December 9, 1991
The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, December 9, 1991, at 3:30 p.m. Present were Mayor Pro
Tempore Swanson, Commissioner Goehrung, Commissioner Frost, Commissioner Knapp, City
Manager Wysocki, City Attorney Luwe and Clerk of the Commission Sullivan. Mayor Hawks
was absent in compliance with Section 7- 3- 4322(2), M.C.A.
The meeting was opened with the Pledge of Allegiance and a moment of silence.
None of the Commissioners requested that any of the Consent Items be removed for
discussion.
Minutes
Mayor Pro Tempore Swanson deferred action on the minutes of the regular meetings
of August 26, October 21, November 18, and November 25, 1991, for a period of one
week.
It was moved by Commissioner Goehrung, seconded by Commissioner Frost, that the
minutes of the meetings of October 15 and December 2, 1991, be approved as amended.
The motion carried by the following Aye and No vote:. those voting Aye being Commission-
er Goehrung, Commissioner Frost, Commissioner Knapp and Mayor Pro Tempore Swanson;
those voting No, none.
Continued public hearing - Conditional Use Permit - Town Pump - allow construction of
automatic car wash in conjunction with existing gas station /convenience store on COS No.
1043 1Town PumD Annexation (2607 West Main Street)
This was the time and place set for the continued public hearing on the Conditional
Use Permit requested by Town Pump to allow the construction of a detached automatic car
wash in conjunction with the existing gas station /convenience store located on Certificate
of Survey No. 1043, also known as the Town Pump Annexation. The subject site is more
commonly known as 2607 West Main Street.
Mayor Pro Tempore Swanson re- opened the continued public hearing, after which he
briefly reviewed the Commission's rules of procedure for conducting public hearings.
Associate Planner Kevin Wall reviewed the memo, dated December 5, which was in-
cluded in the Commissioners' packets. He noted that during last week's portion of this
public hearing, the Commissioners requested additional information on the size of the
"wash" sign on the new structure, the square footage of the existing signage, and the
value of the existing signage.

a medical emergency incurred by Commissioner Knapp. Following this brier break, it was
determined that she would be unable to return to the meeting immediately, but would re-
turn as quickly no possible.

It was moved by Commissioner Gnehrung seconded by Commissioner Frost that the
Commission waive the customary one-week waiting period for land use decisions.
City Attorney L"we cautioned that the Commission's rules of procedure require a
unanimous vote of those Commissioners present. He suggested that since Commissioner
Knapp has not been officially excused from this meeting such action should be deferred
until later in the meeting.

City Manager Wysocki reminded the Commission that Commissioner Frost had re-
quested this item be placed on the agenda.
Commissioner Frost reminded the Commission that at their August 26 meeting, the
Commission forwarded the concerns of the residents along North Wallace Avenue to the
Pedestrian/ Traff[c Safety Committee for their review and recommendation. He noted that
the minutes from the Committee's meeting of November 16 did not directly address the is-
sues; and a conversation with Chairman Drvnk revealed that the Committee members did
not feel they had the expertise no address the specific concerns raised.
Commissioner Frost stated he is concerned that the issues raised by the residents
have not yet been addressed; and the school year is nearly half over. He then suggested
that this item be referred to staff, asking for a response as uonu as possible. He noted
that there are serious human safety threats which need to be addressed in the very near
future.
Ms' Patricia Stetson Agnew, 216 North Wallace Avenue, stated that she moved from
Big Timber about a year ago so her children could attend school hero; and they purchased
their home at that time because it is located in an historic area that needs to be pre-
served. She stated that since moving into their home, she has been appalled by the num-
ber of trucks which use the street, and the speed at which traffic moves. She stated that

