BACKGROUND: Bids were opened May 24, 2011, for the 2011 Street Improvements project. The project consists of three Schedules: Schedule 1 is cold milling and asphalt plant mix overlay of Kagy Boulevard from approximately S. Tracy Ave to Highland Boulevard, followed by a chip seal, and an asphalt plant mix overlay of Baxter Lane from Davis Lane to approximately Buckrake Avenue; Schedule 2 consists of chip seals on various streets as shown on the attached Work Vicinity Map; and Schedule 3 consists of chip sealing the streets in Sundance Springs Subdivision. The Sundance Springs Homeowners Association, which is responsible for maintenance of the streets in this subdivision, requested that we include chip sealing their streets in our project this year. Two bids were received, with the low bidder being Knife River, Inc. of Belgrade, MT in the amount of $432,978.00. The bids appear to be competitive with the low bid being approximately 2% below the construction estimate ($443,464.00). A copy of the Certified Bid Tabulation is attached. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission. FISCAL EFFECTS: Funding for Schedules 1 and 2, in the amount of $382,870.50, has been planned for from the Fuel Tax fund. You are notified that your Bid dated May 24, 2011, for the above Contract has been considered. You are the apparent Successful Bidder and have been awarded a Contract for cold milling and hot mix overlays, pavement marking replacements, and seal coat improvements (Schedules 1, 2 and 3). The Contract Price of your Contract is: four hundred thirty two thousand nine hundred seventy eight and 00/100 Dollars ($432,978.00). Three copies of the proposed Contract Documents accompany this Notice of Award. You must comply with the following conditions precedent within fifteen (15) days of the date of this Notice of Award, that is, by . 1. You must deliver to the OWNER 3 fully executed counterparts of the Agreement including all the Contract Documents and Drawings. 2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the Instruction to Bidders (page 8), General Conditions (paragraph 5.01) and Supplementary Conditions (paragraph SC-5.02). 3. List other conditions precedent: You must deliver with the executed Agreement the Certificates of Insurance as specified in the General Conditions (paragraph 5.03). Failure to comply with these conditions within the time specified will entitle OWNER to consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited. Within ten (10) days after you comply with these conditions, OWNER will return to you one fully signed counterpart of the Agreement with the Contract Documents attached.
