COMMISSION RESOLUTION NO. 2912
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN.
MONTANA. CREATING SPECIAL IMPROVEMENT DISTRICT NO. 658 FOR
THE PURPOSE OF ACCOMPLISHING THE ENGINEERING DESIGN.
CONSTRUCTION. INSPECTION AND ENGINEERING CERTIFICATION OF
ASPHAL T CONCRETE STREET IMPROVEMENTS; STORM DRAINAGE;
INTEGRAL CONCRETE CURB AND GUTTER; CONCRETE SIDEWALKS; AND
ALL OTHER NECESSARY APPURTENANCES TO COMPLETE THE ASPHALT
. PAVING IMPROVEMENTS IN AN APPROXIMATE 1100-FOOT PORTION OF
WEST BABCOCK STREET IN THE CITY OF BOZEMAN. MONTANA.
WHEREAS, at a regular session of the City Commission of the City of Bozeman,
Montana, held on the 26th day of April, 1993, the City Commission duly passed Commission
Resolution No. 2910, declaring it to be the intention of said City Commission to create a Special
Improvement District to be known and designated as Special Improvement District No. 658 for the
purpose of accomplishing the engineering design, construction, inspection and engineering
certification of asphalt concrete street improvements; storm drainage; concrete curb and gutter;
concrete sidewalks; and all other necessary appurtenances to complete the asphalt paving
improvements in an approximate 1100-foot portion of West Babcock Street in the City of
Bozeman, Montana. That said Commission Resolution No. 2910 is hereby referred to and made
a part hereof for further particulars in respect to the boundaries of said Special Improvement
.District No. 658, the estimated cost of said improvements and the method of assessing the same
against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No. 2910 was duly
published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general
circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such
notice by U.S. mail to each person, firm or corporation having property within the proposed district
at his or its last known address, upon the same date that such notice was first published as
aforesaid, and due proof having been made of the publication and service of said notice; and
WHEREAS, within the time provided by law and said published and served notice, there
was not sufficient protest against the creation of said proposed Special Improvement District No.
658. The City Commission was in regular session on the 17th day of May, 1993, at 7:00 o'clock
. p.m. at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana.
The same was the time and place passing upon all protests, if any, against the proposed work or
against the creation of said district; and, it further appears that all of the proceedings for the
creation of said district have been lawful and regular.
NOW, THEREFORE. BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:

Section 1
That the said Special Improvement District No. 658 of the City of Bozeman is hereby
created for the purpose of making improvements as set out in Commission Resolution No. 2910
and hereinafter described.
Section 2
. That said special improvements are hereby ordered to be made in Special Improvement
District No. 658 as follows:
THE ENGINEERING DESIGN. CONSTRUCTION.
INSPECTION AND ENGINEERING CERTIFICATION OF
ASPHALT CONCRETE STREET IMPROVEMENTS; STORM
DRAINAGE; CONCRETE CURB AND GUTTER; CONCRETE
SIDEWALKS; AND ALL OTHER NECESSARY
APPURTENANCES TO COMPLETE THE ASPHALT PAVING
IMPROVEMENTS IN AN APPROXIMATE 1100-FOOT
PORTION OF WEST BABCOCK STREET IN THE CITY OF
BOlEMAN. MONTANA.
Section 3
That the entire cost and expense of the above referenced improvements in said Special
Improvement District No. 658 shall be assessed against the entire district. Each lot. block. tract
or parcel of land within the district boundary will be assessed for that portion of the whole cost
.WhiCh its area bears to the area of the entire district. exclusive of streets. avenues. alleys. public .
places. and open spaces. attached as Exhibit" A" to Commission Resolution No. 2910. .
The total actual assessable area within the entire district is 2.625.348 square feet
square feet and is the area on which all assessments will be calculated.
PASSED AND ADOPTED by the City Commission of the City of Bozeman. Montana. at
a regular session thereof held on the 24th day of May 1993.
