A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF
CONTRACT WITH DUNEMAN CONSTRUCTION, BELGRADE,
MONTANA.
WHEREAS, the City Commission did, on the 16th day of August, 2010, authorize award of the
bid for the Construction of the College/Huffine Pathway to Duneman Construction, Belgrade, Montana;

WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman,
a municipal corporation, and Duneman Construction, Belgrade, Montana, as contained in Change Order
#2, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and
directed to execute the contract change order for and on behalf of the City; and the City Clerk is
authorized and directed to attest such signature.

JUSTIFICATION OF CHANGE ORDER:
Item 1:During construction, the work uncovered a buried electrical pull box at the corner of Ferguson Avenue and Huffine
Lane. The pull box is in conflict with the proposed curb and gutter and ADA pedestrian ramp. The Contractor has
coordinated with numerous potential electrical subcontractors to obtain a cost estimate with limited success over the
course of the winter shutdown. The original proposal of $17,536.26 by another electrical subcontractor was rejected as
excessive. The City since supplied the Contractor with a list of contractors that they usually send requests for signal work.
Of those, it was noted that Gallatin Electric does a good job and is reasonable. Gallatin Electric has thoroughly acoped
the work with MDT and provided this second quote. The pull box will be relocated –25'mutof the street. The work
includes trenching, new conduit, approximately 1,000' of signal cable for loop sensors, re-using pedestrian pole cable, and
new ground. In coordination with MDT, theacceptable traffic control would be candles along the shoulder of Huffine
Lane. Full lane closure would likely not benecessary.
Item 2: This Change Order will eliminate the bid Additive Alternate No, 1in its entirety. The proposed work, if
constructed, would traverse thru a park area on the Montana State University (MSU) campus, of which MSU would have
tu perpetually maintain. The widened path, if constructed, would not fit the purpose and need for the park area. Instead,
it is desired by MSU to leave the narrower, existing sidewalk in place; that is and will remain to be suitable to meet K4SU'm
purpose and need. Likewise, eliminating construction mf this item would eliminate concerning impacts tu park trees and
shrubbery.

days. The date for completion of all work will be May 21, 2011 . based on 20 Calendar Days remaining, and if the Work
proceeds from its current winter shutdown beginning May 2, 2011, which is the anticipated spring startup date based on
current coordination,
APPROVALS:
Surety consent is required if the net increase of this change order and ali previous change orders exceeds 20% of the
original contract amount.
Note: The following Surety Consent is NA as this Change Order No. 2, along with the previously approved
Change Order No. I does not exceed 20% of the original contract amount.
SURETY CONSENT
The surety hereby consents to the aforementioned contract change order and agrees that its bond or bonds shall apply
and they extend to the contract as thereby modified or amended per this change order. The principal and the surety
further agree that on or after execution of this consent, the penalty of the applicable performance bonds or bonds is
hereby increased by $ (100% of the change order amount) and the penalty of the applicable
labor and material bond or bonds is hereby increased by $ 11 —__ (100% of the change order amount).
