SUBJECT: Acknowledge receipt of Impact Fee Appeal 1102, regarding procedural flaws in Impact Fee Credit Request 1101 and set a public hearing date of May 23, 2011.

BACKGROUND: An impact fee credit request was received for construction on Cottonwood Road, West Babcock Street and a water main located under West Babcock Street. The credit was denied due to procedural flaws including lack of CIP listing and timeliness of submittal. The
decision of staff was appealed to the Development Impact Fee Review Committee. The DIFRC
met on April 25th. After considering the matter they upheld the earlier administrative action. The
applicant now appeals to the City Commission.
UNRESOLVED ISSUES: The date of the hearing.
ALTERNATIVES: The City Commission may choose its preferred date to consider the
appeal. Notice of the hearing does need to be provided. The soonest possible date for
consideration is May 23rd which is the recommended date.
FISCAL EFFECTS: This item will require public notice with associated costs. No other fiscal effects are quantified at this time.
