AMENDING THE 1990 BOZEMAN AREA MASTER PLAN UPDA TE BY CHANGING THE LAND USE ELEMENT ON 134.24 ACRES DESCRIBED AS THE EASTERN 765 FEET OF TRACT 1 OF C.O.S. NO. 2050. ALL OF MINOR SUBDIVISION NO. 145A. TRACT 2 OF C.O.S. 2050. AND A PARCEL DESCRIBED IN FILM 12. PAGE 1159 AT THE GALLA TIN COUNTY CLERK AND RECORDER'S OFFICE FROM "URBAN RESIDENTIAL" TO "COMMERCIAL" ON 22:t ACRES EAST OF THE NEW ALIGNMENT OF NORTH 27TH A VENUE AND TO "URBAN RESIDENTIAL IN FILL" ON 52.79:t ACRES WEST OF SAID ALIGNMENT. WHEREAS. the City of Bozeman has adopted a master plan, pursuant to Section 76-1-604, M.C.A.; and WHEREAS, the proposed master plan amendment has been properly submitted, reviewed and advertised in accordance with the procedures set forth in Section 76-1-601 et seq.. M.C.A., and the 1990 Bozeman Area Master Plan Update, dated October 1990; and WHEREAS, the City Planning Board held a public hearing on October 5, 1999, to receive and review all written and oral testimony on the request for the master plan amendment; and WHEREAS, the City Planning Board recommended to the Bozeman City Commission that the requested master plan amendment to change the land use element from "Urban Residential" to "Commercial" and "Urban Residential Infill" be approved; and WHEREAS, the City Commission adopted Commission Resolution No. 3332 on November 1, 1999, stating its intent to revise the 1990 Bozeman Area Master Plan Update to change the land use element from "Urban Residential" to "Commercial" and "Urban Residential Infill" on the subject parcel; and WHEREAS, the City Commission held its public hearing on November 1, 1999; and WHEREAS, the City Commission has reviewed and considered the four criteria established in the 1990 Bozeman Area Master Plan Update, and found the proposed master plan amendment to be in compliance with the four criteria; and WHEREAS, the City Commission has found the proposed master plan amendment to change the land use element from "Urban Residential" to "Commercial" and "Urban Residential Infill" on the subject parcel would be appropriate and constitute an overall improvement to the plan, contingent upon annexation; and WHEREAS, the subject property was annexed through adoption of Commission Resolution No. 3434, adopted on the 9th day of April 2001. NOW. THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That the 1990 Bozeman Area Master Plan Update is hereby amended by changing the land use element from "Urban Residential" to "Commercial" on 22.44 acres described as: A tract of land being a part of the Northwest Quarter of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana, and being more particularly described as follows: Commencing at the center 114 corner of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana; thence North 00013'52"East, along the north-south 1 14 line of said Section 35, a distance of 126.05 feet to the Point of Beginning, said point being the point of curvature of a non.tangent curve to the left, having: a radius of 300.00 feet, a central angle of 16034'01", a chord bearing of North 32046'40" West and a chord length of 86.45 feet; thence along the arc of said curve, an arc length of 86.75 feet to the point of tangency of said curve; thence North 41 003'43"West, a distance of 470.98 feet to the point of curvature of a curve to the right, having: a radius of 300.00 feet, a central angle of 41017'35",a chord bearing of North 20024'56"West and a chord length of 211.56 feet; thence along the arc of said curve, an arc length of 216.21 feet to the point of tangency of said curve; thence North 00013'52" East, parallel to and 432.50 feet westerly at right angles from the said north- south 114 line of Section 35, a distance of 1902.19 feet; thence North 89045'14" East, along the north line of Section 35, a distance of432.51 feet; thence South 00013'52" West, along the north-south 1 14 line of Section 35, a distance of 2530.14 feet to the Point of Beginning. The described tract contains 22.44:t acres, more or less. Section 2 That the Bozeman Area Master Plan Update is hereby amended by changing the land use element from "Urban Residential" to "Urban Residential Infill" on 52.79:t acres described as: A tract of land being a part of the Northwest Quarter of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County. Montana, and being more particularly described as follows: Beginning at the center 114 corner of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana; thence South 89041 '58 "West, along the east-west 1 14 line of said Section 35. a distance of 1126.15 feet; thence North 30022' 19"West, a distance of 483.25 feet; thence North 59037'41 "East, a distance of 87.36 feet; thence North 30022'19"West, a distance of 65.00 feet; thence clockwise through the following 9 courses; South 59037'41" West, a distance of 87.36 feet; North 30022' 19" West, a distance of 236.99 feet; North 00013'52" East, a distance of 893.36 feet; South 89046'08" East, a distance of 58.43 feet; North 00013' 52" East, a distance of 60.00 feet; North 89046'08" West, a distance of 58.43 feet; North 00013'52" East, a distance of 194.08 feet; North 89044'23" East, a distance of 760.88 feet; North 00013'52" East, a distance of 830.43 feet; thence North 89045' 14" East, along the north line of Section 35, a distance of 332.51 feet; thence South 000 13'52"West, parallel to and 432.50 feet westerly at right angles from the north.south 114 line of Section 35, a distance of 1902.19 feet to the point of curvature of a curve to the left, having: a radius of 300.00 feet, a central angle of 41 017'35",a chord bearing of South 20024'56" East and a chord length of 211.56 feet; thence along the arc of said curve, an arc length of 216.21 feet; thence South 41 003'43"East, a distance of 470.98 feet to the point of curvature of a curve to the right, having: a radius of 300.00 feet, a central angle of 16034'07",a chord bearing of South 32 046'40"East and a chord length of 86.45 feet; thence along the arc of said curve, an arc length of 86.75 feet; thence South 00013'52"West, a distance of 126.05 feet to the Point of Beginning.
