A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
V
PROVIDING FOR THE ANNEXATION OF A CERTAIN CONTIGUOUS TRACT OF LAND,
HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN
AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO
INCLUDE SAID CONTIGUOUS TRACT.
WHEREAS, the City of Bozeman received a request for annexation from the City of
Bozeman,
owner of the tract, requesting the City Commission to extend the boundaries of
the City of Bozeman
so as to include a certain contiguous tract of land lying immediately north of
Bridger Creek Golf
Course and Bridger Creek Subdivision, Phase III, along the west side of Story Mill
Road in the County
of Gallatin, State of Montana; and
WHEREAS, an annexation staff report has been prepared in accordance with the Commission's
goals and policies for annexation and was presented to the Commission on June 19,
2000; and
WHEREAS, Commission Resolution No. 3368 was adopted by the City Commission on June
19, 2000, declaring it to be the intent of the City of Bozeman to extend the boundaries
of said City
so as to include said contiguous tract within the corporate limits of the City;
and
WHEREAS, a public hearing on Commission Resolution No. 3368 was duly noticed and
held
on August 7, 2000; and
WHEREAS, one objection to said annexation were raised at the public hearing; and
WHEREAS, the City did not receive any written protest from the real property owners
of the
area to be annexed; and
WHEREAS, on August 7, 2000, the Commission authorized and directed staff, upon
satisfaction of the terms of approval, to prepare the necessary documents to proceed
with the
annexation of this tract in accordance with Commission Resolution No. 3368; and
WHEREAS, the provision of services must be addressed as required by Section 7~2-4305
MCA; and
WHEREAS, the City states its intention that the provision of rights-of-way, installation
of
services, easements, and other matters necessary for development of the property
be appurtenant
to the property; and
WHEREAS, the City states its intention that extensions of services not be at the
public
expense unless the City itself undertakes the development of the subject property;
and
WHEREAS, the Bozeman City Commission hereby finds that the annexation of this contiguous
tract is in the best interests of the City of Bozeman and the inhabitants thereof
and of the inhabitants
of the contiguous tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 43, M.C.A.,
the following-
described property, which is contiguous to the municipal boundaries of the City
of Bozeman, be
annexed to the City of Bozeman and that the boundaries of said City shall be extended
so as to
embrace and include such 201.22 acres of land, to wit:
A parcel of land located in the Southwest one-quarter and the Southeast one-quarter
of Section 30, Township 1 South, Range 6 East, Montana Principal Meridian, Gallatin
County, Montana, being more particularly described as follows:

The Southeast Quarter (SE Y4) and all that part of the Southwest Quarter (SW Y4)
lying
east of the County road in Section 30, Township 1 South, Range 6 East, Montana
Principal Meridian. Gallatin County, Montana, described as follows:
Beginning that the East Quarter Corner of Section 30, Township 1 South, Range 6
East,
Montana Principal
Meridian; thence
South 00058'16" West, along the
North/South section line, a distance of 2482.44 feet, to the Southeast Corner of
Section 30; thence South 88015'39" West, along the East/West section line, a
distance of 2616.92 feet, to the South Quarter Corner of Section 30; thence North
01 034'52"East, along the North/South quarter section line, a distance of 146.82
feet,
to the centerline of Mcllhattan Road; thence following the centerline of Mcllhattan
Road through the following course: North 25023'47"West a distance of 80.31 feet;
North 45045'25"West a distance of 209.3 feet; North 31 038'51 "West a distance
of
218.34 feet; North 350 52'41 "West a distance of 141.88 feet; North 38 041'49"West

to the Point of Beginning.
Section 2
The City hereby covenants that:
All future development on the tract, excepting improvements related to current
City of
Bozeman landfill operations, shall be served by City Water and Sewer as provided
for
in the City's facility master planning documents.
Upon future development of the
tract, the City Water/Sewer Department will review plans for development of the
proposed water infrastructure when they are provided and make any recommendations
required to supply water to any proposed development on the tract. The Landowner
shall complete at Landowners' expense, the necessary system improvements as
determined by the City of Bozeman to serve the full development. Utility easements,
a minimum of thirty (30) feet in width, will be necessary for the installation
and
maintenance of water and sewer utility services to the annexed parcel.
The
Landowners shall create any such other easements in locations agreeable to the
City
during the appropriate development procedure, but in no event later than the filing
of
any final plat or site plan or issuance of a building permit on the subject property.
Section 3
The effective date of this annexation is August 15, 2001.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 6th day August 2001 .
