The meeting was opened with the Pledge of Allegiance and a moment of silence. Mayor Hawks asked if any of the Commissioners wished any of the Consent Items be removed for discussion. City Manager Wysocki asked that the request for deviations sub- mitted by Quality Lubo be removed for discussion' Minutes Mayor Hawks deferred action on the minutes of the regular meetings of August zo and October 15, 1991 for a period of one week. It was moved by Commissioner Frost, seconded by Commissioner Swanson, that the Commission approve the minutes of the regular meeting of August 19, 1991 as amended. The motion carried by the following Aye and No vote' those voting Aye being Commission- er Frost, Commissioner Swanson, Commissioner Knapp and Mayor Hawks/ those voting wn none. Ordinance No. 1336 - establishing a tax increment financing industrial district (TIFID) program City Manager Wysocki presented to the Commission Ordinance No. 1336, as reviewed by the City Attorney, entitled: ORDINANCE NO. 1336 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF 8OZEMAN MONTANA, ESTABLISHING ATAX INCREMENT FINANCING {WDUSTR/ALD/S- TR|CT PROGRAM TO ASSIST IN FINANCING NECESSARY INDUSTRIAL IN- FRASTRUCTURE T0 ENCOURAGE THE ATTRACT/8N GROWTH, AND RE- TENTION OF SECONDARY VALVE ADDING INDUSTRIES; PROVIDING FOR DEFINITION OF TERMS; AND ESTABLISHING THE COSTS WHICH MAY BE PAID BY TAX INCREMENT FINANCING INDUSTRIAL DISTRICTS. Assistant to the City Manager Ron Brey reminded the Commissioners that this ord! nunoo was included in last week's packet for initial review. He then reviewed the infor- mation which he had presented at last week's meeting, reminding the Commission that this ordinance is anohNng legislation which establishes the program and u||mws for specific proposals to be forwarded for Commission consideration. He noted adoption of this or- dinance does not result in any City commitment a: this time' He stated that at the time a 10-2l-91 - 2 - specific proposal is submitted, the Commission must conduct a public hearing and fully explore the merits of the application. The Assistant reminded the Commission that at last week's meeting, Mayor Hawks had raised a question about the wording in Section 3; and he has revised that wording to correspond with the statutory language. The Assistant then reviewed the steps to be followed after adoption of this ordi- nance, which includes creating and appointing a tax increment financing industrial district advisory board, and developing a policy for the program and its operational guidelines. Responding to Commissioner Frost, the Assistant stated that some areas will lend themselves to the TIFID program while others may be better under an urban renewal dis- trict. He then noted that the boundaries of a district may be modified as deemed appro- priate, cautioning that such modifications may have an impact on the base year. Responding to Mayor Hawks, the Assistant stated that the monies from this program can be utilized to upgrade the infrastructure. He noted that such upgrades may need to extend beyond the boundaries of the district; and that possibility is contemplated in the State statutes. It was moved by Commissioner Swanson, seconded by Commissioner Knapp, that the Commission provisionally adopt Ordinance No. 1336, establishing a tax increment financing industrial district, and that it be brought back in two weeks for final adoption. The mo- tion carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Knapp, Commissioner Frost and Mayor Hawks; those voting No, none. Ordinance No. 1337 - creating a tax increment financing industrial district (TIFID) board The City Manager presented to the Commission Ordinance No. 1337, as reviewed by the City Attorney, entitled: ORDINANCE NO. 1337 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A TAX INCREMENT FINANCING INDUSTRIAL DIS- TRICT (TIFID) BOARD; ESTABLISHING THE PURPOSE AND INTENT FOR CREATING THE TIFID BOARD; PROVIDING FOR A DEFINITION OF TERMS; PROVIDING FOR THE POWERS AND DUTIES OF THE TIFID BOARD; PROVIDING FOR APPOINTMENT AND TERMS OF BOARD MEMBERS; PROVID- ING FOR REGULAR MEETINGS AND ELECTION OF OFFICERS; AND PROVID- ING FOR ANNUAL REPORTS. Assistant to the City Manager Ron Brey stated that this ordinance simply creates the advisory board for the TIFID program, as outlined in the above agenda item. He not- ed that, due to the complexities of the program, it is important that specific areas of ex- pertise be included in the board membership; and those specifications have been included in this ordinance. 10 -21 -91 - 3 - Responding to Mayor Hawks, the Assistant stated that the bylaws for this board will include the issue of conflict of interest, noting he anticipates that the issue will be encountered in a number of situations. It was moved by Commissioner Knapp' seconded by Commissioner Frost, that the Commission provisionally adopt Ordinance No. 1337 creating a tax increment financing in- dustrial district (T|F|D) board, and that it be brought back in two weeks for final adoption. