HomeMy WebLinkAboutResolution 3535 Fire mill levy for ballot .---..-----.------- ------- -.----.-..-.. ----.--- - -. - ---.- COMMISSION RESOLUTION NO. 3535 A RESOLUTION OF THE CITY COMMISSION SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF BOZEMAN, MONTANA, THE QUESTION OF AUTHORIZING THE BOZEMAN CITY COMMISSION TO EXCEED THE STATUTORY MILL LEVY ALLOWED BY SECTION 15-10-420, M.C.A., BY LEVYING UP TO EIGHT (8) MILLS ANNUALLY, FOR A PERIOD NOT TO EXCEED THREE (3) YEARS, TO FUND CAPITAL PROJECTS FOR THE BOZEMAN FIRE DEPARTMENT. WHEREAS, the Bozeman Fire Department has reviewed its capital needs; and WHEREAS, City staff has conducted a complete analysis of its revenues and expenditures for the past two years as well as projected revenues for the upcoming fiscal year; and WHEREAS, it appears that the expenditure level necessary to continue to maintain adequate fire protection services to the citizens of the City of Bozeman cannot be reached by existing revenues; and WHEREAS, Section 7-6-4431, Montana Code Annotated, authorizes a municipal governing body to exceed the maximum mill levy allowed by Section 15-10-420, M.C.A., upon approval of a majority of the qualified electors voting in an election; and WHEREAS, the City Commission desires to present to the electors a proposal to authorize the City of Bozeman to levy up to eight mills annually for a period not to exceed three years to fund capital projects for the Bozeman Fire Department. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That additional monies are needed to fund capital projects in the Bozeman Fire Department, as follows: Pumper truck and equipment $ 420,000.00 (Replace 1979 Darley) Hazardous materials and rescue truck (Replace 1978 haz mat van) 300,000.00 Replacement utility vehicle (Replace 1991 Jeep) 36,500.00 Replacement utility vehicle (Replace 1993 Suburban) 36,500.00 Clean Room Addition at Fire Station No. 1 100,000.00 Fire Station No. 2 (Remodel to accommodate larger apparatus; Ventilation system upgrade) 107,000.00 $1,000,000.00 ----_on -----.-- -.---- Section 2 That the ballot question to authorize the Bozeman City Commission to exceed the statutory mill levy allowed by Section 15-10-420, M.C.A., by levying up to eight mills annually, for a period not to exceed three years, to fund capital projects for the Bozeman Fire Department shall be submitted to the registered electors of the City of Bozeman at the general election to be held on Tuesday, November 5, 2002, and the wording of the ballot measure shall be substantially as follows: NOTICE OF SPECIAL ELECTION CITY OF BOZEMAN, MONTANA NOTICE IS HEREBY GIVEN that on the 5th day of November 2002, an election will be held in and for the City of Bozeman, Montana, on the question of authorizing the Bozeman City Commissioners to make a levy of up to eight (8) mills in addition to the mill levy limit imposed by law for the purpose of funding capital projects for the Bozeman Fire Department, as follows: PROPOSITION That the City Commission of the City of Bozeman, Montana, be authorized to exceed the statutory mill levy allowed by Section 15-10-420, M.C.A., by levying up to eight mills annually, for a period not to exceed three years, to fund capital projects for the Bozeman Fire Department. The specific amount of money that is to be raised, based on the City of Bozeman Fiscal Year 2002 mill rate, is $334,000 annually. The levy shall be for three years. Approval of this additional mill levy will result in an annual increase of $19.1 0 for a home with an assessed valuation of $100,000, or an annual increase of $38.20 for a home with an assessed valuation of $200,000. o FOR Authorizing the City Commission of the City of Bozeman to exceed the statutory mill levy allowed by Section 15-10-420, M.C.A., by levying up to eight mills annually, for a period not to exceed three years, to fund capital projects for the Bozeman Fire Department. o AGAINST Authorizing the City Commission of the City of Bozeman to exceed the statutory mill levy allowed by Section 15-10-420, M.C.A., by levying up to eight mills annually, for a period not to exceed three years, to fund capital projects for the Bozeman Fire Department. The election shall be held on November 5, 2002. Section 3 That, upon a favorable vote of the public, the mill levy may be set and levied by the City Commission annually, with those property tax revenues being used for the single purpose of funding capital projects for the Bozeman Fire Department listed in Section 1 above. -2- PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 19th day of August 2002. ~~- STEVE R.
