1. Authorize Payment of Accounts Payable Claims (LaMeres)
2. Authorize City Manager to sign grant agreements and other documents
related to a grant proposal to the Department of Justice, Community
Oriented Policing Services, Secure Our Schools program (Stocks)
3. Authorize Submittal of Grant application to the Montana Preservation
Fund (Kramer)
4. Finally Adopt Ordinance No. 1805, implementing prior Commission
action on Zone Map Amendment No. Z-10320 Loyal Garden Lot 1, Phase
1A (Skelton)
5. Finally Adopt Ordinance No. 1806, implementing prior Commission
action on Zone Map Amendment No. Z-10240 Loyal Garden Lot 2-3,
Phase 1A (Skelton)

for the record. This is the time for individuals to comment on matters falling
within the purview of the Bozeman City Commission. There will also be an
opportunity in conjunction with each agenda item for comments pertaining to that
item. Please limit your comments to three minutes.

H. Action Items
1. Resolution No. 4316, notifying the Gallatin County Election
Administrator of the City's desire to conduct the 2011 City Primary (if

held) and the 2011 General Election by Mail Ballot in accordance with
Section 13-19-202 of the Montana Code Annotated and Decision of
funding Postage Return Costs (Ulmen)
*Consider a motion approving Resolution No. 4316, notifying the Gallatin County
Election Administrator of the City's desire to conduct the 2011 City Primary (if held) and
2011 General Election by Mail Ballot in accordance with Section 13-19-202 of the
Montana Code Annotated including the funding for return postage costs, and direct
City Clerk to submit the Resolution to the Gallatin County Elections Office by June
11, 2011.
OR
*Consider a motion approving Resolution No. 4316 notifying the Gallatin County
Election Administrator of the City's desire to conduct the 2011 City Primary (if held) and
2011 General Election by Mail Ballot in accordance with Section 13-19-202 of the
Montana Code Annotated without funding the return postage costs, and direct City
Clerk to submit the Resolution to the Gallatin County Elections Office by June 11, 2011.
2. Fellowship Baptist Church Conditional Use Permit with Variances
Application No. Z-11069 (Skelton)
*Consider the motion: Having reviewed the application materials, considered public
comment, and considered all of the information presented, I hereby adopt the findings
presented in the staff report for Z-11069 and move to deny the requested variance to
Section 18.44.010A “Relationship to Undeveloped Areas” and 18.44.010.B
“Relationship to Developed Areas” to not construct North 25th Avenue and provide for
the continuation of streets.
AND
*Consider the motion: Having reviewed the application materials, considered public
comment, and considered all of the information presented, I hereby adopt the findings
presented in the staff report for Z-11069 and move to deny the requested variance to
Section 18.50.060 “Frontage” to not construct North 25th Avenue and provide street
frontage along the west perimeter of Rose Park.
AND
*Consider the motion: Having reviewed the application materials, considered public
comment, and considered all of the information presented, I hereby adopt the findings
presented in the staff report for Z-11069 and move to approve Conditional Use Permit
application Z-11069 to construct a 53,587 church and site related improvements, hereby
incorporating by reference the findings included in the staff report with conditions as
recommended in the staff report and subject to all applicable code provisions.

3. Public hearing on Impact Fee Appeal No. 1102 from Norton Properties
and J & D Family Partnership, regarding procedural flaws in Impact Fee
Credit Request No. 1101 (Saunders)
*Consider the motion: Having heard and considered the evidence and public testimony,
I move to uphold the determination of the impact fee coordinator,
OR
*Consider the motion: Having heard and considered the evidence and public testimony,
I move to waive criterion 5, Timely request for Impact Fee Credit Request 1101 and
direct staff to advertise a public hearing to consider amending the street and water
impact fee capital improvement programs to include the items in Impact Fee Credit
Request 1101, and direct staff to provide actual cost of work evidence in support of the
requested amounts.
4. Appointment to the Beautification Advisory Board (Kissel)
*Consider appointing one new member to the Beautification Advisory Board.
5. Appointment to the Bozeman Area Bicycle Advisory Board (Kissel)
*Consider appointing one new non-voting High School student liaison to the Bicycle
Advisory Board.
6. Appointment to the Design Review Board (Kissel)
*Consider a motion appointing one new member as the non-professional representative
to the Design Review Board.
I. FYI/Discussion
1. The City Commission will not meet on Monday, May 30th as they do not
meet the fifth Monday of the month, and it is a holiday (Ulmen)
J. Executive Session – 8 p.m. - Litigation Strategy
*The Mayor may close to the public all or portions of this meeting pursuant to Sect. 2-3-
203(4)(a), MCA, if the Mayor finds the meeting involves a discussion of litigation strategy and an
open meeting would have detrimental effect on the litigation position of the City.
