COMMISSION RESOLUTION NO. 3531
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,
PROVIDING FOR THE
ANNEXATION OF A
CERTAIN
NONCONTIGUOUS TRACT OF LAND, HEREINAFTER DESCRIBED,
TO THE
CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION
OF
THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE
SAID
NONCONTIGUOUS TRACT.
WH EREAS, the City of Bozeman received a request for
annexation from Bridger Headlands
L.L.C., owner of the tract, requesting the City Commission to extend the boundaries of the City of
Bozeman so as to include a certain noncontiguous tract of land lying along the south side of Bridger
Drive and east of the intersection of Bridger Drive and Story Mill Road in the County of Gallatin, State
of Montana; and
WHEREAS, an annexation staff report has been prepared
in accordance with the
Commission's goals and policies for annexation and was presented to the Commission on February
20,2001; and
WHEREAS, a public hearing on the petition was duly noticed
and held on February 20,2001;
and
WHEREAS, two members of the general public voiced objections
to said annexation at the
public hearing; and
WH EREAS, the City did not receive any written protest
from the real property owners of the
area to be annexed; and
WHEREAS, on February 20, 2001, the Commission authorized
and directed staff, upon
satisfaction by the applicant of the conditions of approval, to prepare the necessary documents to
proceed with the annexation of this tract; and
WHEREAS, the provision of available services, including,
but not limited to, rights-of-way,
easements, water rights or cash in lieu, waivers of protest against creation of SID's and water and
sewer hookup fees, to said noncontiguous tract is the subject of a written agreement between the City
and Bridger Headlands, L.L.C., record owner of the tract; and
WHEREAS, said noncontiguous tract is the subject of
a plat or Certificate of Survey, filed in
the office of the Gallatin County Clerk and Recorder's Office; and

WHEREAS, the Bozeman City Commission hereby finds that the annexation of this
noncontiguous tract is in the best interests of the City of Bozeman and the inhabitants thereof and of
the inhabitants of the noncontiguous tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 46, M.C.A., the following-
described property, which is noncontiguous to the municipal boundaries of the City of Bozeman, be
annexed to the City of Bozeman and that the boundaries of said City shall be extended so as to
embrace and include such 26.606 acres of land, to wit:
A tract of land being described as Tract A of Certificate of Survey No. 2220, located
in the Southeast one-quarter and Southwest one-quarter of Section 32, Township
1 South, Range 6 East, Principal Meridian Montana, City of Bozeman, Gallatin
County, Montana, and being further described as follows:
Beginning at the Northwest corner of said Tract A, thence along said Tract A
through the following courses:
North 89028'56" East a distance of 54.51 feet, North 00004'18" West a distance of
20.00 feet, North 89055'42" East a distance of 1010.06 feet, North 89055'09" East
a distance of 1349.78 feet, North 89050'54" East a distance of 300.03 feet, South
00004'12" East a distance of 516.51 feet, South 89056'37" West a distance of 85.70
feet, North 89050'00" West a distance of 230.48 feet, North 89058'35" West a
distance of 341.81 feet, North 01014'44'.' West a distance of 100.02 feet, South
89041'50" West a distance of 153.58 feet, North 89057'48" West a distance of
120.95 feet, South 89050'43" West a distance of 121.06 feet, South 89055'42" West,
a distance of 121.07 feet, North 89059'39" West a distance of 127.39 feet, South
89056'39" West a distance of 114.38 feet, South 89056'40" West a distance of

Section 2
The effective date of this annexation is August 15, 2002.
Section 3
The annexation of the above-described tract is subject to the terms of the Agreement dated
August 5,2002, by and between the City of Bozeman and Bridger Headlands, L.L.C.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 5th day August 2002.
