removed and replaced,
and 4,229 square yards of geotextile fabric was used. A complete break-
down of quantities and unit prices has been provided by the engineer and
the contractor in the attached Change Order 93.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: This project is funded through the CTEP program. If this project
does not finish on schedule the City and the contractor potentially
face reduced funding from CTEP due to the reporting requirements
and the commitments outlined in the original contract. The use of
geotextile fabric, for the wetter portions of the pathway, have
allowed faster construction, since the contractor does not have to
wait for the material to dry out.
This change order increases the contract price by $22,495.00. The
new total contract price is $463,520.65.
