COMMISSION RESOLUTION NO. 2907 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOlEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 657 FOR THE PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN, CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICATION OF ASPHAL T CONCRETE STREET IMPROVEMENTS, STORM DRAINAGE, CONCRETE CURB AND GUTTER, CONCRETE SIDEWALK, AND ALL NECESSARY APPURTENANCES TO SERVE THE WESTFIELD SUBDIVISION, . PHASE III, IN THE CITY OF BOlEMAN, MONTANA. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 22nd day of February, 1993, the City Commission duly passed Commission Resolution No. 2905, declaring it to be the intention of said City Commission to create a Special Improvement District to be known and designated as Special Improvement District No. 657 for the purpose of accomplishing the engineering design, construction, inspection and engineering certification of asphalt concrete street improvements, storm drainage, concrete curb and gutter, concrete sidewalk, and all necessary appurtenances to serve the Westfield Subdivision, Phase III, in the City of Bozeman, Montana. That said Commission Resolution No. 2905 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 657, the estimated cost of said improvements and the method of .assessing the same against the property of the district; and WHEREAS, the notice of the passage of Commission Resolution No. 2905 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the publication and service of said notice; and WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protest against the creation of said proposed Special Improvement District No. 657. The City Commission was in regular session on the 15th day of March, 1993, at 7:00 o'clock p.m. at the Commission Chamber in the City Hall Building in the said City of Bozeman, . Montana. The same was the time and place passing upon all protests, if any, against the proposed work or against the creation of said district; and, it further appears that all of the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: ..- ------- >~.".. ----.- - ~ ' .. .. . ~ . .. . Section 1 That the said Special Improvement District No. 657 of the City of Bozeman is hereby created for the purpose of making improvements as set out in Commission Resolution No. 2905 and hereinafter described. Section 2 . That said special improvements are hereby ordered to be made in Special Improvement District No. 657 as follows: THE ENGINEERING DESIGN. CONSTRUCTION. INSPECTION AND ENGINEERING CERTIFICATION OF ASPHAl T CONCRETE STREET IMPROVEMENTS. STORM DRAINAGE. CONCRETE CURB AND GUTTER, CONCRETE SIDEWALK. AND All NECESSARY APPURTENANCES TO SERVE THE WESTFIELD SUBDIVISION. PHASE III. IN THE CITY OF BOZEMAN. MONTANA. Section 3 That the entire cost and expense of the improvements herein referred to in said Special Improvement District No. 657 shall be assessed against the entire district. Each lot. block. tract or parcel of land within the district boundary will be assessed for that portion of the whole cost which its area bears to the area of the entire district. exclusive of streets. avenues. alleys. public .Places. and open spaces designated as open space on the plat of Westfield Subdivision. Phase III. attached as Exhibit "An to Commission Resolution No. 2905. The total actual assessable area within the entire district is 304.322.80 square feet and is the area on which all assessments will be calculated.
