HomeMy WebLinkAboutApprove Reclaiming jurisdiction for the F&H Building at 211 East Main.pdf Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Allyson Bristor, Associate Planner Tim McHarg, Planning Director SUBJECT: Jurisdiction of a Certificate of Appropriateness (COA) application for the property located at 211 East Main Street (commonly known as the F&H Building) requesting the establishment of a new projecting sign that is 19 square feet in area. MEETING DATE: June 13, 2011 AGENDA ITEM TYPE: Consent Item RECOMMENDATION: The City Commission reclaimed jurisdiction for the F&H Building site plan application in 2010, located at 211 East Main Street. Therefore, because this COA application is for the same property, Staff recommends that the City Commission consider reclaiming to itself the final approval of the Santa Fe Red’s Projecting Sign COA application, per Section 18.64.010 C.1 of the B.M.C., and further set a tentative public hearing date of July 18, 2011 for formal consideration of the application proposal. RECOMMENDED MOTION: Based upon the fact the City Commission reclaimed jurisdiction of the F&H Building site development at 211 East Main Street, I move to reclaim jurisdiction of the Santa Fe Red’s Sign COA application proposed for the same property. I further move to set the Santa Fe Red’s Sign application’s public hearing date to July 18, 2011. BACKGROUND: Property owner Mike Hope and business owner Jared Bratsky, represented by Locati Architects, submitted a sign permit and COA application for the establishment of a new projecting sign at 211 East Main Street (commonly known as the F&H Building). The new sign is proposed as 19 square feet in area and will read as “Santa Fe Red’s Restaurante Cantina.” One deviation from the Bozeman Municipal Code is requested with the application, specifically from Section 18.52.060, to allow the projecting sign to exceed 12 square feet in area. When a zoning application has been reclaimed by the City Commission, it has been the policy of the Commission to reclaim all subsequent applications related to the original zoning application. Since the City Commission reclaimed and approved the site plan application for the F&H Building, Staff believes it is appropriate for the Commission to reclaim the COA application for the COA for the new projecting sign on the building. UNRESOLVED ISSUES: None at this time. 45 ALTERNATIVES: The City Commission may choose to not reclaim jurisdiction of the Santa Fe Red’s Sign COA application, and therefore, the Board of Adjustment would be the final decision making body. FISCAL EFFECTS: Reclaiming jurisdiction of the COA will not have any fiscal impacts. Attachments: None. Report compiled on: June 2, 2011 46