At Commissioner Gpuhrung/s request, the City manager highlighted the differences
between the State's guidelines and those proposed in this document. He stated that he is
proposing that a federation most be comprised of five or more organizations, a majority of
which must be charitable; and the State guidelines indicate all the organization must be
charitable. Vc noted that he has added the requirement that the federation include orga-
nizations which have a substantial presence in Gallatin County. He further noted the re-
quirement of a minimum enrollment of ten City employees for each federation. He then
noted that the State specifies that no more than zs percent of the monies generated may be
used to support administration and fund raising activities; and ho has changed that to zn
percent.
The City Manager stated that for administration of this prngram, he is proposing
that all materials for eligibility consideration he submitted to his office by August zo each
year; and his decision on eligibility is appealable on the Commission. He than indicated
that the federation posters and printed materials must clearly allow for and stipulate that
an individual may specify his/her contributions to a specific organization within that fed-
eration.
Responding to Commissioner Frost, the City Manager stated he has not forwarded a
copy of these proposed guidelines to United Way.
Commissioner Frost then stated his interest in having a copy forwarded to them
noting his desire to receive feedback from that organization as well since they will be
required to 90 through this process in the future.
Mr. Richard 0iUouo, member of the Board or Directors of Montana Community
Shares, raised several questions and concerns about items contained in these proposed
guidelines. He noted that under "Solicitation," No. * stipulates that no presentations may
be made at work sites during work hnurs. He contrasted this policy with MSU's policy,
where federations were allowed to make their presentations at various group meetings,
such as faculty meetings or employee meetings. He then noted that Nu. a requires that
the pledge cards be submitted to the Payroll Office by the 20th of the month following the
solicitation for inclusion in the deduction program. He encouraged that it be changed to
December 15 which would sti|l allow adequate time to complete the bookkeeping process

prior to the deduction period.
Mr. Gillette noted that the listing of services which an organization must provide to
be eligible under the City's proposed guidelines does not ;odudo any reference to orga-
nizations representing environmental concerns or issues. He also raised concern about
requiring that 75 percent of the monies raised in Gallatin County must remain in Gallatin
County. He noted that the federation represents many state-wide grassroots organiza-
tions; and it Would be difficult to separate those expenditures. He stated that while he

be beneficial to have the fo|| Commission address the issue.
Mayor Pro Tempnre Swanson stated an interest in adding environmental agencies to
the list of eligible oreanizaumns, He then suggested de|udmy the requirement that rs per-
cant of the funds raised remain in Gallatin County. He reiterated his position that Gallatin
County is a prosperous county, while others are less fortunate. He suggested that City
employees ah"vW be given the opportunity to contribute within the state as they so
choose. The Mayor pro Trmpo,e then suggested that to require a minimum enrollment of
ten might be unrealistic, noting that number should possibly be reduced to five.
Responding to the Mayor Pro Tempore, the City Manager briefly highlighted the
fund raising process which has been provided to United Way in recent years. He noted
that they have been allowed to make a brief presentation to the department heads at staff
meeting. He noted that a City mnp|oyvo has then been selected to serve as the campaign
person; and a letter from that individual is distributed, along with United *ay information,
with a monthly paycheck. The employees are then given o period of time to respond by
submitting a pledge card or otherwise contributing to the program. The City Manager
noted that a tape on United Way has also been made available to those employees wishing
to view it; but response to that has been minimal.

plans to promote the North 7th Avenue entrance, steps should be taken to provide pedes-
trian circulation for those staying in that area. He then stated support for establishing a
straight sidewalk, which includes a boulevard area for safety and an attractive entrance to
the community, depending on the costs and legal difficulties that might be incurred.
Mayor Pro Tempore Swanson stated support for a boulevard and sidewalk, stating
he is not interested in a checkerboard approach. He then suggested setting a meeting of
key business leaders along North 7th Avenue, a City staff member and one or two Commis-
sioners to discuss this issue in an attempt to develop a core support group for an
agreed -upon plan.
Ms. Darla Joyner, Executive Director of the Bozeman Area Chamber of Commerce,
stated a willingness to assist in this effort. She then noted that sidewalks are only a
small part of the entryway corridor design, suggesting that some trade -offs may need to
be identified.
Responding to the Mayor Pro Tempore, Planner Wall stated that the final draft of
the Design Objective Plans is due in January; and he projected that adoption of those
plans is anticipated two to three months after that.
South Third Avenue -- Kagv Boulevard to West Graf Street
The Director indicated that Assistant City Engineer Brawner will address this item
later in this presentation.
East Main Street -- Cypress Avenue to Highland Boulevard
The Director stated that this is a similar situation to North 7th Avenue. He noted,
however, that in this instance, a majority of the sidewalk has already been installed, adja-
cent to the curb; and there is only a short portion of the sidewalk to be completed.
North 20th Avenue -- West Main Street to West Beall Street
There was no discussion on this item.
North 17th Avenue -- Durston Road north to city limits
Director Forbes stated that he is comfortable with a full street construction along
this street. He noted, however, that is typically done through a special improvement dis-
trict; and there do not seem to be many proponents of that option along this roadway. He
further noted the issue of equity, particularly since one of the heaviest users of this
roadway is the mobile home park located at the end of the street, which is outside city
limits and, therefore, cannot be automatically included within a special improvement dis-
trict. He suggested it might be possible to install the street through an SID /RID; howev-
er, it would require a substantial amount of time to orchestrate.
Responding to Commissioner Goehrung, the Director suggested that the only accu-
rate way to determine support for an SID would be to go through the process, adopting a
resolution of intent to create, and waiting for response. He further noted that to recon-

