SUBJECT: Request by Van Bryan Studio Architects on behalf of Fellowship Baptist Church
for the City Commission to Reclaim to Itself the Final Approval of Conditional
Use Permit with Variances Application #Z-11069, per Section 18.64.010C.1,
BMC.

RECOMMENDATION: That the City Commission reclaims approval authority over Conditional Use
Permit with Variances Application #Z-11069, per Section 18.64.010.C.1.
BACKGROUND: Zoning Application #Z11069 has been made for Conditional Use Permit with
Variances approval for the Fellowship Baptist Church to construct a 53,587 square foot church and
related site improvements on property situated at the northeast corner of the intersection of West Oak
Street and North 27th Avenue. The application includes a request for variances to Section 18.44.010.A
& B “Relationship to Undeveloped Areas and Developed Areas” and Section 18.50.060 “Frontage” of
the Bozeman Municipal Code. Because of the multiple variances, the application would normally be
considered by the Board of Adjustment for final action.
On October 20, 2008 the Bozeman City Commission conditionally approved a Minor Subdivision
Preliminary Plat application and a Zone Map Amendment application to amend the City of Bozeman
Zone Map from R-3 to R-4 for the north 2.8 acres of the property in question. Based on past City
Commission involvement with review and approval of the planning related proposals on the subject
property, also involving similar variance requests, the applicant has requested that the City Commission
reclaim approval authority over the project, per Section 18.64.010.C.1, BMC ( see attached letter from
Van Bryan Studio Architects dated March 30, 2011). Given the history of past development reviews on
this site by the City Commission, and further finding that one of the requested variances is related to
public parkland, Planning Staff is supportive of the applicant’s request.
UNRESOLVED ISSUES: None determined at this time.
