The meeting was opened with the Pledge of Allegiance and a moment of silence. None of the Commissioners requested that any of the Consent Items be removed for discussion. Minutes Mayor Hawks deferred action on the minutes of the regular meetings of August 19 and August zk 1991 for a period of one week. It was moved by Commissioner Oochrung seconded by Commissioner Frost, that the Commission approve the minutes of the regular meeting of October 7 1991 as submitted. The motion carried by the following Aye and No vote: those voting Aye being Commission- er Goehrung Commissioner Frost Commissioner Swanson, Commissioner Knapp and Mayor Hawks; those voting No none. Appointment of sub-committee to review Pledged Securities as of September m luo/ City Manager Wysocki reminded the Commission that the pledged securities must be reviewed quarterly according to State statute. It was moved by Commissioner Frost, seconded by Commissioner Goehrong that the Commission appoint Commissioner Swanson and Commissioner Knapp to review Pledged Secu- rities as of September 30, 1901. Staff report re water lines in f the community The City Manager submitted to the Commission a memo from Director of Public Ser- vice Ph|U Forbes, regarding water lines in the northwest sector of the cmmmunity. Director of Public Service Forbes highlighted the contents of the memo stating that he needs Commission direction regarding this issue. Mayor Hawks noted that this approach helps to direct where development will take place, which is something the City has been attempting to do. He then asked if installa- tion of sewer lines in these same locations has been considered. Director of Public Service Forbes responded that existing sewer trunk mains in that immediate area can be extended to provide sewer service when needed. He noted that wa- ter is the main concern at this time. City Manager Wysocki indicated that staff will bring back a contract for the engi- neering services for the water trunk lines as soon as possible. The Mayor thanked Director of Public Service Forbes for his presentation. Staff report re options for installation of sidewalk along South Third Avenue from Graf Street to Kagy Boulevard City Manager Wysocki submitted to the Commission a memo from Director of Public Service Forbes providing several options for installation of sidewalk along South Third Av- enue from Graf Street to Kagy Boulevard. The Director of Public Service briefly highlighted his memo. He stated that, staff as identified three options for the installation of sidewalks on the east side of South Third Avenue between Graf Street and Kagy Boulevard. (1) City - ordered sidewalk, in which the adjacent property owners would be ordered to pay the costs, with the City paying any costs which exceed 1.5 times normal installation costs; (2) a limited extended SID for side- walk improvements only, which would encompass lots in Westridge, Thompson's Third and Graf's Third Subdivisions to pay a majority of the costs on a per -lot basis, and Spring Meadows Subdivision to make a small contribution based on a previously - signed waiver of right to protest the creation of an SID for these improvements; and (3) an extended SID to improve South Third Avenue to a full collector street standard, which includes those subdivisions identified in No. 2, above, plus Figgins; Westfield, Phases I and II; Wood- ridge Subdivision; and the unplatted Westfield, Graf's Fourth, and Allison Annexations plus the school property. The Director then suggested that, due to the short timeframe available in this af- ternoon's meeting, he would respond to questions rather than making a more comprehensive presentation. Commissioner Swanson asked if there is any design work completed to date that would fit into Option No. 3. The Director responded that only design work for the sidewalk has been completed to date; and it would allow the sidewalk to interact with the probable future design of the roadway. He noted that more information must be provided to the potentially af- fected property owners; and it would be beneficial if he knew which way the Commission was leaning prior to disseminating the information to those individuals. Commissioner Frost stated support for Option No. 1 ; Commissioner Swanson stated support for Option No. 3, then No. 2, then No. 1; Commissioner Knapp stated she would be most comfortable with Option No. 2, noting that Option No. 3 would really be the opti- mum; Mayor Hawks stated support for Option No. 2; and Commissioner Goehrung stated he feels it is imperative to pursue Option No, 1, although he feels it would be beneficial to utilize Option No. 2 if that funding mechanism can be implemented and the work completed prior to the opening of the new elementary school. Responding to Commissioner Swanson, the Director stated that if it seems most ap- propriate to hold a public meeting with the potentially affected property owners, he will do SO. Responding to Commissioner Frost, the Director indicated that to utilize the SID process, the necessary steps must be started around December 1. He noted that the com- pletion date varies, depending on the option utilized; however, the project would be com- plete by the opening of school. The Commission thanked the Director for his presentation. Staff report re tax increment financing options (a) tax increment financing industrial district (b) urban renewal The City Manager submitted to the Commission a staff report, dated October 10, regarding tax increment financing options, along with some support information on such districts. Assistant to the City Manager Ron Brey reviewed the information provided in his staff report. He noted that, attached to his report, are copies of two proposed ordinances and one proposed resolution, which will be placed on next week's agenda for Commission action. He then reviewed the two programs which he has outlined in his memo, the first being the creation of a tax increment financing industrial district (TIFID) and the second being a determination on the desirability and feasibility of establishing an urban renewal tax increment financing (TIF) program. Assistant Brey stated that the 1889 Legislature adopted legislation which provides for the creation of a tax increment financing industrial district. He stated that under this legislation, a TIFID may be applied to any industrially zoned areas of the community which are under- serviced or under - utilized. He noted that such guidelines would require approval by the Commission before they could be uU|ized. He further suggested that a policy for amending districts or cre- ating subsequent districts would be appropriate. Further responding to the Mayor Assistant Brey stated that an urban renewal dis- trict and a tax increment financing industrial district may not overlap, and a tax increment financing industrial district may not include non-connected areas under the State statutes. The Commission thanked Assistant Drey for his presentation, noting they would consider action on the ordinances and resolution at next week's meeting. Discussion revision f faoa ch arged City Manager Wysocki reminded the Commission