was much greater support for Option No. s ' which involves a special improvement district
for improvement of the onUna roadway to a collector street status. He cautioned the Com-
mission that if all or the property within the general boundaries preliminarily established
were assessed on an equal basis, the cost per lot would be $000 to $1'000. He expressed
concern that about sn percent of those costa would be borne by presently undeveloped
properties, which couW impact the viability of the 5/D. He noted that if those undevel-
oped parcels were eliminated from the boundaries, or only a small portion of them included
within the boundarias, then the coots to the individual property owners would double.
The Assistant City Engineer then asked the Commissioners to review the cross sec-
tion of South Third Avenue as it exists, and the location of the sidewalk, which *mum be
installed to match future improvement to the roadway. He noted that the existing roadway
is constructed toward the east edge of the 90-foot right-of-way; therefore, the sidewalk
would be built lower than the existing roadway and much closer than he would like to sow.
He stated that it became evident at the public input meeting that this would not he an ac-
ceptable sidewalk location from a safety standpoint.
Assistant City Engineer Brawner suggested that Option Nn' J is not a viable option
for the Commission to consider because of the high assessments that would be incurred,
and the attendant potential for default, if it is not protested out first. He further noted
that the City is in the middle of its transportation plan update; and the character and pri-
ority for improvement are not yet hnovm. He further uvuad that the main issues to be ad-
dressed involve the pedestrian/ vehicular conflicts; and it may be determined that there is
not o need to upgrade the street to accomplish that.
Assistant City Engineer Brawnar suggested that since he unrs not rre| that Option
No' y is an acceptable remedy at this time and since Option Nos. ) and z do not provide
an acceptable Solution from a safety standpoint, the Commission consider on Option Nn. 4
which would be installation of a temporary asphalt pathway along one side of South Third
Avenue. He indicated a preference for placing that pathway as close to the property lines
as possible, 10 provide as much space as possible between the roadway and pedestrians.
He suggested that this would address the immediate safety issues and provide an accept-
able alternative to the traveling public, at an approximate cost of $50,000. He stated that
at the present time, he is considering various funding options,

the special improvement districts upon which those who would be imparted by on 3|o for

S/D/s involved include ones for storm water, mmtur sewer and paving; and many of those
lots are already carrying a heavy load of assessments.