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Knapp, Commissioner Frost Commissioner Swanson and Mayor Ho*hy; those voting No none. Commission Resolution No. 2847 - direct staff to examine conditions and prepare report pursuant to the requirements of relating to urban renewal City Manager Wysocki presented Commission Resolution No. 2847, as reviewed by the City Attorney, entitled: COMMISSION RESOLUTION NO. 2847 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN MONTANA, DIRECTING CITY STAFF T0 EXAMINE CONDITIONS IN VARIOUS AREAS OF THE CITY AND T0 PREPARE A REPORT EXAMINING THOSE CONDITIONS PURSUANT TO THE REQUIREMENTS OF STATE LAW RELATING TO URBAN RENEwAL The Assistant to the City Manager stated that this resolution simply directs staff to investigate the feasibility and desirability of an urban renewal program in the City of Bozeman at this dnw. He noted that a packet of background information on tax increment financing districts and the projects completed under such programs in various communities in the State were included in the Commissioners' packets. He stated that some of those programs have been in place for ten years; and those programs are now mature. The Assistant stated that under this resolution, staff would be directed to gather information related to an urban renewal program; discuss such a program with concerned individuals and organizations, gathering input; and report back to the Commission on the feasibility and desirability of creating a tax increment financing district. The Assistant stated that if the Commission determines that it would be appropriate, it could then direct staff to proceed with the steps necessary to create a tax increment financing district, which would include the preparation of an urban renewal plan, a public hearing on that plan and adoption of the plan. It was moved by Commissioner Frost, seconded by Commissioner Swanson, that the Commission adopt Commission Resolution No, 2847 directing staff to pursue the feasibility of establishing an urban renewal program. The Commission then directed the Clerk of the Commission to advertise for the non-professional position which is open as n result of this appointment. Responding to a question from Commissioner Swanson, Commissioner Knepp noted that Mr, Ron Hnaa/s recent letter indicated that he would be no a |oeva of absence for u specified period of time, and did not include any indication that he intends to submit a letter of resignation from this board. A p ointments to Recreation and Parks Advisory Board It was moved by Commissioner Swansvn, seconded by Commissioner Knapp, that the Commission appoint Robert O. Leo to replace Dick pnh| on the Recreation and Parks Advisory Board, with a term to expire on December 31 1992. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Knapp, Commissioner Go:hrung. Commissioner Frost and Mayor Hawks; those voting No, none. Continued discussi City Manager Wysocki reminded the Commission that at last week's meeting' they had reviewed staff's recommendations for Category 1 and most of Category z comments; and staff has now recommended comments to be included in Categories z and 4. for Commission review and d/ucossion. He stated that, in addition to the memo forwarding staff recommendations, the Commissioners have received a letter from the Southwest Building Industry, listing four areas of particular concnrn, Mayor Hawks stated that he received a telephone call from the Southwest Building Industry; and he had asked them to submit the memo which is now before them. He stat- previ- ously submitted. At the Mayor's request, the Planning Director briefly highlighted the four points spa forth in the Southwest Building Industry memo. He stated that the first two points include the general issues pertaining to the Design Review Board and the Development Re- view Committee, their authorities and actions are addressed in the memo. He noted that these issues are discussed in several different contexts throughout this amendment pro- cess- He also noted that the third point involving the issue of requiring bicycle lanes is also addressed in the memo. He noted the fourth issue addressed is a broad one which warrants a lot of attention; and that pertains to when a building permit may be drawn. He characterized this as a philosophical issue that overlaps into a technical area. He stated however, it has been expanded to include "weekend projects" as well as "repairs.'