SUBJECT: Approve Resolution 4310 authorizing the City Manager to sign
Change Order #19 for the Lower Yard Vehicle Maintenance and HRDC Bus Barn. The Change
Order reflects multiple items for mechanical and electrical, code compliance, site issues, and
owner initiated changes.

RECOMMENDATION: Approve Resolution 4310 authorizing the City Manger to sign
Change Order #19 in the amount of $7,749.79, (City of Bozeman portion), for the Lower Yard
Vehicle Maintenance and HRDC Bus Barn.
This change includes 14 Change Proposals for mechanical, electrical, code compliance, site
issues, and owner initiated changes.
BACKGROUND: The vehicle maintenance staff is now working out of the new facility at
the lower yard. A certificate of occupancy has been issued by the building department and the
crews are getting all their materials and equipment set up. The ribbon cutting ceremony is
planned for February 2nd.
The items included in this Change Order are made up of 14 Change Proposals. CP #52, Lot
paving, ($38,842.35-100% HRDC); CP #60, antenna mount, ($330.00-100% HRDC); and CP
#68, antenna conduit, ($139.68-100% HRDC) are owner initiated changes from HRDC and are
their responsibility.
Owner initiated changes by the city include CP #55, OS & Y Valve Rotation on the fire sprinkler
system. The original orientation of the valve was too close to one of the entrance doors in the
vehicle maintenance, ($437.80-100% COB); CP #58, Two additional bollards to protect
communications equipment located in the north parking area, ($586.30-50/50); CP #59, Purchase
waste oil to operate waste oil burner. There was not enough waste oil on hand to fire up the

system to test the operation and to heat the building during the initial move in, ($552.00-50/50);
CP #67, Roof top snow fence to prevent snow coming off the roof on the water fill station,
($3,282.08-50/50)
Electrical modifications are included in CP #54A, TOX Alert System, The mechanical control
system for the boilers was not designed to fully interface with the pumps and motors associated
with the hot water distribution system. This charge is for some additional control equipment, a
transformer, additional manual overrides on the pumps, and additional conduit and labor costs
for the electrician, ($4,920.97-50/50); CP #57, relocation of mechanical room lights. Pumps, hot
water lines, and gas lines suspended from the ceilings required the relocation of some of the light
fixtures in the mechanical room, ($292.50-50/50); CP #64, Mohawk lift sensor. Vehicle
maintenance staff was concerned that some of the taller trucks might hit on some of the sprinkler
lines when the lift was fully raised. This cost is for the installation or an electronic eye that will
automatically halt the raising of the lift if the top of the truck breaks the light beam that is just
below the location of the fire suppression line, ($842.40-100% COB);
Code related changes include CP #61, Concrete exit pad on shop door. Code requires that the
step out from the exit door of the building be at the same grade inside and outside of the
building, ($780.00-50/50); CP #62, Emergency Shutoff for boilers, ($573.20-50/50); CP #65,
Close openings in ceiling areas in the south entry hallway for a good fire break, ($440.00-50/50);
CP #66, Exit and Entry lights with emergency battery back-ups were installed. Credit was
received for the originally specified fixtures, ($1,512.13-50/50)
UNRESOLVED ISSUES: All these Change Proposals were reviewed carefully with the
Architects and the Contractor. These charges were reviewed carefully and some of the costs for
the changes were shared. For example, on a number of the changes the Contractor pulled any of
their mark-up from the charges.
There are some items that are still under review and discussion and staff anticipated one final
Change Order prior to full close out of the project.
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: The costs associated with the items in this change order will be
paid out of the project contingency fund. Through Change Order #19, the current balance for the
Pre-Construction Change Orders is $5,465.62. The balance for the 12% Project Contingency
Change Order is $30,471.30. The summary of activity for the contingency fund is shown below.

COMMISSION RESOLUTION NO. 4310
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF
CONTRACT WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 5th day of October 2009, authorize award of the
bid for the Construction of the Vehicle Maintenance Building and HRDC Bus Barn to BN Builders,
Bozeman, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman,
a municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #19,
attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and
directed to execute the contract change order for and on behalf of the City; and the City Clerk is
authorized and directed to attest such signature.
