PUBLIC STREET AND UTILITY EASEMENT
NORTHWESTERN CORPORATION GRANTOR, in consideration of $1.00 and for other and
valuable considerations, receipt of which is acknowledged, grants to the CITY OF BOZEMAN,
a municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue,
Bozeman, Montana, 59715, GRANTEE, its successors and assigns, a perpetual street and utility
casement for the use of the public, in, through, and across a portion of a parcel of real property
situated in Gallatin County, Montana, legally described as follows:
A parcel of land situated in the Southwest 7 / Section 12, Township 2 South Range
5 East, P.M.,M., Gallatin County, Montana and being part of that land deeded to
Madison River Power Company, now NorthWestem Corporation, by Deed
recorded in Book 36, Page 109, Records of Gallatin County, Montana.
The location and shape of that portion of the above described real property hereby
granted as perpetual street and utility casement is more particularly described on the attached
`RIGHT OF WAY EXHIBIT A' which by this reference is made a part hereof
The GRANTOR states that they possess the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