/ He noted staff support for this proposal, indicating that the requirements and processes should be the some for both the entryway overlay district and the neighborhood conservation district. He stated that at the present time only very minor projects are allowed as "weekend projects;" and /hose items are approved administratively by staff and one DRB member. He noted that to make the three-tiered process currently in place in the neighborhood conservation overlay district parallel and available in the entryway overlay district makes good sense. Commissioner Ooehrung noted there is no definition for "weekend project" and sug- gested that one be added. He then embwd what criteria would be used to determine what qualifies as o "weekend project." Planning Director Epp|e stated that under the section pertaining to the neighbor- hood conservation overlay district there are definitions which apply specifically to that section. He then suggested that e definition for '`weekend project" could appropriately be added to that list. Mayor Hawks stated support for this revision, suggesting that the requirements for quorum should also he revised to reflect the old interim zoning ordinance requirements. He reiterated his concern that the current quorum requirements could create a legal prob- lem in the future. Commissioner Swanson stated he has no problem with changing the quorum; howev- er, he still feels that the issue of a liaison between the Planning Board and the DRB can be achieved without a voting membership. Mayor Hawks then suggested another option would he to have two lay people on the DRB, one of those being a Planning Board member. He noted that would create an 8-mem- ber board. Commissioner Knapp noted that under the current zone code, the non-professional member must have an interest in urban design or historic preservation suggesting that this restriction should apply to all non- profess iuna| members. She then noted there is no point in having a professional board that includes people with no professional experience in the field. Mr. Keith Swenson reminded the Commission that last summer, six of the seven members of the DRB were out of city or otherwise unable to attend a meeting. He then proposed that for the Board to meet on a weekly basis which he feels is essential, it would be beneficial if the current Board members could ce|| upon former Board members to fill o vacancy for a meeting. Mayor Hawks asked if that could be accommodated through a change in the by-laws. City Manager Wysocki suggested that an individual must be duly appointed to oerve. He then asked if the Board makes any final decisions, suggesting that if they do, Mr. 5wonson'u proposal would create an unacceptable situation. Mayor Hawks noted that all DR8 decisions are either advisory or appealable to the City Commission. Commissioner Knapp reminded the Commission that the master plan and the zone code are design driven. She noted that since it is design driven, there is the implication that the DRB must be as strong and professional as possible; and if that is not the Com- mission's desire then the documents should riot be design driven. She noted that the Commission depends on both the DRC and the DRB to give professional advice. She then encouraged the Commissioners to "get hack to the basics" when addressing this item. Mayor Hawks stated the size of the signs was determined on a scientific basis, and calculations of what size is necessary to provide information to a driver moving a certain speed on a certain width roadway. He then stated that since the sizes have been scienti- fically determined, he feels there is no reason to increase them, particularly if that in- crease could be construed as aesthetically negative. Commissioner Swanson noted the current height limitation is 8 foot with a potential for 20-peroent deviation, or 10 fort. Loan Fund ated by repayment of CUBU economic development loans This was the time and place set for the public hearing on the proposed guidelines for Economic Development Revolving Loan Fund created by repayment of CDBO economic development loans. Mayor Hawks opened the public hearing. Assistant Planner Debbie Arke/| presented the staff report. She reminded the Com- mission that the City has been successful in receiving four Community Development Block Grant economic development loans: (r) a $150 loan for Sohnoe"s Boot Works, (z) a $300,000 loan for |LX Lightwava Corporation (3) a $180.000 loan for Lattice Materials Cor- poration, and (u) a $95,000 loan for CVK Oak Designs. Mr. Rupp suggested that Section /X| be revised to require that 51 percent of the jobs be for low-income persons, rather than low- and moderate-income persons because of the income guidelines involved. He suggested that this revision would target the jobs for which CDBC monies were intended. He also recommended that a /ovm| wage benchmark be established by which to evaluate the jobs generated. He noted that a single parent with children would be eligible for public assistance at $6.60 per hour; and he feels that it would be inconsistent to create jobs with public funds that allow the further use of public assistance monies. He suggested that this could be accomplished by requiring that the wages paid for those jobs created under this program be at lzs percent of the poverty level established by Congress. Mr. Jeff Rupp suggested that 0 percent of the monies in this fund be earmarked for nicrnbusinessos' which could be defined as those businesses with under five popp&a. He stated that JO percent or the pe"n|o working in businesses xmrh in operations with less than five people. He stated this suggestion would provide small