SUBJECT: Sketch Plan Application #Z-10295 proposes the construction of Class II
trails in the Northeast Urban Renewal District. Class II trails receive heavy to moderate use and
are ADA accessible. They are intended for multiple non-motorized, recreational and commuter use.
Class II trails are constructed of natural fines and are 6 feet in width. The Northeast Urban Renewal
Board (NURB) is proposing that trails be constructed in undeveloped portions of the public right-
of-way, specifically two sections: 1) N. Church Avenue between Tamarack and Cottonwood
Streets and 2) E. Aspen Street, between N. Wallace Avenue and Ida Avenue (across from the
recently completed Depot Park).

RECOMMENDATION: Staff recommends approval of Sketch Plan Application #Z-10295 as
conditioned by Staff.
BACKGROUND: Per section 18.02.080.B, Bozeman Municipal Code (BMC): To the extent
reasonable, all City-owned land shall be subject to applicable regulations of the underlying zoning
district. Development of such land shall be subject to approval by the City Commission upon review
of the development review committee [DRC] and other review bodies as may be required by this title.
Review process to date:
· The DRC reviewed this project on November 24, 2010. Per Section 18.52.110,
“Recreational Pathways”, The DRC shall be responsible for determining whether a
pathway is a transportation pathway or a recreation pathway.
The DRC deemed the proposed trails recreational pathways for the following reasons:
1) The trail locations are within undeveloped portions of the N. Church and E. Aspen
Street right-of-ways;
2) The improvements are not proposed in conjunction with any development and;
3) They may be deemed recreational pathways until future development occurs on the
adjacent parcels
· The DRC approved the project as conditioned by staff and forwarded a favorable
recommendation to the City Commission (see attached Sketch Plan materials).
· On December 3, 2010, a maintenance agreement drafted by Ted Lange of Gallatin Valley
Land Trust (GVLT) was finalized at the Recreation and Parks Advisory Board (RPAB)

Subdivision Subcommittee meeting. Maintenance of the trails will be jointly managed by
GVLT, the Northeast Neighborhood Association (NENA) and the Bozeman Parks
Division with GVLT taking the lead responsibility.
· On December 6, 2010 both project locations were posted with public notice signs with
meeting dates and contact information for public comment.
· Per Section 18.50.110, “Recreational Pathways”, Recreational pathways must be
reviewed by the Recreation and Parks Advisory Board (RPAB). They did so on December
9th, 2010, and found the Class II (six foot wide natural fines trail) appropriate for this
project and locations.
· Public comment was taken at the RPAB meeting (attached)
· In response to public comment, Planning Staff added the following condition: The
widening of the existing trail in the N. Church Avenue right-of-way, to the greatest extent
feasible, will be widened away from the creek to the east to reduce any potential impact
to the creek.
· No additional public comment has been received
FISCAL EFFECTS: The FY2011 Annual Work Plan and Budget for the Northeast Urban
Renewal Board allocated $4,300 for improvements to the North Church Avenue trail and $9,000
for the Aspen Street Right-of-Way Open Space Improvements. Preliminary cost estimates
indicate that this is sufficient funding.
ALTERNATIVES: As suggested by the City Commission.

The Development Review Committee met regarding the trail proposals within the Northeast Urban Renewal
District on November 24, 2010. The DRC deemed the proposed pathways as recreational pathways for the
following reasons:
1) The trail locations are within undeveloped portions of the N. Church and E. Aspen Street right-of-ways;
2) The improvements are not proposed in conjunction with any development and;
3) They may be deemed recreational pathways until future development occurs on the adjacent parcels
The DRC also forwarded a favorable recommendation of approval to the City Commission with the following
conditions from staff:
ENGINEERING
Standard conditions/code provisions:
1. The FSP shall be adequately dimensioned. A complete legend of all line types used shall also be provided.
2. Drive approach and public street intersection sight triangles shall be free of plantings which at mature growth
will obscure vision within the sight triangle.
3. The applicant shall submit a construction route map dictating how materials and heavy equipment will travel to
and from the site in accordance with section 18.74.020.A.1 of the Unified Development Ordinance. This shall be
submitted as part of the final site plan for site developments, or with the infrastructure plans for subdivisions. It
shall be the responsibility of the applicant to ensure that the construction traffic follows the approved routes.
4. All construction activities shall comply with section 18.74.020.A.2. of the Unified Development Ordinance.
This shall include routine cleaning/sweeping of material that is dragged to adjacent streets. The City may require
a guarantee as allowed for under this section at any time during the construction to ensure any damages or
cleaning that are required are complete. The developer shall be responsible to reimburse the City for all costs
associated with the work if it becomes necessary for the City to correct any problems that are identified.

Project Specific Conditions:
5. Any trails proposed in the location of existing curb/gutter and a paved street shall be constructed as city
standard sidewalk.
6. City of Bozeman standard Dead End Barricades will be used at the area of transition between the public
roadway and the proposed trail. (City of Bozeman Standard drawing No. 09810-2)
7. City of Bozeman standard Class II trail shall be used in all areas of the proposed fines trail. (City of Bozeman
Standard drawing No. 02529-18)
8. An encroachment permit must be obtained from the City Engineering Department prior to commencing work.
PLANNING
Conditions and Code Provisions
1) Per Section 18.50.110.D, “Recreation Pathways”, The class of the trail shall be determined by the Recreation
and Parks Advisory Board, and the trail shall be designed and constructed according to any adopted park or
recreation plan or other City specifications and standards. Trails and bridges must meet Americans with
Disabilities Act (ADA) specifications for recreational facilities and maintain a natural appearance. Trail plans and
specifications shall be submitted to the Planning Department for review and approval prior to installation.
2) Per Section 18.42.100, “Watercourse Setback”,
(1) Trails, and trail-related improvements such as benches and trail signage, may be placed in Zone 2;
(2) Limited, non-looping developed spur trails to the water’s edge may cross all zones. Benches and
limited informational/interpretive signage may be placed in Zone 1 at the terminus of spur trails;
The benches and picnic tables proposed in the N. Church Avenue right-of-way along Bozeman Creek shall be
placed 45 feet from the edge of the creek or placed at the trail’s intersection with the bridge.
3) The City Commission must grant permission to perform work in the City public rights-of-way.
4) A maintenance agreement must be prepared and signed by responsible party(ies) prior to presenting this
proposal to the City Commission.
5) The barricade and totem shall be placed within the Aspen Street right-of-way but outside of the Ida Street right-
of-way
6) Bench and picnic table design shall be submitted to the Planning Department and Parks Division for approval
prior to installation
7) Trail construction must be monitored by the Parks Division to ensure compliance with the City Standard.

SUBJECT: Northeast Urban Renewal District Trails
REVIEWED ON: 12/3/2010
BACKGROUND:
· These trails are proposed on city owned easement and currently are historical social trail,
connecting to Depot Park. DRC designated the trail as a “Recreational Pathway”, rather
than a “Transportation Pathway”. This calls for a recommendation from RPAB as to the
class of trail.
COMMENTS:
· There are no sidewalks in this neighborhood. Properly developed trails with signage will
give it better definition.
RECOMMENDATION:
· Engineering, GVLT, and Subdivision Review recommend a class 2 trail. This is a 6’
wide natural fines trail. It meets ADA requirements.
FISCAL EFFECTS:
· The project will be financed through taxes already collected, donations, and volunteer
labor.
ALTERNATIVES:
· Sidewalks would be the logical alternative but the money is insufficient
