SUBJECT: Withdrawal of the demolition component of the McGuane Single
Household Residence (SHR) Certificate of Appropriateness (COA) application (#Z11050),
which was noticed as a public hearing and opened and continued by the City Commission on
May 2, 2011.

RECOMMENDATION: Approval of the consent item to acknowledge the withdrawal of the
request for demolition as a component of the McGuane SHR COA. This action will resolve the
need to schedule, notice and hold a public hearing on the application, since it was previously
opened and continued on May 2.
BACKGROUND: Applicant Thomas McGuane submitted an application for extensive
“remodeling” of the residence at 410 South 3rd Avenue. The Department of Planning and
Community Development found the extent of alterations met the definition of “Demolition” per
Sec. 18.80.800 of the Bozeman Municipal Code (BMC). “Demoltion” is defined as “Any act or
process that destroys, in part or whole, a structure or archaeological site.” The project was
scheduled for review and approval by the Design Review Board, Historic Preservation Board and
City Commission, as required by Sec. 18.28.080 of the BMC.
Prior to the Design Review Board hearing, the applicant requested the action item be opened and
continued by the Commission in order to allow time to work with Staff to revise the proposed
design. The Commission opened and continued the item on May 2, 2011.
Subsequent revisions to the design of the project have preserved the historically significant
portions of the structure in compliance with the applicable regulations and design guidelines. As
such, the demolition component of the COA has been withdrawn and the COA application can
be reviewed and approved administratively.
To that end, by approving this action item the commission will acknowledge withdrawal of the
demolition component of the application. This will resolve the need to schedule, notice and hold
a public hearing on the application, since it was previously opened and continued. The revised
application will be reviewed administratively and be subject to approval by the Planning
Director.

The Planning Department has mailed a revised notice to surrounding property owners who
originally received notification indicating that the application has been revised to eliminate the
demolition component and that all comments on the application should be direct to Staff for
consideration as part of the administrative review.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: The City Commission could remove this item from the consent agenda,
reclaim approval authority of the application and schedule a public hearing for the McGuane
SHR COA.
