MEETING DATE: May 16, 2011 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution 4315 authorizing the City Manger to sign Change Order #2 in the amount of -$11,750.00, (City of Bozeman savings), for the College/Huffine CTEP Pathway project. BACKGROUND: During the construction of the shared use pathway, the contractor discovered a traffic signal pull box at the intersection of Ferguson and Huffine that was buried and previously unidentified by the Montana Department of Transportation (MDT) during preconstruction review. ADA accessible curbs and approaches are to be installed at this intersection as part of the pathway project. Engineers from Robert Peccia and Associates (RPA), Keith Duneman, construction contractor, City engineers, City Sign and Signal staff, Parks and Recreation Director, and representatives from MDT met on site to assess the problem. It was determined that the pull box needed to be relocated to avoid being run over by traffic and to prevent water from running into it. With construction of the new accessible curbs, the pull box, in its present location, would be in the street. It is necessary to move the pull box back behind the curb in order to keep it out of the line of vehicle traffic and drainage. UNRESOLVED ISSUES: None at this time. ALTERNATIVES: As suggested by the City Commission. 21 FISCAL EFFECTS: .The original contract for the construction of the College/Huffine CTEP Pathway included reconstruction of the walkway through the MSU Park at the corner of 11th and College at a cost of $18,950.00. MSU has decided that they would rather keep the walkway the size that it is currently and so this has been eliminated from the project. The bid for relocation of the pull box is $7,200.00. As a result of the elimination of the MSU Park pathway, Additive Alternative #1, there is a reduction in the project cost of $18,950.00 resulting in a savings of $11,750.00 after paying $7,200.00 for the pull box relocation. Attachments: Change Order Form #2 Change Order Resolution # 4315 Report compiled on: May 4 2011 22 1 of 2 COMMISSION RESOLUTION NO. 4315 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH DUNEMAN CONSTRUCTION, BELGRADE, MONTANA. WHEREAS, the City Commission did, on the 16th day of August, 2010, authorize award of the bid for the Construction of the College/Huffine Pathway to Duneman Construction, Belgrade, Montana; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and Duneman Construction, Belgrade, Montana, as contained in Change Order #2, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 23 Resolution No. 4313 Change order #21 Page 2 of 2 PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 16th day of May, 2011. __________________________________________ JEFFREY K.