correctly the first tine. He stated there is neighborhood interest in this issue; and they
may be willing to heonm* involved in some way to assist the City in gathering information
to determine the viability of the project.
Mr. Lineberger also suggested pursuing possible County assistance in funding for
improvement to South Third Avenue particularly in light of the number of County resi-
dents who live within four miles of the city limits. He then stated his interest in seeing
the project done right the first time rather than paying for w temporary measure now and
then paying for a permanent installation in ten years.
Mrs. Judy McKenna, 505 Arnold Street, stated she has invited zr people from the
oei8hhvrbouu to attend a meeting at her house on Wednesday evening for a brainstorming
session. She stated an interest in creating a committee of area residents to assist the De-
partment of Public Works in developing possible alternatives for improvements and funding
possibi|ities. She then stated an interest in seeing the pnV*ot done right the first dma.
She suggested that one possible funding source would be those residents in FigBio, Addi-
tion along Cul-de-sac streets, if they are not required to install sidewalks in front or their
homes. She noted there might be similar sources that a neighborhood committee might be
able to identify. She then stated their desire to work with the City in creating tbe best
possible solution.
Mr. Frank Sch|edorn lmo North 8th Avenue, stated he is a member of the Pilgrim
Congregational Church, which owns :oo feet along South Third Avenue, He stated that he
attended the meeting held on November zo. He noted that many members of the church
would like to have some idea of the participation that will be expected from them for the
temporary pathway. He then stated concern that the new elementary school was construct-
ed without a transportation network in place. He also expressed concern about implement-
ing a temporary measure now, just to address the immediate problem, with the knowledge
that a ponnaocmt solution will be forthcoming within a few years.
Mr. Soh|edvrn noted that be lived in the same home for thirty years. He stated
that when his children were in sohnu| residents of that neighborhood carried petitions to
the City requesting the installation of sidewalks yo their children could safely walk to
school. He noted that thirty years |otwr they still don't have sidewalks. Mr. 5ch/edorn
suggested that many of the children attending the new school wilt he driven there rather
than having To walk. He then suggested that it may be better to take a longer look at the
entire transportation network, and then develop a program that will better vor"c the
school and the area.
City Manager Wysocki asked if the Church would be willing to provide an easement,
as long as it does not interfere with the current perking arrangements, that could be
utilized for p more permanent installation. He suggested that this might be an option to

Director or public Service Fv,oe^ stated ho was approached by the Museum of the
Rockies about the current signage program' since it is not adequately directing visitors to
their facility; and the Pioneer Museum and Beall park Arts Center have also requested
signage for their faci|iUws. He also noted that a signage package should possibly include
the Main NbU.
The Director stated that while the signage is located in an entryway corridor he
feels that it could also be considered independently and coordinated with the other factors.
He stated the bigger issue is determining who can instaQ signage in the public
right-of-way noting that the list of those desiring to do so is quite long.
City Manager Wysocki suggested that the Hospital should be included in any signage
package' He noted that the current signage for the facility may be inadequate, particu-
larly for someone in an emergency situation.
Mayor Pro Temp"re Swanson noted that construction of the new performing art,
center in the downtown area may impact the signage package in the future.
The City Manager stated that standard signage denoting the downtown area is
readily visible in many of the communities throughout the country suggesting that instal-
lation of such signage here could be easily accvmpUyhcd. He then stated a willingness to
meet with representatives from the State Highway Department to discuss this issue.

MONTANA AMENDING ORDINANCE m0. 1337 WHICH CREATED A TAX IN-
CREMENT FINANCING INDUSTRIAL DISTRICT (T/P|D) BOARD.
The City Manager reminded the Commission that they had provisionally adopted this
ordinance at their regular meeting or November 25 and recommended that it be finally
adopted at this time
Cmnm/ooivnrr Goehrung stated his continued opposition to allow those residing out-
side the city limits to participate on this board, whose decisions could impact the taxpay-
ers in the community.
It was moved by Commissioner Frost, seconded by Commissioner Knapp, that the
Commission finally adopt Ordinance No. 1339 amending the membership requirements for
the tax increment financing industrial (T/FID) board. The motion carried by the following

equipment, which was not contemplated during the budgetary process. The City Manager
suggested that this flexibility is needed to operate efficiently.

ber of hit-and-run incidents; issuance of three DUI citations this past week; and issuance
of 140 citations over the weekend, (s) Noted that the police officers are involved in
physical fitness testing, which occurs twice a year. (4) Announced that the interest rate
in the State pool is 5.5 percent, which is generating substantially lower revenues than
projected in the budget. (5) Noted that staff spent the past work preparing for certifica-
tion of delinquent assessments to the County. (s) Noted the retreat held on Saturday.
(7) Indicated that alley dean-up is continuing whenever possible. (n) Stated that the
first part of the information for the newsletter has been forwarded to Bob Ekuy' noting

the Planning Board meeting on Tuesday night, noting it was an example of a poorly run

portion of the retreat was very interesting, with both sides of the argument being pre-
