MEETING DATE: March 21, 2011 AGENDA ITEM TYPE: Consent   RECOMMENDATION: Authorize the City Manager to sign the award of bids to Tyler Electric and McLees Incorporated for Lighting and Energy Retrofits at various City owned facilities under the U.S. Department of Energy – Energy Efficiency Conservation Block Grant Program. The total contract amount will be up to $151,625.00, including consultant fees, as per the grant award amount. BACKGROUND: The City of Bozeman was awarded $175,500 in Energy Efficiency and Renewable Energy Conservation Block Grant Program, (EECBG), funding. Of this total $131,625.00 was to be used for Building Energy Efficiency. $20,000 of the total was to be used for the installation of a solar energy package at Fire Station #3 and the 911 Center. When the solar energy package did not happen, the money was reallocated to the Public Building Retrofits. The remainder of the award was dedicated to the North 7th Bus Shelter, and energy tracking for the City Climate Action Plan. City Staff worked with an energy consulting firm to identify a list of energy and mechanical system retrofits that would provide the highest reduction of energy use in relation to the amount of money spent. Staff’s summary and the consultant summary are included for reference as an attachment. This is to show the projects that were considered for the grant funding. The goal was both a reduction in energy use and a short payback period for the renovations that are carried out. The grant specifically does not allow money to be spent on swimming pools and there are restrictions for historic buildings. These projects were included because we are going to pursue rebate money from North Western Energy. The rebate money could then be used on grant restricted projects without having to rebid. 37 The retrofits will be documented and the summary of changes will be submitted to NorthWestern Energy under the commercial E+ Energy Program. Should the modifications made qualify for any energy rebates the rebate money will be applied to additional improvements that are outside the realm of the allowable funding under the grant program. Based on NCAT’s Project Summary and the Staff Summary of Possible Energy Projects, NCAT compiled bid specifications (Exhibit A and B). Contractors submitted bids for each of these line items and NCAT made a recommendation for award based on the bid numbers. Staff will work with NCAT to scale back the project to fit within the grant ceiling of $151,625.00. The Department of Energy requires that we commit grant funds by March 22, 2011. Commission authorization will allow us to formalize the contract and satisfy this requirement. This Federal source of funds is tied into the American Recovery and Reinvestment Act and has a large number of oversight requirements. These include, in part: reporting requirements, lobbying restrictions, prevailing wage rate requirements, and buy-America provisions. The Finance Department will be heavily involved in meeting all the grant documentation and reporting requirements. FISCAL EFFECTS: The bid package for this project was developed so that the subset components of the project were bid in a way that allows us to select the improvements that are both the most energy efficient and that will stay within the level of grant funding we have for the project. The final contract will summarize the scope of work so that we stay within the designated grant funding. The combined contract, with consultant fees, will be for the grant award amount of $151,625.00. ALTERNATIVES: As suggested by the City Commission.