businesses with a source of revenues that could allow them to compete with more established businesses, particularly during the start-up phase. He stated that the Capital Opportunities Program was imple- mented in 1909, and was designed to assist microbusinesses. He noted that this loan pro- gram could provide an additional support for those businesses which is not currently avail- able. He then submitted to the Commission a copy of the annual report for the Capital Opportunities Program for the year 1990-1991. Commissioner Swanson asked Mr. Rupp if he would recommend that the $100.000 cap be retained for microbusinooses under his proposed earmarking of those monies. He stated that includes not limiting access to the jobs created through loans from this fund to low- income individuals, particularly since that would be much more restrictive that the federal and state guidelines. Mr. Steven Knight, Great Gatherings, stated he has started his business under the Capital Opportunities Program, noting that he is competing in the real world. He stated that his business will be competing in the national and international markets for wall de- cor; and it has an unlimited growth potential. He stated that the $10,000 maximum on the Capital Opportunities loan does not provide all of the monies needed for capitalization of equipment and the expenses of a strong growth pattern. He noted that if monies from a program such as this revolving loan fund were made available to microbusinesses, it could provide the additional revenues necessary to maintain that growth pattern, projecting that his current space could accommodate twelve to sixteen employees per shift. Mr. Knight then encouraged approval of the guidelines, including the revisions proposed by Mr. Rupp. Mr. Jim Hassler, Recycle It, noted he started his curbside recycling program under a loan from the Capital Opportunities Program. He stated that he received the maximum loan available; however, that did not cover his expenses of acquiring a vehicle and the other start -up costs. He then urged approval of the guidelines with the provision that 50 percent of the monies be made available to microbusinesses. Responding to Commissioner Goehrung, Planner Arkell stated that under the current State program, CDBG economic development monies become available in July; and the State accepts applications until all of those monies are committed. She then noted that applica- tions for the other CDBG programs are accepted until September 1 of each year only. She then suggested that it would be possible to accept applications at any time for this revolv- ing fund; however, she noted that if the application were for an amount greater than the balance of the fund, the application could either be denied, the amount reduced, or the application held until the fund balance is adequate.. Commissioner Goehrung asked how setting aside a certain percentage for microbusi- nesses would work. He also asked if the City would be eligible to make application for new grants from the State. Planner Arkell stated that the City is eligible to make application for new grants. She stated that whether the State will require that the City use all of its revolving fund monies toward that project will depend upon whether the State accepts the City`s proposed guidelines. She stated that she has sent the State a copy drafts of the guidelines; and the City is using the State's guidelines as a basis for this document. She stated that Lattice proposes to expand upon added value fabrication services as well. Planner Debbie Arke|l reminded the Commission that Lattice Materials Corporation received a CD8O economic development wan in )oon/ and the project under that application was scheduled for completion in February 1992. She stated that the program was complet- ed in August l991; and instead of hiring 14 persons, 9 of whom were LW| they hired 21 individuals, 14 of whom were low- or moderate-income. The Planner stated that under this application, the company projects creation of Yo permanent full-time or full-time equivalent jobs, 11 of which will be for low- and moderate-income persons. She noted that repre- sents 68,75 percent of the new jobs, which far exceeds the 57 percent required. Section V. Township 2 South' Range 6 East. Montana Principal Meridian filed by Dick Walter Motors, Appellant and Aggrieved Party, and Mike Hu*mphner Aggrieved Party. The subject site is more commonly located at 31910 East Frontage Road. Mayor Hawks opened the public hearing. Associate Planner Dave Skelton distributed to the Commissioners a copy of Section 18.58,080, which sets forth the procedure for hearing of an appeal as well as the options for decision following that hearing. He then briefly reviewed the procedure, noting that after the hearing has been held, the Commission may vote to uphold, overturn or modify the decision of the City-County Planning Board. Planner Skelton reminded the Commission that the subject site is located within the East Frontage Road entryway corridor as well as the 1-90 corridor. He stated that' since the size of the existing building is over 15 square feet this application was subjected to the major site plan review process. He stated that Mr. Dick Waiter has worked with staff over a period of time regarding the relocation of his auto dealership to this s/my not- ing that this application is subject to review under the provisions of the interim zoning ordinance. He then stated that the applicant is willing to pay his fair share of the costs of improving East Frontage Road to include one-half a local street standard for that portion of the roadway which fronts on Tract IA. The City Manager noted that one-half a local street standard includes 17 feet of mat plus curb and gutter. 