that this item was requested by Commissioner Frost. Commissioner Frost stated that following discussion with Planning Director Epy|m' he feels it is important to review and revise the fees charged by the Planning Department. He noted that this is an issue which has been brought up at Planning Board meetings on a regular basis over the past two years. He noted that, duo to staff time cuostraints, the issue has never been adequately addressed. He then proposed that the Commission direct the Planning Board through the Planning Director, to develop a new [ua schedule which more adequately covers the costs involved. He further noted that for some of the major development reviows, the taxpayers of the communities have incurred thousands of dollars of those costa; and he also feels that the fees for many of the "weekend" projects are much too high. Commissioner Swanson suggested that with the amount of activity which is taking place in the Planning office during this comment period on the final zone code, it may be more appropriate to delay this review of the fee schedule until after the public hearing process has been completed. Commissioner Frost stated an interest in seeing the request forwarded immediately, noting that it will not actually be started for several weeks anyway. Commissioner Swanson asked if this request should be made more formally than just through o motion and vote. He then suggested that a memo providing more specific dirac- tion mentioning issues like the h:o for "weekend" projects, might be beneficial. Commissioner Frost stated his willingness to prepare such a memo. It was moved by Commissioner Swanson, seconded by Commissioner Knapp, that the Commission refer the issue of revising fees charged by the Planning Department to the City-County Planning Board, for their review and recommendation. He noted that the Commission may identify other potential amendments which require more time and study before being for- warded through the process; and they will follow the normal channels for zone code amendments at the appropriate times. The Mayor stated that this afternoon, Commissioners will pare the list of proposed amendments down to those which will be forwarded through the 90 -day process. He stated this is not a public hearing; therefore, public comment will be limited. He noted that sub - mitters, however, will be given an opportunity to clarify their proposals if they feel that the Commissioners have misinterpreted their written statements. Planning Director Andy Epple submitted to the Commission a memo, dated October 15, in which he had "sorted" the comments received into four proposed categories for Com- mission consideration. He then briefly highlighted each of those four categories, as fol- lows: Category 1 - those comments which staff feels can be eliminated from further consideration by the Commission because (1) the amendment would create a provision in the zone code which is not in substantial compliance with the Master Plan; (2) the provision had always been a part of the zone code (of- ten based on statutory authority); (3) it appears to represent a misinterpre- tation by the submi'tter; or (4) the amendment would conflict with the intent and purpose of the zone code. Category 2 - those comments which staff feels can be addressed through mi- nor language modifications to the code, and which do not represent "sub- stantive" changes in policy direction. These comments are generally clari- fications of language and could be forwarded for public hearing during this ninety -day review process. Category 3 - those comments which represent substantive changes to the code, but which appear to reflect a consensus among submitters, staff and the Commission. These comments should be forwarded through the amend- ment process; however, they cannot be adequately addressed and accom- modated through this initial ninety--day review process. Category 4 - those comments which represent substantive changes in policy direction, about which (1) there does not appear to be consensus or (2) staff needs more time to evaluate and develop viable working solutions. These comments need a substantial amount of additional work and, therefore, will not be ready for further consideration as soon as the other categories. The Planning Director stated that, due to time constraints, he has been able to complete comments on only Categories 1 and 2 in this memo; and staff comments on Cat- egories 3 and 4 will be forthcoming prior to next week's meeting. The Commission concurred in the Planning Director's assessment that a lay person should not be included on the DRC. 3. Lot width. Planning Director Epple stated that this section of the code specifies that a lot must be a minimum of 25 feet wide at the building setback line, which is typically 25 feet in a residential district. He stated that the individuals who have forwarded this proposed zone code amendment are concerned about lots located on cul -de -sacs which might have street frontages of less than 25 feet. He then suggested that this section, as written, is appro- priate, and that this amendment was proposed due to a misinterpretation. The Commission concurred no revisions should be considered. 9.b. Planning Board versus DRB recommendations on deviations. The Commission concurred this item should be eliminated. 5. Reviews on developments lying wholly or partially within an overlay district. The Planning Director stated that the code includes a provision for artificial lots, which he feels would adequately address the concerns raised under this proposed amend- ment. He suggested that any development in the interior of a parcel, outside the overlay district boundaries, would not be subjected to this review. The Planning Director stated that a question has been raised about whether an en- tire Planned Unit Development would be subjected to this review if a portion of it lies within the overlay district. He then suggested that it would be, since development of the entire parcel would be subjected to the same review process. Mr. Joe Sabol stated that he does not disagree with the logic; however, he does not feel that development of an entire parcel should be subjected to the overlay review process just because ten feet of the property lies within the district. Responding to Mayor Hawks, the Planning Director stated he feels the applicant can control the situation by placing his "development" of the site outside the district bounda- ry. He then suggested that if the Commission wishes to address this item, it should be placed in Category 3, since it will take more time to complete than the 90 -day process al- lows. Commissioner Frost noted that the overlay district extends 660 feet back from major entryways and 330 feet back from minor entryways. He then asked, for reference, how deep the K -Mart lot is; the Planning Director estimated it is 1,000 feet deep. Commissioner Frost and Mayor Hawks suggested this item would be worth further review. Elimination of sign amortization. The Planning Director stated that an amortization schedule is essential and neces- sary to ensure reasonable compliance with the sign code.
