BACKGROUND: On April 27, 2010 the Bureau of Justice Assistance (BJA) announced the Bozeman Police Department and the Gallatin County Sheriff’s Office were eligible for an Edward Byrne Memorial Justice Assistance Grant (JAG) in the amount of $24, 305. A requirement of this disparate grant is that the funds be used jointly between our two (2) law enforcement agencies. On February 3, 2011, Dara Schulman (Department of Justice Grants Specialist) informed the City that documents needed to be revised to reflect an increase in the award amount to $40,204. These revisions were completed by Lt. Kent and Mr. Stocks and require Commission approval. JAG funded projects address crime by improving the effectiveness and efficiency of the criminal justice systems, processes and procedures. The Commission is asked to review the attached program narrative and approve the application and sign the revised Interlocal Agreement/MOU. FISCAL EFFECTS: We intend to use these grant funds to purchase equipment which will be used by the City and County Detectives as well as the City/County Evidence Technician. This will provide valuable equipment to the agencies while at the same time lessen the impact on our respective equipment budgets. No matching funds are required. ALTERNATIVES: As suggested by the City Commission. Attachments: JAG Program Narrative Interlocal Agreement Report compiled on: March 3, 2011 16 Attachment 1 – Program Narrative (REVISED 3/3/2011) Bozeman Police Department and Gallatin County Sheriff’s Office Justice Assistance Grant (JAG) Application 2010 Automated Fingerprint Identification System (AFIS) Proposed Program Activities The Bozeman Police Department (BPD) in conjunction with the Gallatin County Sheriff’s Office (GCSO) is requesting FY 2010 Local Justice Assistance Grant funding to purchase a fully integrated Automated Fingerprint Identification System (AFIS) at a cost of $40,204. The AFIS system will be used equally by detectives from both agencies. The stand alone, desktop system will give local law enforcement access to the Federal Bureau of Investigation’s fingerprint database which consists of several million sets of latent finger and palm prints. We expect the AFIS system will significantly increase efficiency of processing fingerprints and enhance the Departments ability to identify offenders. Previously, BPD and GCSO anticipated an award in the amount of $24,000. Additional funds provided by JAG ($16,204) will be used to increase the quality and capacity of the AFIS. This revised Program Narrative does not modify the scope or budget in any way except total cost. Project Need and Objectives: The purchase of a stand alone AFIS system will increase efficiency in processing crime scene evidence. Currently, when latent fingerprints are collected from a crime scene, they are sent to the State of Montana Crime Lab for identification. Identification at the lab is done using a similar AFIS system but the process of fingerprint identification and verification can take anywhere from 2 to 6 months. Having the local resources and technology available to quickly and accurately identify latent fingerprints can make a significant difference between providing a just outcome for a crime victim and allowing an offender to not get caught. This grant will be used for a one time purchase of an Automated Fingerprint Identification System. Upon approval of grant funds, the BPD and GCSO will immediately purchase, set up, and connect to the FBI fingerprint database. The equipment will be operational shortly after purchase, immediately enhancing the Departments investigative tools and ability to identify offenders. Organization Capabilities and Competencies The City of Bozeman Accounting Division provides accounting and financial services to the Bozeman Police Department. They are responsible for maintaining the financial integrity of accounting records, transactions, and systems for all departments. Among many duties, the Accounting Division bills reimbursements from federal, state, and local grantor agencies and assures expenditures are in compliance with appropriation and budgetary constraints. The Accounting Division ensures the City’s financial records are maintained in accordance with Generally Accepted Accounting Principles and prepares a Comprehensive Annual Financial Report (CAFR) for each fiscal year. This JAG grant will be used for a one time purchase of an Automated Fingerprint Identification System. The purchase must 17 comply with the City’s purchasing policy, which will be verified by the City Controller in the Accounting Division. Disparate Certification The proposed JAG project is a collaborative effort between the Bozeman Police Department and Gallatin County Sheriff’s Office. Grant funding will be used equally. A Memorandum of Understanding between the BPD and GCSO is attached. 18 Attachment 2 - Budget Narrative (Revised 3/3/2011) Bozeman Police Department and Gallatin County Sheriff’s Office AFIS System On April 27, 2010 the Bureau of Justice Assistance (BJA) announced the Bozeman Police Department and the Gallatin County Sheriff’s Office were eligible for an Edward Byrne Memorial Justice Assistance Grant (JAG) in the amount of $24,305. A requirement of this disparate grant is that the funds be used jointly between our two law enforcement agencies and we requested $23,910 for purchase of an Automated Fingerprint/Palmprint System (AFIS). Subsequently, the grant award was modified from $23,914 to $40,204. We are requesting these funds and will apply them solely to the AFIS as described in the previous proposal. The additional funds will be used to increase system capacity and efficiency. This equipment will significantly increase efficiency of processing fingerprints and enhance both departments ability to identify offenders. 19 Attachment 3 – Review Narrative On April 27, 2010 the Bureau of Justice Assistance (BJA) announced the Bozeman Police Department and the Gallatin County Sheriff’s Office were eligible for an Edward Byrne Memorial Justice Assistance Grant (JAG) in the amount of $24,305. Following the announcement, the two departments determined that funding should be proposed to purchase an AFIS system in order to increase efficiency of processing fingerprints. The proposal was presented to the Bozeman City Commission and opened for public comment on June 7, 2010. The Commission consented to the disparate agreement between the City and the County and to the submitting the proposal for purchase of the AFIS System. On June 22, 2010 the proposal was passed by the Gallatin County Commission. Subsequently, BJA revised the award amount to $40,204 and requested the submission of revised documents, including the Interlocal Agreement/MOU. We expect the AFIS system will significantly increase efficiency of processing fingerprints and enhance the Departments ability to identify offenders. 21 GMS Application Number: 2010-H6979-MT-DJ GMS Application Number: 2010-H6979-MT-DJ Contract Number: 2010-DJ-BX-1148 The State of Montana City of Bozeman Know all by these present County of Gallatin County AGREEMENT BETWEEN THE CITY OF BOZEMAN AND COUNTY OF GALLATIN 2010 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD This Agreement if made and entered into this ____day of March, 2011 and revises the Agreement entered into the 9th day of June, 2010, by and between the COUNTY of Gallatin, acting by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the CITY of BOZEMAN, acting by and through its governing body, the City Commission, hereinafter referred to as CITY, both of Gallatin County, State of Montana, witnesseth: WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party: and WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement: and WHEREAS, the CITY and COUNTY agree to use the $40,204.00 (revised from $24,000.00) from the JAG award towards the purchase of specialized equipment and indirect costs for the jointly-funded Law Enforcement Evidence Technician and by Detectives from both agencies, which is an equal collaborative effort by the CITY and the COUNTY: and WHEREAS, the CITY and COUNTY believe it’s in the best interests of the public to reallocate JAG funds. NOW THEREFORE, the CITY and the COUNTY agree as follows: Section 1. CITY and COUNTY agree jointly to use the $40,204.00 of JAG funds. 22 GMS Application Number: 2010-H6979-MT-DJ Section 2. COUNTY agrees to use $40,204.00 for the purchase of specialized equipment and indirect costs for the jointly-funded Law Enforcement Evidence Technician and by Detectives from both agencies. Section 3. Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which applicable law may impose liability. Section 4. Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which applicable law may impose liability. Section 5. Each party to this Agreement will be responsible for its own actions in providing services under this Agreement and shall not be liable for any civil liability that may arise for the furnishing of the services by the other party. Section 6. The parties to this Agreement do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto.