3. That the applicant's domestic water wells be metered by the City Water De- partment to determine sanitary sewer charges, exclusive of water for land- scape irrigation, and that the meters and remote registers be installed by the City Water Department at the owner's cost prior to final site plan ap- proval. The Associate Planner stated that at the present time, the subject site is serviced by two private wells and the City's sanitary sewer facilities. He stated that this condition has been included so that the appropriate sanitary sewer charges can be established, based on the ocLuo| amount of domestic water used from these wells. Mr. Stokes stated that this condition has been clarified to the applicant's satisfac- tion. He noted that the City will monitor the meters wNch are to be installed on the do- mestic water *oUs using the water usage for the months of November, oecomher. January and February as the basis for establishing the sewer charge. u. That the sanitary sewer connection at the northwest corner of the property be corrected to comply with City standards or be disconnected, that the "p- grade to City standards or disconnection be at the owner's cost, and that it be resolved prior to final site plan approval. Associate Planner Skelton stated that there are presently two sanitary sewer lines to the subject site from the trunk line along the East Frontage upau, He stated that the City's Sewer Department has conducted a television monitor of the sewer lines and de- termined that the line running from the tap at the northwest corner of the property is no longer being used. He further noted that the tap at the center of the property has not been installed to City standards; and, therefore, groundwater is infiltrating into the sani- tary sewer line. He stated that under this condition, the City would disconnect and cap the northwest connection, at its expense, and upgrade the connection at the center of the property to meet City standards, at the appellant's expense. The Planner emphasized that the installation of these two sanitary sewer service lines occurred before the aggrieved parties became involved in the subject property. Responding to Commissioner Swanson, the Planner stated that while groundwater is infiltrating into the sewer line, the effluent is not going into the groundwater because of the difference in pressure. He indicated that this issue has been basically resolved. Mr. Stokes concurred that this issue has essentially been reso|ved. He then stated concurrence that the new landscaped areas much be protected by curbing. 10. Should the Bozeman City Commission grant approval of the applicant's re- quest for deviations, the applicant will provide the additional landscape buf- fer strip recommended by the Design Review Board. The landscape buffer strip shall be u minimum of five (5) feet in width with continuous concrete curbing, and will be located along the oast edge of the existing asphalt pavement, being approximately 300 square feet. The landscape buffer strip shall provide live vegetative grnondcvvor and the appropriate shade traaa and shall be graphically delineated on the site plan prior to final site plan approval. Associate Planner Skelton stated this condition relates to the next item on the ag*n- da since it involves a reduction in required landscaped area. He stated that this 300-square-foot landscaped area wvw/u be provided along the oast side of the area which will be utilized by Dick Walter Motors generally lying between the two structures on the subject tract. He noted that this landscaped area would be used to provide a buffer from the parked vehicles for those vehicles traveling *eat on both the East Frontage Road and the Interstate. That the applicant apply to the Planning Office for Minor Site Plan Review of the second structure located on the subject property prior to issuance of a building permit for any exterior construction or finish related to the auto dealership structure, that the minor site plan be reviewed and approved by the appropriate bodios, and that it obtain final site plan approval from the Planning Director, including endorsement of an Improvements Agreement by the property owner. Associate Planner Skelton reminded the Commission that a conditional use permit for Dick Walter Motors to relocate to North 7th Avenue, immediately