The motion carried by the following Aye and No vote: those voting Aye being Commissioner Goebruog Commissioner Frost, Commissioner Swanson, Commissioner Knaipp and Mayor Hawks; those voting No none' Commission Resolution No 2835 certi delinquent semi-annual assessments as of Ma 31, 1991 to the County Treasurer for collection City Manager Wysocki presented Commission Resolution No. 2835, as approved by the City Attorney, entitled: COMMISSION RESOLUTION NO- 2835 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN MONTANA DECLARING 3Bm[-ANNUAL SPECIAL ASSESSMENT INSTALLMENTS DUE AND PAYABLE MAY 31 1991 AND UNPAID 83 OF THAT DATE, DE- L|N0UENT PURSUANT TO SECTION 7-12-41u3 MONTANA C0DEANNVTAT- ED AND AS PROVIDED BY CHAPTERS 2,32 AND 3,04 OF T8E BOZEMAN MUNICIPAL CODE AND DIRECTING THE DIRECTOR OF FINANCE TO CER- TIFY THE SAME TO THE 6ALLAT/N COUNTY TREASURER FOR COL- LECT0N' The City Manager reminded the Commission that he had requested this item be re- omvcu from the Consent Items. He then noted that the list of delinquencies is substan- tially larger than it has been in past years; however, given the figures on the printout, it appears that many people forgot to make the second half payment in May, He reminded the Commission that the street and tree maintenance districts were assessed on v semi- annual basis. He also noted that many people are used to making only an annval payment in November, and both half coupons were included an the one form with no reminder being mailed for the second half payments. re- moved from the Consent Items because of the length of the listing. He noted that the od- d/tiona[ length may be duo in large part to oversight; however he noted that some major property owners, with large amounts due and owing, are included in the list, He then expressed concern that given the present interest rates, it may once again be cheaper for individuals to let the assessments go delinquent than to borrow monies to pay them. He noted however, there is nothing the City can do to alleviate that problem under existing statutes. City Manager Wysocki recommended that the Commission adopt this Resolution. It was moved by Commissioner Frost, seconded by Commissioner Smansom, that the Commission adopt Commission Resolution Mp- 2835 certifying delinquent assessments as of May 37 1997' to the County Treasurer for collection.
