Application with variance requests for a 9,682 sq. ft. addition, free standing bell
tower in the front yard and related improvements

RECOMMENDATION: That the City Commission consider reclaiming to itself the final approval of
the Resurrection Catholic Church Conditional Use Permit Application with variances, per Section
18.64.010 C.1 of the B.M.C., and further set a tentative public hearing date of February 28, 2011 for
formal consideration of the application.
BACKGROUND: On January 27, 2011, the applicant’s representative, Bob Mechels of Dowling
Sandholm Architects submitted written request to the City Clerk’s Office that the City Commission
reclaim to itself the final approval of Resurrection Catholic Church Conditional Use Permit Application
which includes variance requests for the construction of a bell tower in the front yard. The proposed bell
tower would be taller than the proposed addition to the existing building. Staff has deemed the bell tower
an accessory structure, and as such Sections 18.38.050.E.1, BMC and 18.38.050.G.1, BMC prohibit its
construction.
The application is currently scheduled for its 3rd review with the Development Review Committee on
February 2nd. A wetlands report was prepared for the project and is currently being distributed to members
of the Bozeman Wetlands Review Board. This application is currently scheduled to be heard by the Board
of Adjustment on March 8, 2011.
UNRESOLVED ISSUES: None identified.
FISCAL IMPACTS: None.
ALTERNATIVES: As suggested by the City Commission.

RE: Resurrection Parish Catholic Church with Variance Request (Application #Z-10356)
Mayor and Commissioners:
On behalf of our client, Resurrection University Parish Catholic Church, we are respectfully
requesting that the City Commission reclaim this project for review. The project includes an
addition to the existing church located at 1725 S. 11th Avenue, which is along the south edge of
the MSU campus.
The existing Church with proposed addition is a Conditional Use within its R4 zone. We are
submitting two variance requests, the first to Section 18.38.050 G.1 of the Unified Development
Ordinance (UDO) and the second to 18.38.060 D.1. Section 18.38.050G.1 addresses detached
accessory structures in front, side or corner-side yards and Section 18.38.060 D.1 addresses
Height Limitation Exceptions.
Due to the unique design goals and challenges of church projects, the location and context of
this particular church and the lack of clear code definition and requirements pertaining to bell
towers, we feel it is most appropriate to take this course of action. If you have any question
