SUBJECT: Consider amendment to the Transportation Impact Fee Capital
Improvement Program to add signalization at the intersection of Fowler Avenue and W. Main
Street.

RECOMMENDATION: Move to approve an amendment to include on the FY11 transportation
impact fee capital improvement listing the signalization of Fowler Avenue and W. Main Street in
the amount of $384,580.
BACKGROUND: W. Main Street is classed as a principal arterial and Fowler Avenue is
classed as a minor arterial. The primary function of arterial streets is to carry large volumes of
vehicles over longer distances with a secondary purpose of access to adjoining properties. The
functional classification of streets is described in more detail in Section 9.1 in the City’s
transportation plan.
The City has adopted transportation impact fees to help provide for additional capacity in the
arterial and collector streets to provide service to new development within the community. The
fees are spent to widen streets, install intersection control, and take related actions to increase
capacity. For further information please see Chapter 3.24, Impact Fees, in the Bozeman
Municipal Code.
The City has established certain criteria which must be satisfied before expending impact fees.
Included in those criteria is that a project must be included on the City’s impact fee capital
improvement list and funded on that list. A request has been received to include signalization of
Fowler Avenue and W. Main Street on the Transportation CIP.
As noted above, the two streets are arterial streets and signalization of the intersection will
provide service to many. The 2005 traffic counts for the intersecting road segments show a daily
load of 24,500 vehicles per day. Main Street is the primary east-west link in the City’s
transportation system. Fowler Avenue is a developing north-south link that will eventually
provide service from Valley Center Road to Hyalite Canyon. With these characteristics it appears
that the signalization will provide material benefit to the overall transportation system by
allowing greater daily volumes to be served at a key intersection.

The exact cost of the work to complete the intersection is known at $384,579.39. Signalization of
major intersections such as the one requested under this item are considered as 100% impact fee
eligible for costs of signalization since they serve such a large volume of long distance travelers.
Examples of similar projects also funded through impact fees include the intersections of
Cottonwood Avenue and W. Main Street, Kagy Blvd. and S 11th Avenue, and Rouse Avenue and
Griffin Drive.
On February 14, 2011 the City Commission directed Staff to prepare and notice a public hearing
to consider this request to amend the CIP. The notice has been correctly published and the
Commission may consider the matter at the March 21, 2011 City Commission meeting.
Supporting material for the costs for this item was provided to the Staff and Commission earlier
and are not duplicated here. Materials may be found through the City website at
http://www.bozeman.net/Business/Document-Center. Select the Agendas and Packets (2001-
2011) item under the heading for Commission Meetings. Materials are located under the heading
of Mitchell Impact Fee appeal on the January 10, 2011 and February 7, 2011 City Commission
meetings and is available for review with the agenda packet for that date. A summary by the
applicant is attached, see item 5 on the Mitchell Development Group sheet. The City Engineer’s
staff has reviewed the provided costs and has found them reasonable and appropriate to the work
performed for the signalization.

FISCAL EFFECTS: This item will commit the City to funding $384,580 from the
Transportation Impact Fee account. There are sufficient funds within that account to cover this
commitment.