adjacent to Trim/ina was approved, and has since expired. He then stated that Trim/inc has just relocated its auto detailing business to the second building on the subject tract and is therefore, immediate- ly adjacent to Dick Walter Motors in its new location. If all required conditions have not been sausfiou, an on-site inspection will be made and a report made to the City Commission for their appropriate action, The Associate Planner stated that, at the app|icant"s request, the Planning Board changed the length of time for installation of improvements from nine to twelve months. Mr' Stokes stated that he had requested twelve months for installation of improve- ments because of the time of year. He noted that if the applicant is unable to complete all of the planting in the spring' he must wait until fall to complete it. He stated that if the improvements are not completed within the twelve-month period, the City may then utilize the financial guarantee to complete the work. After the staff and appellant's attorney had completed their presentations as highlighted above the Commissioners asked various questions. Responding to Commissioner Knapp, Mr. Stokes stated the applicant has two *e||o *hk± provide domestic water. He noted that at the present time, the business has no fire suppression system, except for fire extinguishers. Responding to Commissioner Ovehrong, Mr. Stokes stated the appellant is now satisfied with the conditions for approval of the major site plan, as modified and clarified by staff. Mr. Mike H"emphner aggrieved party and owner of the yub}ooL property, indicated that he is also financially involved in Dick Walter Motors. He then stated that it seems many of the conditions have been satisfactorily addressed; however, he noted that such agreement was not reached until this past wc,k. He encouraged the Commission to modify the conditions as agreed upon with staff. Responding to Mayor Hawks' Mr' Huemphner stated that Dick Walter Motors filed the application for signs and landscaping on its portion of the lot; and the City staff tried to be both pieces of the tract together. He then stated that, as property owner, he does not know what Trim|ino's plans are for uiBnag*; however' their plan will he subjected to a minor site plan review after they submit the appropriate application. Mr. Muomphnor then noted the problems and frustrations which he as property owner, has incurred because two separate buildings and two separate businesses are located on one tract. Deviations from the off-street hi i | ea limitations for directional signs, and off-street parking lot landscape requirements - Dick Walter Motors, 31910 East Frontage Road; per DRB recommendations City Manager WyyvrW submitted to the Commission a memo from Planner Skelton, dated October 17. setting forth the deviations requested by Dick Walter Motors, 31910 East Frontage Road. Planner Dave Skelton provided a brief overview of this application. He stated that the applicant is seeking four deviations, as hu||owy: z. From the off-street parking requirements to allow 46 parking spaces rather than the required los parking spaces/ %. From the sign ordinance' to a(/ow an aggregate of sao square feet of signage, rather than the maximum aggregate of aso square feet; y. From the sign ordinance, to allow each face on two directional signs to contain o square feet, rather than the 4 square feet allowed; and 4- From the off-street parking lot landscape requirements, which require zo square feet of landscape area per parking space, The Planner stated tbat, given the size of the existing structure on the site, the code requires that loo off-street parking spaces be provided. He stated the Design Re- view Board concurs with the applicant's argument that the existing 46 striped parking spaces are adequate. Planner Skelton then addressed the proposed s|gnage for this project. He stated because this auto dealer represents so many different car manufacturers, it is extremely difficult to meet the 250-squane-hmt maximum for signaQe. He etatad that the applicant has proposed no signago on the building, rather he has proposed to slightly reorganize ' the signagn which was used at his previous location in one large freestanding sign which fronts on East Frontage Road. He noted that under the original proposal, the applicant proposed to place this sign at the northwest corner of the property and to exceed the maximum height of 24 feet- He stated that the Design Review Board recognized the visual impact which this would have, and worked with the applicant to redesign the sign, lower it to be in compliance with the height restrictions be setting it back from the roed, and re- locating it to the northeast corner of the site' The Planner stated that another free- standing is proposed in the southwest corner of the site, oriented toward |-yo; and that sign is in compliance with the height and size restrictions. Planner Dave Skelton stated that the the third requested deviation is for the two existing directional signs on the site.
