Present were Deputy Mayor Sean Becker, Commissioner Chris Mehl, Commissioner Cyndy Andrus, Assistant City Manager Chuck Winn, City Attorney Greg Sullivan and City Clerk Stacy Ulmen. * * Please refer to the audio recording of this meeting for additional detail. 0:10:59 A. Call to Order-6 p.m.-Commission Room, City Hall, 121 North Rouse Deputy Mayor Becker called the meeting to order. 0:11:09 B. Pledge of Allegiance and a Moment of Silence 0:11:42 C. Changes to the Agenda Deputy Mayor Becker asked Assistant City Manager Chuck Winn if there were any changes to the Agenda. Mr. Winn stated that Mayor Krauss's absence needs to be approved. 0:11:51 D. Authorize Absence of Commissioner Taylor and Mayor Krauss. 0:11:54 Motion and Vote to authorize the absence of Cr. Taylor and Mayor Krauss. It was moved by Cr. Andrus, seconded by Cr. Mehl to authorize the absence of Cr. Taylor and Mayor Krauss. Those voting Aye being Crs. Andrus, Mehl and Deputy Mayor Becker. Those voting No being none. The motion passed 3-0. 0:12:07 E. No person commented. Deputy Mayor Becker closed public comment. 0:12:22 Motion and Vote to approve consent Items 1-5. It was moved by Cr. Mehl, seconded by Cr. Andrus to approve consent Items 1-5. Those voting Aye being Crs. Mehl, Andrus and Deputy Mayor Becker. Those voting No being none. The motion passed 3-0. 0:12:39 F. Public Comment Deputy Mayor Becker opened public comment. 0:13:03 David Graham, Public Comment Mr. Graham of 257 Eze Street, Belgrade spoke in support of one of the Economic Development Council applicants. 0:13:38 Public Comment closed Deputy Mayor Becker closed the public comment. 0:13:41 G. Action Items 0:13:46 1. Deputy Mayor Becker closed public comment. 0:26:44 Motion to approve a Mail Ballot Election for the 2011 Elections. It was moved by Cr. Andrus, seconded by Cr. Mehl to approve a Mail Ballot Election for the 2011 Elections. 0:27:13 Commission Discussion on the motion The Commission discussed polling places and turnout numbers along with expenses and return postage. 0:30:03 Vote on the Motion to approve a Mail Ballot Election for the 2011 Elections. Those voting Aye being Crs. Andrus, Mehl and Deputy Mayor Becker. Those voting No being none. The motion passed 3-0. 0:30:15 Motion to consider funding for return postage costs. It was moved by Cr. Andrus, seconded by Cr. Mehl to consider funding for return postage costs. 0:30:39 Commission Discussion on the motion The Commission spoke regarding the postage costs and return rates. The Commission decided that it would be good to have the Commissioner's that are absent weigh in on this decision. 0:42:43 Motion to withdraw the motion to consider funding for return postage costs. It was moved by Cr. Andrus, seconded by Cr. Mehl to withdraw the motion to consider funding for return postage costs. Those voting Aye being Crs. Andrus, Mehl and Deputy Mayor Becker. Provisional Adoption of Ordinance No. 1807, Amending the Commission’s Rules of Procedure, Bozeman Municipal Code Chapter 2.04 (Sullivan) City Attorney Greg Sullivan gave the staff presentation regarding the Provisional Adoption of Ordinance No. 1807, Amending the Commission’s Rules of Procedure, Bozeman Municipal Code Chapter 2.04. 0:53:27 Questions for Staff Discussion took place regarding public comment times and advisory board rules. 1:01:40 Public Comment Deputy Mayor Becker opened public comment. No person commented. Deputy Mayor Becker closed public comment. 1:01:52 Motion and Vote to provisionally adopt Ordinance No. 1807 amending the Commission's rules of procedure, BMC Chapter 2.04. It was moved by Cr. Mehl, seconded by Cr. Andrus to provisionally adopt Ordinance No. 1807 amending the Commission's rules of procedure, BMC Chapter 2.04. Those voting Aye being Crs. (Re) Appointment to the Police Commission (Kissel) 1:11:35 Motion to approve the City Manager's reappointment of Bill Ranard to the Police Commission. It was moved by Cr. Andrus, seconded by Cr. Mehl to approve the City Manager's reappointment of Bill Ranard to the Police Commission. 1:11:53 Discussion on the Motion 1:12:11 Vote on the Motion to approve the City Manager's reappointment of Bill Ranard to the Police Commission. International Institute of Municipal Clerk's Conference highlights 1:19:52 3. DRC Agenda Distribution Cr. Becker would like a Newsletter sign up notification for Citizen Advisory Board Agendas. He thought that it was already agreed upon to send out the agendas to the Chairpersons of Board. He emphasized that the alert would be helpful so folks will not need to go and find the agendas. Attorney Sullivan spoke regarding the Board Discussions. If an item is discussed, it needs to be on their agendas. He has concerns. Agendas could go to Chair, individuals could send comments rather than setting up a system where they are having meetings. This is another area where education will need to take place. Applicants need to know when their item is to be discussed. 1:26:36 4. Commission Packets 1:27:03 5. LED Lighting Mr. Winn stated that the North 7th Urban Renewal Board rejected the idea of looking into this for the project in their area. Senate Bill 423 Medical Marijuana Mr. Sullivan stated that the bill is now law and some items will soon become effective. There are some items within the City's Ordinance will need to change based upon this. He is looking into this further. There are a lot of legal issues with this. This will be before the Commission this summer for some Code changes. (Before July 1st) 1:31:52 I.
