SUBJECT: Sketch Plan Certificate of Appropriateness application for the property
located at 410 South 3rd Avenue requesting extensive exterior alterations at the property located
at 410 South 3rd Avenue, including: 1) installation of a new foundation with full basement; 2)
removal of the existing roof; 3) construction of a second story of the residence; 4) installation of
new aluminum-clad windows; and 5) related site improvements. The residence contributes to the
Bon Ton Historic District, on the National Register of Historic Preservation.

RECOMMENDATION: To take any public comment on the project and then to “open and
continue” the public hearing in order to give the applicant sufficient time to revise their project
proposal.
RECOMMENDED MOTION: Based upon the request from the applicant, I move to
“Open and Continue” the public hearing on Certificate of Appropriateness application
Z11050, the McGuane Residence, to a date to be determined after the revised project
proposal has been submitted.
BACKGROUND: Property owner Thomas McGuane submitted an application for a Sketch
Plan Certificate of Appropriateness for the residence at 410 South 3rd Avenue, a property in the
Bon Ton Historic District, listed on the National Register of Historic Places. The Department of
Planning and Community Development found the extent of alteration proposed with the project
meets the definition of Bozeman Municipal Code 18.80.800 “Demolition”, defined as “Any act
or process that destroys, in part or whole, a structure or archaeological site.”
As stated in BMC 18.28.080, “Demolition or Movement of Structures or Sites within the
Conservation District,” the existing residence on the site is designated as “contributing” element
by the Montana Historical and Architectural Inventory and therefore, the City Commission is
charged with the final approval of the demolition request through a public hearing.
Historic Preservation Officer prepared a design review memo in preparation for the Design
Review Board’s required hearing on the project. Upon review of the proposed project against
BMC 18.28 and Bozeman’s Design Guidelines for Historic Preservation, Historic Preservation

Officer Courtney Kramer notified the property owner that the Planning Department would
recommend the City Commission deny the COA application.
Following this information, the property owner requested the May 2 City Commission Action
Item be “Opened and Continued” in order to enable the applicant to revise their project proposal.
The applicant requests time to meet with their draftsperson to revise the project, and Staff will
reschedule the Public Hearing date once revised plans have been submitted to the Department of
Planning.
Please note that because this application is being continued to a date undetermined at this time,
the hearing will be renoticed once the schedule is determined.
UNRESOLVED ISSUES: HPO Kramer is uncertain if the City Commission can “Open and
Continue” a project indefinitely.
ALTERNATIVES: The City Commission could deny the request for Open and Continue, and
hear the project application on May 2, 2011.
FISCAL EFFECTS: The proposed application will increase the taxable revenue generated from
the property.
Attachments: Copy of Email from applicant requesting the commission grant the applicant
additional time in order to revise their application.
